SPECIAL MINUTES OF THE NEW BRAUNFELS CITY COUNCIL SPECIAL MEETING OF MONDAY, AUGUST 15, 2016 AMENDED AGENDA The City Council of the City of New Braunfels, Texas, convened in a Special Session on August 15, 2016, at 4:00 p.m. City Councilmembers present were: Present 7 - Mayor Barron Casteel, Councilmember George Green, Councilmember Justin Meadows, Councilmember Ron Reaves, Councilmember Chris Monceballez, Mayor Pro Tem Wayne Peters, and Councilmember Leah García City Staff present were: City Manager Robert Camareno, Assistant City Manager Kristi Aday, City Attorney Valeria Acevedo, City Secretary Patrick Aten, Assistant City Secretary Andrea Cunningham, Capital Programs Manager Bryan Woods, City Engineer Garry Ford, and Finance Director Martie Simpson. The meeting was called to order by Mayor Barron Casteel in the New Braunfels Municipal Building City Council Chambers at 4:03 p.m. 1. INDIVIDUAL ITEMS FOR CONSIDERATION A) Interview one individual for the New Braunfels Industrial Development Corporation Board of Directors for a term ending October 9, 2017. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. City Council interviewed candidate Kathy Meurin for a seat on the New Bruanfels Industrial Development Board of Directors. No action was taken. 2. EXECUTIVE SESSION A) Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information Monday, August 15, 2016 New Braunfels City Council Special Meeting  deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code, specifically: · Carowest Land, Ltd. v. Yantis Company, and the City of New Braunfels (2010 and 2015 cases). Mayor Casteel read the aforementioned caption. City Council convened into Executive Session from 4:14 p.m. - 4:41 p.m. No action or vote was taken. 3. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE. City Council reconvened into Open Session at 4:41 p.m. No vote or action was taken. INDIVIDUAL ITEMS FOR CONSIDERATION B) Discuss and consider approval of the appointment of one individual to the New Braunfels Industrial Development Corporation Board of Directors for a term ending October 9, 2017. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. A motion was made by Councilmember Reaves, seconded by Councilmember Green, that Kathy Meurin be appointed to the New Braunfels Industrial Development Corporation Board of Directors for a term expiring on October 9, 2017. The motion passed via the following vote: In Favor: Mayor Casteel, Councilmember Green, Councilmember Meadows, Councilmember Reaves, Mayor Pro Tem Peters, and Councilmember García Abstain: Councilmember Monceballez Monday, August 15, 2016 New Braunfels City Council Special Meeting  C) Discuss and consider approval of rescheduling the October 10, 2016 Regular City Council Meeting to October 17, 2016. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. A motion was made by Mayor Pro Tem Peters, seconded by Councilmember Reaves, that this item be approved. The motion passed unanimously. D) Discuss and consider approval of the first reading of an ordinance amending Chapter 130 Article II Section 130-26(c) of the Code of Ordinances regarding the appointment of members to the New Braunfels Utilities Board of Trustees. Mayor Casteel read the aforementioned caption. Mayor Casteel presented the item. A motion was made by Mayor Pro Tem Peters, seconded by Councilmember Reaves, that this item be approved with the condition that Section 130-26(c) read that appointments shall be made by the city council no later than the last meeting in October each year. The motion passed unanimously. E) Discuss and consider approval of a resolution recommended by the New Braunfels Industrial Development Corporation to provide up to $470,000 to the City of New Braunfels for a project to construct public restrooms as identified in the Downtown Implementation Plan and authorizing the City Manager to execute all agreements related to the project. Mayor Casteel read the aforementioned caption. Bryan Woods presented the item. Carl Druebert, Ian Perez, Jim Holster, Fred Willard, Wayne Rudolph, and Patrick Lynch spoke regarding the item. A motion was made by Councilmember Meadows, seconded by Councilmember García, that this item be approved. The motion passed Monday, August 15, 2016 New Braunfels City Council Special Meeting  unanimously. F) Public hearing and consideration of the first reading of an ordinance amending Section 126-354 of the Code of Ordinances to establish Parking by Permit Area L. Mayor Casteel read the aforementioned caption. Garry Ford presented the item. Carolyn Crim and Sara Dasso spoke regarding the item. A motion was made by Councilmember Monceballez, seconded by Mayor Pro Tem Peters, that this item be approved. The motion passed unanimously. City Council took a break. G) Presentation and discussion regarding the Proposed Fiscal Year 2016-17 operating and capital budgets. Mayor Casteel read the aforementioned caption. Robert Camareno presented the item. No action was taken. H) Presentation and discussion regarding the 2016 effective and rollback tax rates. Mayor Casteel read the aforementioned caption. Martie Simpson presented the item. No action was taken. I) Discuss and consider approval of the Proposed 2016 Tax Rate. Mayor Casteel read the aforementioned caption. Martie Simpson presented the item. A motion was made by Mayor Pro Tem Peters, seconded by Monday, August 15, 2016 New Braunfels City Council Special Meeting  Councilmember García, to set the proposed tax rate to $0.49823. The motion passed unanimously via roll call vote. J) Discuss and consider scheduling the public hearings on the 2016 tax rate and the FY 2016-17 Proposed Budget. Mayor Casteel read the aforementioned caption. Martie Simpson presented the item. A motion was made by Councilmember Reaves, seconded by Councilmember García, to set the public hearings for the tax rate at a meeting beginning at 6:00 p.m. on Thursday, August 25, 2016 and Tuesday, September 6, 2016; and the public hearing on the FY 2016-17 Proposed Budget and Plan of Municipal Services on Thursday, August 25, 2016 at a meeting beginning at 6:00 p.m. - all in the City Council Chambers located at 424 S. Castell Avenue. The motion passed unanimously via roll call vote. Mayor Casteel announced the following: The FY 2016-17 Proposed Budget, along with the 2016 Tax Rate, will be adopted on September 12, 2016 at a meeting beginning at 6:00 p.m. in the Council Chambers located at 424 S. Castell Avenue, New Braunfels, Texas.
