FINAL - MINUTES OF THE NEW BRAUNFELS CITY COUNCIL - SPECIAL REGULAR MEETING OF MONDAY, SEPTEMBER 18, 2023 AGENDA - AMENDED 09-15-23 CALL TO ORDER Mayor Pro Tem Bowers called the meeting to order at 5:03 p.m. CALL OF ROLL: CITY SECRETARY Present 6 - Councilmember Andres Campos, Councilmember Christopher Willis, Mayor Pro Tem Harry Bowers, Councilmember Lawrence Spradley, Councilmember Mary Ann Labowski, and Councilmember April Ryan Absent 1 - Mayor Neal Linnartz INVOCATION: COUNCILMEMBER WILLIS Councilmember Willis provided the invocation. PLEDGE OF ALLEGIANCE & SALUTE TO THE TEXAS FLAG Mayor Pro Tem Bowers led the Pledge of Allegiance and the Salute to the Texas Flag. PROCLAMATIONS A) Hunger Action Month Mayor Pro-Tem Bowers read the Hunger Action Month Proclamation. Mr. Mario Obledo, Jr. arrived after the proclamation was read but was invited to speak to the Hunger Action Month Proclamation after Workshop item A. B) Clean Energy Week Proclamation Mayor Pro Tem Bowers read the Clean Energy Week Proclamation and presented the Proclamation to Ellie Barnish with McGuire Woods Consulting LLC. 1. WORKSHOP A) Presentation on the NBU Water Supply Strategy and Future Outlook. Mayor Pro Tem Bowers read the aforementioned item. Ryan Kelso presented this item providing a PowerPoint and answered questions from Council. Monday, September 18, 2023 New Braunfels City Council - Special Regular Meeting The following individual spoke at this time: Wayne Peters B) Presentation of the City-County Communications and Marketing Association and Texas Association of Municipal Information Officers awards. Mayor Pro Tem Bowers read the aforementioned item. Jenna Vinson presented this item and invited her team to come forward for a picture displaying their awards. C) Presentation and discussion on a proposed Business Improvement and Preservation Grant Program in the Downtown TIRZ. Mayor Pro Tem Bowers read the aforementioned item. Jeff Jewell presented this item providing a PowerPoint. D) Presentation and possible direction on the Transit Development Plan and New Braunfels Small Urban Area Transit Funding. Mayor Pro Tem Bowers read the aforementioned item. Garry Ford introduced Ellen Soll, a transit consultent with ATG, who presented this item providing a PowerPoint and answered questions from Council. The following individuals spoke at this time: Sarah Dixon and Randall Allsup Mayor Pro Tem took a five minute break and reconvened at 6:36 p.m. E) Presentation and possible direction on the Non-Standard Service Agreement between the City of New Braunfels and Green Valley Special Utility District Mayor Pro Tem read the aforementioned item. Scott McClelland presented this item providing a PowerPoint and answered questions from Council. F) Presentation and possible direction on updates to the traffic impact analysis review fee and requirements. Mayor Pro Tem Bowers read the aforementioned item. Garry Ford presented this item providing a PowerPoint and answered Monday, September 18, 2023 New Braunfels City Council - Special Regular Meeting questions from Council. 2. INDIVIDUAL ITEMS FOR CONSIDERATION A) Discuss and consider approval of a reconsideration of the resolution of the City of New Braunfels ratifying the increase in revenue generated by the 2023 property tax rate included in the FY 2024 Annual Budget. Mayor Pro Tem read the aforementioned item. Jared Werner presented this item providing an explanation for the reconsideration. The following individual spoke at this time: Mrs. Hoyt Councilmember Campos made the specific motion " I move to reconsider the resolution ratifying the property tax revenue increase reflected in the FY 2024 Operating Budget and Plan of Municipal Services." Councilmember Ryan seconded the motion which passed unanimously. Councilmember Spradley made the specific motion " I move to postpone adoption of the resolution ratifying the property tax revenue increase reflected in the FY 2024 Operating Budget and Plan of Municipal Services, until the next regular meeting on Monday, September 25, 2023." Councilmember Ryan seconded the motion which passed unanimously. Absent: Mayor Linnartz B) Discuss and consider approval of a reconsideration of the second and final reading of an ordinance adopting the 2023 ad valorem tax rates. Mayor Pro Tem Bowers read the aforementioned item. Jared Werner spoke to this item stating he had no further information to present to Council. Councilmember Campos made the specific motion " I move to reconsider the second and final reading of an ordinance establishing that the property tax rate for tax year 2023 be increased by the adoption of a total ad valorem property tax rate of .408936 per $100 of assessed taxable valuation, which is effectively an 8.6% increase in the tax rate, with .208936 for debt service and .200000 cents for Monday, September 18, 2023 New Braunfels City Council - Special Regular Meeting operations and maintenance." Councilmember Spradley seconded the motion which passed unanimously. Councilmember Spradley made the specific motion " I move to postpone the second and final reading of an ordinance establishing that the property tax rate for tax year 2023 be increased by the adoption of a total ad valorem property tax rate of .408936 per $100 of assessed taxable valuation, which is effectively n 8.6% increase in the tax rate, with .208936 for debt service and .200000 cents for operations and maintenance, until the next regular meeting on Monday, September 25, 2023." Mayor Pro Tem Bowers read " A public hearing for the tax rate will be held at a meeting beginning at 6:00 p.m. Monday, September 25, 2023, at 550 Landa Street, in the City Council Chambers." AND "The 2023 Tax rate will be adopted on September 25, 2023 at a meeting beginning at 6:00 p.m. at 550 Landa Street, in the City Council Chambers." Absent: Mayor Linnartz 3. EXECUTIVE SESSION In accordance with the Open Meetings Act, Texas Government Code, Ch. 551, the City Council may convene in a closed session to discuss any of the items listed on this agenda. Any final action or vote on any executive session item will be taken in open session. There were no items considered in executive session. 4. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY ACTION RELATING TO THE EXECUTIVE SESSION AS DESCRIBED ABOVE. Monday, September 18, 2023 New Braunfels City Council - Special Regular Meeting 5.
