FOR Authorizing the City of New Carrollton Economic Development Department to apply to the Prince George's County Planning Department for Planning Assistance to Municipalities and Communities Program (PAMC). WHEREAS, the City's Economic Development Department is responsible for pursuing one of the adopted New Carrollton Strategic Outcomes of Increasing Economic Development and, WHEREAS, one of the components of this strategic outcome is to promote the economic development of the city by attracting new businesses to the area while supporting existing city businesses and, WHEREAS, the city wishes to define the standards acceptable by the city to enhance the only trail that is a .64-mile recreational loop at West Field, which is well-used by joggers, bicyclists, walkers, and dog walkers and, WHEREAS, the Economic Development Department wants to apply to the Prince George's County Planning Department’s, Planning Assistance to Municipalities and Communities Program (PAMC), for the creation of the City’s pedestrian and plan to undertake an active transportation connectivity study which will evaluate and diagnose pedestrian and bicyclist facility deficits and propose a system of intracity bikeways, sidewalks, and natural surface trails to provide sustainable, safe, and equitable transportation options and more recreational opportunities within the municipal boundary and, WHEREAS, PAMC provides technical assistance to municipalities and communities in Prince George's County that need assistance with any initiative that assists with redevelopment, revitalization, and community or area plan implementations. The Applicant may request a rescission at any time while the Commitment is in effect before the Grant Agreement is fully executed. Prior to execution of the Grant Agreement, grant funds are subject to change in amount and availability. Additionally, for situations where the scope of work is not part of the Funding Opportunity Announcement, the Applicant and MEA must develop a scope of work, which will be part of the Grant Agreement. Any work performed prior to execution of the Grant Agreement is at the risk of the Applicant and is likely to be ineligible for reimbursement under the Program. The following constitute terms and conditions of this Commitment: 1. Timeline of Commitment (a) This Commitment shall not become effective unless this Commitment Letter is duly executed by the Applicant and returned to MEA by June 18th, 2024. The 1 Commitment of Funds for FY2024 MHD ZEV Program 2024-06-528S1 MEA Section Chief may approve an extension to this date in writing, but in no case shall the amended date be later than June 21, 2024. (b) Execution of the Grant Agreement shall occur no later than November 1, 2024 unless extended by MEA. (c) If Execution of the Grant Agreement does not occur within the time set forth herein or if thisCommitment terminates, this Commitment shall be deemed null and void and shall have no further force and effect. 2. Assignment. This Commitment is not assignable or transferable. The Applicant’s signature on this Commitment Letter constitutes an acknowledgement that the Applicant Name and Applicant address on this Commitment Letter matches the name and federal tax identification number on the IRS W-9 form that the Applicant provided, or will provide, to MEA. In addition, the Applicant understands that any change to the Applicant Name, the federal tax identification number, or Applicant Mailing Address for Grant Disbursement may invalidate this Commitment. 3. Merger. No statements, agreements, or representations, oral or written, which may have been made to the Applicant or to any employee or agent of the Applicant, either by MEA or by an employee or agent acting on behalf of MEA, with respect to the Commitment, shall be of any force or effect, except to the extent stated in this Commitment Letter. This Commitment may not be changed except by written agreement signed by MEA. 4. Governing Law. (a) This Commitment Letter shall be governed by and construed under the laws of the State of Maryland. (b) If any term, covenant, or condition of this Commitment shall be held to be invalid, illegal, or unenforceable in any respect, this Commitment shall be construed without such provision to the fullest extent possible and shall remain in full force and effect. 5. Survival of Commitment. The obligations agreed to by the Applicant in executing this Commitment Letter shall survive the execution of the Grant Agreement. In the event of any conflict between thisCommitment Letter and the Grant Agreement, the Grant Agreement shall prevail. 6. Historical Review. State law requires that all projects undergo a review to analyze whether proposed work will adversely affect properties of historical significance. If adverse effects are indicated, alternatives must be considered or else Federal and State funding will be unavailable. The Maryland Historical Trust conducts this review. If applicable to the Project being funded by this Grant, the Applicant is strongly urged to refrain from any construction, renovation, or similar work until notified by MEA that the proposal has cleared the historical review process. PURPOSE The purpose of this ordinance is to establish guidelines and restrictions on political activities for employees and contractors of the City of New Carrollton, in order to maintain the integrity and impartiality of the City. SECTION 2. DEFINITIONS For the purposes of this ordinance, the following words and phrases shall have the meanings respectively ascribed to them by this section: 2.1 "Employee" shall refer to any individual employed by the City of New Carrollton, including full-time, part- time, temporary, and elected officials. 2.2 "Contractor" shall refer to any individual or entity under contract with the City of New Carrollton to provide goods or services. 2.3 "Political activity" shall refer to any activity related to the campaign for election to public office, or the support or opposition of any candidate or political party. SECTION 3. PROHIBITED ACTIVITIES 3.1 Employees and contractors of the City of New Carrollton shall not engage in political activities during working hours or while on City property. 3.2 Employees and contractors shall not use City resources, equipment, or facilities for political activities. 3.3 Employees and contractors shall not engage in political activities that could create a conflict of interest or the appearance of impropriety.  Page 2 of 3 Ordinance 25-01 Municipal Employee and Contractor Political Activity Ordinance 3.4 Employees who are residents of the City may display political yard signs at their home but shall not be engaged to support a candidate for Citywide office while on the job. 3.5 The City Seal or Emblem shall not be used in any materials disseminated by any Candidate for office or on behalf of any candidate for office. It is the responsibility of the candidate to ensure that all materials created on their behalf are in compliance with this ordinance. 3.6 Municipal campaign materials shall not be disseminated at any official City function put forth by the City of New Carrollton. 3.7 No campaign materials shall be displayed on City Property with the exception of Election Day whereby signs can be posted at City Hall until the polls close. SECTION 4. PENALTIES 4.1 Violation of this ordinance may result in disciplinary action, up to and including termination of employment or termination of contract with the City. 4.2 Any elected official or candidate for elected office found to have violated this ordinance may be subject to fines or other penalties as determined by the City. 4.3 Campaign materials including yard signs found on City Property will be destroyed by ____________ police? Code Enforcement? 4.4 Multiple violations of these provisions by a Candidate will result in said Candidate being deemed ineligible to run for office. SECTION 5. REPORTING 5.1 Employees and contractors of the City of New Carrollton shall report any potential conflicts of interest or violations of this ordinance to their supervisor or the City's ethics committee. 5.2 Any complaints or concerns regarding potential violations of this ordinance shall be investigated by the City's Ethics Committee in consultation with the City Attorney. SECTION 6. AN ORDINANCE OF THE CITY OF NEW CARROLLTON MUNICIPAL EMPLOYEE AND CONTRACTOR POLITICAL ACTIVITY WHEREAS, the City recognizes the importance of allowing residents to keep a car completely covered on private property for various reasons, such as protection from the elements and security; and WHEREAS, the current law requires the registration plates of covered vehicles to be visible at all times; and WHEREAS, residents have voiced plausible concerns with this requirement; and WHEREAS, the City also acknowledges the need to regulate and monitor the storage of covered vehicles on private property to ensure compliance with local laws and regulations; and SECTION 1. NOW, THEREFORE, BE IT ENACTED AND ORDAINED, BY THE CITY COUNCIL OF THE CITY OF NEW CARROLLTON that Chapter 100 “Vehicles and Traffic”, Article III “Parking, Standing and Stopping” § 110-22, “Parking and storage of wrecked, dismantled vehicles” be and it is hereby repealed, re-enacted, and amended to read as: § 110-22 Parking and storage of wrecked, dismantled AND OTHER vehicles. A. It shall be unlawful for any person to park or store on any public street any vehicle that is wrecked, dismantled, in a partially dismantled condition, from which the wheel, engine, transmission or any substantial part thereof has been removed or which, for any reason, is incapable of operation on its own power, or is unlicensed or bearing expired license tags. B. Vehicles parked on private property within the corporate boundaries of the City that are covered with car covers, plastic sheeting, cloth, tarps or similar materials must have registration plates uncovered and/or clearly visible. Registration plates must be valid and have current stickers affixed. C. RESIDENTS MAY STORE A VEHICLE WITH THE REGISTRATION PLATES COMPLETELY COVERED ON PRIVATE PROPERTY WITHIN THE CITY LIMITS, PROVIDED THEY OBTAIN AN ANNUAL PERMIT FROM THE CITY FOR A FEE OF $10. THE PERMIT MUST BE RENEWED ANNUALLY. IN OBTAINING THE PERMIT, THE RESIDENT AUTHORIZES CITY OFFICIALS TO ENTER THEIR PRIVATE PROPERTY TO INSPECT THE SUBJECT VEHICLES TO ENSURE COMPLIANCE WITH THIS SECTION. Effective: August 7, 2024 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF NEW CARROLLTON EXPRESSING ITS FROMAL REQUEST FOR THE MAYOR AND/OR DESIGNATED PURCHASING AGENT TO ISSUE REQUEST FOR PROPOSALS TO RETAIN A RECRUITING SERVICE COMPANY TO ASSIST IN THE SEARCH FOR A CITY MANAGER WITHIN THIRTY (30) DAYS WHEREAS, the City of New Carrollton is currently in the process of changing its form of government; and WHEREAS, to properly function under the new form of government, the City must hire a City Manager to operate the day-to-day operations of the City; and WHEREAS, the City Council understands the critical role the City Manager will have within our new structure of government, and strongly believes the assistance of a recruiting service company to assist in the search for this critical role is vital to the ultimate success of the new form of government; and WHEREAS, pursuant to § C-18 of the Charter, the Mayor is responsible for purchases made by or on behalf of the City; and WHEREAS, under Chapter 27 of the City Code, § 27-4 empowers the purchasing agent, who is designated by the Mayor, sole authority to secure contractual services, and in doing so, to procure for the highest quality of contractual services; and WHEREAS, since the duty and power of purchasing rests solely with the Mayor and her designated purchasing agent, the City Council believes a resolution is necessary to formally request that Request for Proposals (RFP) be issued to retain the services a recruiting service company to assist with the search for a new city manager; and WHEREAS, to ensure the recruiting process is done in a deliberate and efficient manner, the City Council believes the process to identify candidates should begin immediately, which requires securing a recruiting services company as soon as possible. Dodro Mayor  Resolution 25-06 City of New Carrollton Expressing Its Intent to Revise the Current Form of Government Effective: August 7, 2024 RESOLUTION OF THE MAYOR AND CITY COUNCIL OF NEW CARROLLTON EXPRESSING ITS INTENT TO REVISE THE CURRENT FORM OF GOVERNMENT WHEREAS, the City of New Carrollton became an incorporated community on April 11, 1953; and WHEREAS, in a strong mayor form of government the mayor is the Chief Executive Officer of the City, and runs the day-to-day operations of the City; and WHEREAS, in its seventy-one (71) years, the City has dramatically changed in size, municipal demands, and resident needs; and WHEREAS, the City Council has assessed the current state of the City and its day- to-day needs, along with the demands on the Office of Mayor across several administrations; and WHEREAS, the City Council believes that to address the burgeoning and constantly evolving needs of the City, and ensure the efficient and competent operation of City government, a conversion to a weak mayor form of government is in the best interests of residents; and WHEREAS, before the change is officially made to the form of Government, including a reduction of the responsibilities bestowed to the mayor, the City Council will thoroughly consider all potential ramifications of such change, with input from the community and the mayor, to implement the change transparently, efficiently, and successfully; and WHEREAS, after the City Council completes its due diligence on the issue, it will proceed with the Charter amendment process pursuant to Maryland law to formally effectuate the change in the form of government. NOW, THEREFORE, BE IT RESOLVED by the City Council of New Carrollton, that the City Council strongly believes that it is necessary to examine the Mayoral-Administrative Continuum and will immediately begin moving forward with evaluating the modifications of the duties and responsibilities of the Office of Mayor in the new form of government.
