COMMISSION ON PUBLIC WORKS/UTILITIES COUNCIL ROOM JUNE 9, 2015 6:45 P.M. The Commission on Public Works/Utilities met in regular session, Chair Horn presiding. On roll call: all members present. The minutes of the previous meeting were declared approved. Director of Public Works Flynn reported on one burial at the cemetery, equipment maintenance, mowing and weed eating cemetery and parks, trash pickup, watering flowers, preparing for new shingles on the Gazebo, mowed eight residential lots, hauled brush and compost, working on street lighting, cleaning storm drains, street sweeping, preparing for line painting, saw cutting patches for street repair, the Grand Avenue reconstruction project excavating is about 75% complete with curb and gutter next, and a lot of “mow your lawn” letters have been sent out. Director of Public Works Flynn presented the AECOM Task Order 17 for General Engineering on the Wastewater Screening project for pre-construction meeting, shop drawing review, coordination and site inspection services at the cost of $5,200. The Pledge of Allegiance was recited. The minutes of the previous meeting were declared approved. Council Member Neville reported on the May 28 and June 4, 2015 meetings of the Heritage Days Committee regarding: 1) an update on donations, 2) discussion on the Miss Neillsville Contest – Larry Hoeser will emcee, 3) discussion on the electric power needs and update on the new electrical service installed on the north end, 4) an update on the golf outing, 5) a new meter socket was installed at the tennis court and the service was updated on the south end to better accommodate having bands, 6) an update on the pub crawl, 7) discussed bartender schedule; 8) update on the Miss Neillsville Contest – four girls are running, 9) update on movie night, 10) update on the mini rods event, 11) discussion on beverages, bean bag tournament, posters, tents and signage. Council Member Neville reported on the June 1, 2015 meeting of the Grants Committee regarding: 1) discussion on and recommendation that the “Procedures for Approving Emergency Repair Loans” be approved, and 2) discussion on, amending and recommendation that the “City of Neillsville CDBG Housing Program Policy for Loan Approval” as amended be adopted. Council Member Quicker reported on the June 9, 2015 meeting of the Commission on Public Works/Utilities regarding: 1) current activities, and 2) the recommendation that the AECOM Task Order 17 General Engineering – Wastewater Screening at a cost of $5,200 be approved. Mayor Mabie declared all reports filed as presented with the City Clerk. Mayor Mabie asked if there were any questions on the Grants Committee items (1 and 2). City Attorney Wachsmuth read the following ordinance, stating that Chief of Police Klueckmann wanted “911” calls added, so the whole ordinance has been reworked. ORDINANCE NO. 1050 AN ORDINANCE AMENDING §9-2-4 HARRASSING OR OBSCENE TELEPHONE CALLS The Common Council of the City of Neillsville does hereby ordain as follows: The index to Title 9, Chapter 2 shall be changed to read: §9-2-4 Unlawful Telephone Use Section 9-2-4 is hereby amended as follows: Sec. 9-2-4 UNLAWFUL TELEPHONE USE Whoever does any of the following shall be subject to the penalty as provided in this Municipal Code: (a) HARASSING OR OBSCENE TELEPHONE CALLS (1) Makes any comment, request, suggestion or proposal which is obscene, lewd, lascivious, filthy, or indecent; (2) Makes a telephone call, whether or not conversation ensues, with the intent to abuse, threaten or harass any person at the called number or numbers; (3) Makes or causes the telephone of another repeatedly or continuously to ring, with intent to harass any person at the called number or numbers; (4) Make repeated telephone calls, during which conversation ensues, solely to harass any person at the called number or numbers; (5) Knowingly permits any telephone under his control to be used for any purpose prohibited by this section; (6) In conspiracy or concerted action with other persons, makes repeated calls or simultaneous calls solely to harass any person at the called number or numbers. (b) IMPROPER USE OF 911 EMERGENCY PHONE SYSTEM No person shall: (1) Intentionally dial the telephone number “911” to report an emergency, knowing that the fact situation which he or she is reported does not exist. (2) Intentionally dial the number “911” for no legitimate purpose. (3) Intentionally dial the number “911” for a non-emergency reason. For the purposes of this section “emergency” shall mean a situation in which  property or human life are in jeopardy and the prompt summoning of aid is essential. (4) Intentionally dial the number “911”, but fails to report an emergency or fails to hang up, causing an open line. City Attorney Wachsmuth reported on the two billboard lease agreements in the City’s industrial park with Shubert and Hoey Outdoor Advertising. Our fee would be $600 per year per billboard on a five year contract. Rental fees are based on size, location, electricity or not – these billboards are 12 feet by 20 feet, and the range runs from $500 to $700 on a 10-year contract. Motion Glassbrenner, second Neville, to authorize renewal of the two industrial park billboard lease agreements with Shubert and Hoey Advertising, Inc. at a rental fee of $600 per year per sign on a five-year contract (2015-2020). All Aye. The City Clerk presented the 2015 Recycling Grant funds received from the State of Wisconsin Department of Natural Resources in the amount of $9,356.31 (2014 was $9,357.41). Motion Counsell, second Neville, to accept and appropriate $9,356.31 Recycling Grant funds to Account No. 53620 Refuse and Garbage Collection. All Aye. City Clerk Roehl reported that the League of Wisconsin Municipalities Mutual Insurance (LWMMI) has announced that the Wisconsin Insurance Commissioner has approved the incorporation of Municipal Property Insurance Company (MPIC). LWMMI working together with Cities and Villages Mutual Insurance Company (CVMIC) and Wisconsin Municipal Mutual Insurance Company (WMMIC) have created this member-owned company and are on track to issue quotations in August and policies on October 1, 2015. LWMMI members will be served by their current insurance agents, who will be also appointed as MPIC insurance agents. Council Member Glassbrenner reported that as part of the State budget, the Joint Finance Committee has inserted changes to the Room Tax law which eliminate municipal governing body discretion to spend room tax revenues directly on tourism promotion and development. The amendment mandates that municipalities transfer the revenues (70%) designated for tourism promotion and development to an unelected tourism entity or commission for spending. Discussion followed. Council Member Glassbrenner stated that he called Governor Walker’s office and asked him to veto this change, and he also called State Senator Moulton and Representative Kulp to ask them to contact the Governor to veto this change. Council Members Clough and Counsell reported on attending the League of Wisconsin Municipalities New Officials Workshop in Green Bay. Mayor Mabie reported on a thank you from the Daniel Clough family (his mother’s funeral).
