Council meeting of January 13, 2020.

This time is for citizens to address the City Council on issues and items of concerns not on this
agenda. There will be no City Council action at this time.

3. CONSENT AGENDA
All items listed below are considered to be routine and non-controversial by the City Council
and will be approved by one motion. There will be no separate discussion of these items
unless a Councilmember or citizen so requests, in which case the item will be removed from
the consent agenda and considered as part of the normal order of business.
Resolutions & Action Items
A) Approval of the appointment of one individual to the Animal Services
Advisory Board for a term ending November 1, 2022.

B) Approval of a resolution for the submission of an application to the
Texas Parks & Wildlife Department, Recreational Trail Grant Program
for the provision of funding for the creation of multiple trails at the New
Braunfels Sports Complex, and authorization for the City Manager to
accept funds and to execute all contract documents associated with the
grant, if awarded.

C) Approval of a memorandum of understanding between the City of New
Braunfels and New Braunfels Utilities regarding law enforcement
services provided by the New Braunfels Police Department.

D) Approval of a professional services contract with M & S Engineers, Inc.
for preparation of fiber engineering design plans to allow for expansion
of the City’s existing fiber network and approval of the issuance of an
invitation for competitive sealed proposals since the City Council finds
that this delivery method will provide the best value to the City.

E) Approval of the second and final reading of an ordinance regarding the
proposed abandonment and sale of approximately 0.45 of an acre of
street right-of-way located at the terminus of North Houston Avenue.

F) Approval of the second and final reading of an ordinance amending the
Code of Ordinances, Chapter 144 Zoning, Section 5.22, Nonresidential
and Multifamily Design Standards, Section 3.6-3, Special Use Permits,

G) Approval of the second and final reading of an ordinance regarding a
proposed rezoning to apply a Special Use Permit to allow a bed and
breakfast in the “R-2” Single and Two-family District on Lot 45, Block 4,
Rio Vista Addition, addressed at 683 Albert Street.

H) Approval of the second and final reading of an ordinance regarding the
proposed rezoning of approximately 19.1 acres out of the A M
Esnaurizar A-1 Survey, addressed at 850 Highway 46 South, from
“R-2” Single and Two-family District to “ZH-A” Zero Lot Line Home
District.

I) Approval of the second and final reading of an ordinance regarding the
proposed rezoning to apply a Special Use Permit to allow the short-term
rental of a single-family dwelling and accessory dwelling unit in the
“C-3” Commercial District, addressed at 676 S. Santa Clara Avenue.

J) Approval of the first reading of an ordinance amending Section 126-186
of the Code of Ordinances to prohibit through truck traffic on Airport
Road.

A) Discuss and consider approval of the appointment of two individuals to
the Arts Commission for terms ending January 31, 2023.

2018-19 Convention and Tourism Fund

improvements plan.

regarding the proposed rezoning of 5 acres out of the Orilla Russell
Survey No. 2, addressed at 2841 Goodwin Lane, from “APD”
Agricultural/Pre-Development District to “C-1B” General Business
District.

F) Public hearing and first reading of an ordinance regarding the proposed
rezoning of 2.55 acres out of Lot 2A2, Block 1, Oak Run Commercial
Reserve 2, located on North State Highway 46 near the northwest

Neighborhood Business District to “C-1B” General Business District.

I) Discuss and consider a request for a conditional sign permit for East
Common Place Owners Association, to allow a proposed monument
sign to exceed the adopted height and sign area standards, addressed
at 1523 - 1535 East Common Street.

ordering a special election to be held in the City of New Braunfels on
May 2, 2020, for proposed amendments to the City Charter; and
establishing an Early Voting Location and Polling Places for this

L) Discuss and consider approval of the Mayoral appointment of two
individuals to the New Braunfels Housing Authority Board of
Commissioners for terms ending January 22, 2022.

5. EXECUTIVE SESSIONS
In accordance with Texas Government Code, Subchapter D, the City Council may convene in a
closed session to discuss any of the following items; any final action or vote taken will be in
public.
A) Deliberate issues regarding economic development negotiations in
accordance with Section 551.087, of the Texas Government Code,
including but not limited to:
· Project Maintenance
B) Deliberate pending/contemplated litigation, settlement offer(s), and
matters concerning privileged and unprivileged client information
deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of
Professional Conduct in accordance with Section 551.071, of the Texas
Government Code, specifically:
· State Comptroller’s draft rule amending the Texas Administrative
Code, Section 3.334, relating to Local Sales and Use Taxes
C) Deliberate the appointment, evaluation, duties, discipline, or removal of
the Municipal Court Judge in accordance with Section 551.074 of the
Texas Government Code.
NOTE: The City Council reserves the right to retire into executive session concerning any of
the items listed on this Agenda whenever it is considered necessary and legally justified under
the Open Meetings Act (Chapter 551 of the Texas Government Code).
6. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION
RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE.
