SPECIAL MINUTES OF THE NEW BRAUNFELS CITY COUNCIL SPECIAL MEETING OF MONDAY, MAY 15, 2017 The City Council of the City of New Braunfels, Texas, convened in a Special Meeting on May 15, 2017, at 5:30 p.m. City Councilmembers present were: Present 7 - Mayor Barron Casteel, Councilmember George Green, Councilmember Justin Meadows, Councilmember Ron Reaves, Councilmember Chris Monceballez, Mayor Pro Tem Wayne Peters, and Councilmember Leah García City Staff present were: City Manager Robert Camareno, Assistant City Manager Kristi Aday, City Attorney Valeria Acevedo, City Secretary Patrick Aten, Assistant City Secretary Andrea Cunningham, Finance Director Martie Simpson, Grants Coordinator Michele Valadez, Public Works Director Greg Malatek, and Economic Development Manager Jeff Jewell. The meeting was called to order by Mayor Casteel in the New Braunfels City Hall Tejas Room at 5:46 p.m. Councilmember Reaves gave the invocation; and Mayor Casteel led the Pledge of Allegiance and the Salute to the Texas Flag. 1. CITY COUNCIL ITEMS Mayor Casteel read the following captions: A) Discuss and consider approval of a resolution relating to establishing the City's intention to reimburse itself for the prior lawful expenditure of funds relating to constructing various city improvements from the proceeds of tax-exempt obligations to be issued by the city for authorized purposes; authorizing other matters incident and related thereto; and providing an effect date. B) Discuss and consider approval of a resolution authorizing the City Manager to enter into an Advance Funding Agreement with the Texas Department of Transportation for Voluntary Local Government Contributions to the Loop 337 Expansion Project. Monday, May 15, 2017 New Braunfels City Council Special Meeting  Mayor Casteel announced that City Council will recess into Executive Session and read the following caption: Deliberate pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code. City Council recessed into Executive Session from 5:50 p.m. - 6:30 p.m. No vote or action was taken. The motion passed unanimously via roll call vote. B) Discuss and consider approval of a resolution authorizing the City Manager to enter into an Advance Funding Agreement with the Texas Department of Transportation for Voluntary Local Government Contributions to the Loop 337 Expansion Project. Mayor Casteel read the aforementioned caption. Robert Camareno presented the item. A motion was made by Mayor Pro Tem Peters, seconded by Councilmember Reaves, that this item be approved. The motion passed unanimously. Monday, May 15, 2017 New Braunfels City Council Special Meeting  C) Discuss and consider approval of a resolution for final acceptance to approve the Proposed Executable Contract (TWDB Contract No. 1600012096) between the Texas Water Development Board and the City of New Braunfels for the Flood Mitigation Assistance Project Grant, of a budget amendment to increase the Grant Fund Capital Expenditure allocation, and to authorize the City Manager to accept funds and execute all contract documents associated with the grant. Mayor Casteel read the aforementioned caption. Michele Valadez presented the item. A motion was made by Councilmember Monceballez, seconded by Mayor Pro Tem Peters, that this item be approved. The motion passed unanimously. D) Interview applicants for the City of New Braunfels Planning Commission for terms ending May 31, 2020. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. City Council interviewed Chad Nolte, Jerry Sonier, Chad Hunter, Creighton Tubb, and David Carpenter for three vacancies on the Planning Commission. No vote or action was taken. E) Interview applicants for the City of New Braunfels Zoning Board of Adjustment for terms ending May 31, 2019. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. City Council interviewed Cynthia Foster, Amanda Reed, Brandon Mund, Melinda Poss, Michael Frederickson, and Bonnie Leitch for two regular and two alternate vacancies on the Zoning Board of Adjustment. Monday, May 15, 2017 New Braunfels City Council Special Meeting  No vote or action was taken. F) Discuss and consider approval of the appointment of three individuals to the Planning Commission for terms ending May 31, 2020. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. A motion was made by Councilmember Reaves, seconded by Councilmember Meadows, to appoint Chad Nolte, Jerry Sonier, and Creighton Tubb to the Planning Commission for terms ending May 31, 2020. The motion passed unanimously. G) Discuss and consider approval of the appointment of two individuals as regular members and two individuals as alternate members to Zoning Board of Adjustment for terms ending May 31, 2019. Mayor Casteel read the aforementioned caption. Patrick Aten presented the item. A motion was made by Councilmember Reaves, seconded by Councilmember Green, to appoint Cynthia Foster and Bonnie Leitch as regular members, and Amanda Reed and Brandon Mund as alternate members, to the Zoning Board of Adjustment for terms ending May 31, 2019. The motion passed unanimously.
