Resolutions & Action Items A) Approval of an Interlocal Cooperation Agreement 20-509 between the City of New Braunfels and the New Braunfels Independent School District, establishing guidelines for the continuation the provision of School Resource Officers by the New Braunfels Police Department to the NBISD for a 3 year period, through the 2022-23 school year. Tom Wibert, Police Chief B) Approval of a Memorandum of Understanding between 20-503 the City and New Braunfels Utilities (NBU) for the payment of funds to NBU for a temporary, part-time Watershed Educator position at the Headwaters at the Comal. Mark Enders, Watershed Program Manager C) Approval of a resolution amending the Chapter 380 20-531 Economic Development Agreement with HD Supply Facilities Maintenance, Ltd. Jeff Jewell, Director of Economic and Community Development D) Approval of a resolution recommended by the New 20-532 Braunfels Economic Development Corporation to amend the performance agreement between the EDC and HD Supply Facilities Maintenance, LTD. F) Approval of the second and final reading of an ordinance 20-494 regarding the proposed rezoning of approximately 8.0 [2] City Council Agenda August 10, 2020 acres, Lots 1& 2 Soefje Subdivision (3.9 acres) addressed at 1998 IH 35 North and 4.0 acres out of A-1 SUR-1AM Esnaurizar addressed at 2050 IH 35 North, from “C-3” Commercial District and “APD” Agricultural/Pre-Development District to “MU-B” High Intensity Mixed-Use District. Christopher Looney, Planning and Development Services Director G) Approval of a second and final reading of an ordinance 20-514 amending the Code of Ordinances, Ch. 2, by repealing Section 2-5, relating to employees, and amending Section 2-7(d) and (e), relating to political activities and social media guidelines for City Council. Valeria Acevedo, City Attorney H) Approval of the second and final reading of an ordinance 20-522 regarding the proposed rezoning of Lots 1 & 5, Block 1, Freiheit Subdivision, addressed at 672 & 690 South Kowald Lane, from “M-1A” Light Industrial to “C-1B” General Business District. INDIVIDUAL ITEMS FOR CONSIDERATION A) Discuss and consider a resolution of the City Council of 20-530 the City of New Braunfels approving a recommendation of the New Braunfels Economic Development Corporation to provide up tot $85,000 in financial incentives to United Training Career, LLC. for the creation and retention of up to 40 full-time jobs; and declaring an effective date. Jeff Jewell, Director of Economic and Community Development B) Public hearing and first reading of an ordinance of the 20-533 City of New Braunfels, Texas approving the change of boundaries or reinvestment zone number one, City of New Braunfels, Texas; amending the project plan and reinvestment zone financing plan; approving and executing an amendment to the tax increment participation interlocal agreement and an amendment to the phase II tax increment participation interlocal agreement; and other matters in connection therewith. Jared Werner, Chief Financial Officer [3] City Council Agenda August 10, 2020 C) Discuss and consider approval of the second and final 20-523 reading of an ordinance regarding the proposed rezoning of Lots 1 and 2 Solms Subdivision, located in the 4400 block of IH-35 South, from “APD” Agricultural/Pre-Development to “C-1B” General Business District. EXECUTIVE SESSIONS In accordance with Texas Government Code, Subchapter D, the City Council may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public. A) Deliberate the appointment, evaluation, duties, discipline, 20-476 or removal of the Municipal Court Judge in accordance with Section 551.074 of the Texas Government Code. NOTE: The City Council reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code). 6. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE. 7.
