MINUTES OF THE NEW BRAUNFELS CITY COUNCIL REGULAR MEETING OF MONDAY, MAY 8, 2017 The City Council of the City of New Braunfels, Texas, convened in a Regular Session on May 8, 2017, at 6:00 p.m. City Councilmembers present were: Present: 7 - Mayor Barron Casteel, Councilmember George Green, Councilmember Justin Meadows, Councilmember Ron Reaves, Councilmember Chris Monceballez, Mayor Pro Tem Wayne Peters, and Councilmember Leah García City Staff present were: City Manager Robert Camareno, Assistant City Manager Kristi Aday, City Attorney Valeria Acevedo, City Secretary Patrick Aten, Assistant City Secretary Andrea Cunningham, Downtown Development Coordinator and Historic Preservation Officer Amy McWhorter, Parks and Recreation Director Stacey Dicke, Solid Waste Manager Mike Mundell, Planning and Community Development Director Christopher Looney, Planning Manager Stacy Snell, Planner Matt Greene, Planner Katherine Crowe, and Economic Development Manager Jeff Jewell. The meeting was called to order by Mayor Casteel in the New Braunfels City Hall Council Chambers at 6:03 p.m. Councilmember Meadows gave the invocation; and Mayor Casteel led the Pledge of Allegiance and the Salute to the Texas Flag. PROCLAMATIONS: A) Nursing Home Week Mayor Casteel proclaimed the week of May 14-20, 2017 as National Nursing Home Week. B) Letter Carriers' Food Drive Day Mayor Casteel proclaimed May 13, 2017, as Letter Carriers' Food Drive Day. C) Small Business Week Monday, May 8, 2017 New Braunfels City Council Regular Meeting  Mayor Casteel proclaimed April 30 - May 6, 2017 as Small Business Week. D) Historic Preservation Month Mayor Casteel proclaimed the month of May, 2017 as Historic Preservation Month. E) Economic Development Week Mayor Casteel proclaimed the week of May 7-13, 2017, as Economic Development Week. PRESENTATIONS: A) Presentation and discussion on the results and major conclusions of the 2017 New Braunfels Citizen Survey conducted by the National Research Center. National Research Center Survey Associate Morgan Adams presented the results of the 2017 New Braunfels Citizen Survey. 1. MINUTES A) Discuss and consider approval of the minutes of the regular City Council meeting of April 24, 2017. Mayor Casteel read the aforementioned caption. A motion was made by Councilmember Green, seconded by Councilmember Monceballez, that this item be approved. The motion passed unanimously. 2. CITIZENS' COMMUNICATIONS Tracy Graves spoke regarding transportation for the disabled. Norma Rangel spoke regarding a zoning and permit issue. Chase Cochran thanked the Mayor for his assistance with a code issue, and spoke regarding Landa Park street closures. Ron Savage spoke regarding truck traffic on Orion Drive. Monday, May 8, 2017 New Braunfels City Council Regular Meeting 3. CONSENT AGENDA A) Approval of the appointment of one individual to the Airport Advisory Board for a term ending May 12, 2020. B) Approval of the Mayoral appointment of one individual to the New Braunfels Partnership Committee for a term ending August 1, 2018. C) Approval of a resolution and the ratification of the submission of a grant application to the Texas Department of Transportation through the Texas Traffic Program’s Selective Traffic Enforcement Program (STEP) of up to $110,964.10 to fund salaries and equipment and authorizing the City Manager to accept funds and execute all contract documents associated with the grant, if awarded. D) Approval of annual recurring expenditures for FY 2016-17. E) Approval of an annual contract for the purchase of customized green waste collection bags from WasteZero, Inc. for the Public Works Department. F) Approval of the Water and Wastewater Impact Fee Committee's recommendation to accept the semiannual Water and Wastewater Impact Fee Report for the period of June 30, 2016, through December 31, 2016. G) Approval of the second and final reading of an ordinance amending Chapter 86-4 - Additional Rules and Regulations for control of Parks and Recreation areas and facilities, to redefine the term “smoking”. H) Approval of the first reading of an ordinance to revise the school speed zone on FM 1863 for the New Braunfels Christian Academy. I) Approval of the second and final reading of an ordinance regarding a requested rezoning to apply a Special Use Permit to 1.089 acres, Lot 2-R, Moeller Subdivision, to allow the temporary placement and habitation of a travel trailer for resident security and an unimproved parking lot with the operation of a Christmas tree sales lot in the “C-3” Commercial District, addressed at 2742 FM 725. J) Approval of the second and final reading of an ordinance to create parking restrictions in river-related areas. Approval of the Consent Agenda Monday, May 8, 2017 New Braunfels City Council Regular Meeting  Mayor Casteel read the aforementioned captions. A motion was made by Councilmember Green, seconded by Councilmember García, to approve the Consent Agenda. The motion passed unanimously via roll call vote. 4. INDIVIDUAL ITEMS FOR CONSIDERATION A) Discuss and consider approval of the first reading of an ordinance modifying Chapter 86-91 of the Code of Ordinances regarding golf course fees. Mayor Casteel read the aforementioned caption. Stacey Dicke presented the item. A motion was made by Councilmember Reaves, seconded by Mayor Pro Tem Peters, that this item be postponed until further information can be presented. The motion passed unanimously. B) Discuss and consider approval of a resolution supporting the completion of a Multi-Stream Waste Collection Center feasibility study co-funded by the City of New Braunfels Solid Waste and Recycling Division and grant funds awarded by the Alamo Area Council of Governments pass through grants program from the Texas Commission on Environmental Quality, and supporting the use of the study findings to guide future city services. Mayor Casteel read the aforementioned caption. Mike Mundell and NewGen Strategies & Solutions President of Environmental Practice David Yanke, presented the item. A motion was made by Mayor Pro Tem Peters, seconded by Councilmember García, that this item be approved. The motion passed via the following vote: In Favor: Mayor Casteel, Councilmember Meadows, Councilmember Reaves, Mayor Pro Tem Peters, and Councilmember García Opposed: Councilmember Green, and Councilmember Monceballez <City Council took a break.> Monday, May 8, 2017 New Braunfels City Council Regular Meeting  C) Discuss and consider a request for a conditional sign permit for a pole sign at the future In-N-Out Burger at 106 FM 306. Mayor Casteel read the aforementioned caption. Christopher Looney presented the item. A motion was made by Councilmember Monceballez, seconded by Councilmember Green, that this item be approved. A motion to amend was made by Mayor Pro Tem Peters, seconded by Councilmember Monceballez, to eliminate the two (2) monument signs, retain the one (1) free-standing sixty-eight and half foot pole sign, and that the applicant meet the conditions as documented in the waiver request for the pole sign. The motion to amend passed unanimously. The main amended motion passed via the following vote: In Favor: Councilmember Green, Councilmember Meadows, Councilmember Reaves, Councilmember Monceballez, Mayor Pro Tem Peters, and Councilmember García Opposed: Mayor Casteel D) Discuss and consider the second and final reading of an ordinance regarding a rezoning request to apply a Special Use Permit to 1.186 acres out of the A-155, SUR-35 A P Fuquay Survey, Comal County, Texas, to allow the temporary placement and habitation of a travel trailer for resident security and operation of a Christmas tree sales lot with unimproved parking in the "C-1" Local Business District, addressed at 1293 FM 306. Mayor Casteel read the aforementioned caption. Christopher Looney presented the item. A motion was made by Councilmember Monceballez, seconded by Councilmember García, that this item be denied. The motion failed via the following vote: Monday, May 8, 2017 New Braunfels City Council Regular Meeting  In Favor: Councilmember Monceballez, Mayor Pro Tem Peters, and Councilmember García Opposed: Mayor Casteel, Councilmember Green, Councilmember Meadows, and Councilmember Reaves A motion was made by Councilmember Reaves, seconded by Councilmember Green, that this item be approved. A motion to amend was made by Mayor Pro Tem Peters, seconded by Councilmember Monceballez, to include staff recommendations for the SUP. The motion to amend passed unanimously. A second motion to amend was made by Councilmember Monceballez, seconded by Councilmember Green, to designate the hours of operation from 12:00 p.m. to 12:00 a.m., and that customers are prohibited from using parking located at the Shell gas station and the post office during those respective businesses' operating hours. The second motion to amend passed unanimously. The final amended motion passed via the following roll call vote: In Favor: Mayor Casteel, Councilmember Green, Councilmember Meadows, Councilmember Reaves, Councilmember Monceballez, and Mayor Pro Tem Peters Opposed: Councilmember García E) Discuss and consider approval of a resolution recommended by the New Braunfels Industrial Development Corporation to provide funds to the New Braunfels Parks Foundation in an amount up to $75,000 for a project to renovate the miniature golf course at Landa Park. Mayor Casteel read the aforementioned caption. Jeff Jewell presented the item. A motion was made by Councilmember Meadows, seconded by Councilmember Reaves, that this item be approved. The motion passed unanimously. Monday, May 8, 2017 New Braunfels City Council Regular Meeting  F) Discuss and consider approval of the sixth amendment to the Veramendi Development Agreement and authorizing the City Manager to execute the amendment. Mayor Casteel read the aforementioned caption. Mayor Casteel announced that City Council will recess into Executive Session and read the following caption: Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code. City Council recessed into Executive Session from 8:22 p.m. - 9:02 p.m. No vote or action was taken. City Council reconvened into Open Session at 9:02 p.m. No vote or action was taken. 5. EXECUTIVE SESSIONS A) Deliberate and consider the purchase of, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code, including but not limited to: · acquisition of land for city facilities B) Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code, specifically: · Condemnation of an approximate 3.564 acres along Weltner Road related to the expansion of NBU’s electric system. Mayor Casteel read the aforementioned captions. City Council recessed into Executive Session from 9:04 p.m. - 9:34 Monday, May 8, 2017 New Braunfels City Council Regular Meeting  p.m. No vote or action was taken. 6. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE. City Council reconvened into Open Session at 9:34 p.m. No vote or action was taken.
