Joel Enders seconded the motion. Carried unanimously. APPROVAL OF MINUTES Mike Kastens made a motion to approve the minutes from 06 May 2025. Ben Kurth seconded the motion. Carried unanimously. NEW BUSINESS ELECTION OF CHAIRPERSON AND VICE-CHAIRPERSON MaryKay Rice made a motion nominating Jim Zajkowski as Chair of the Plan Commission for one year. Ron Volkert seconded the motion. Carried unanimously. Jim Zajkowski made a motion to name Mike Kasten as Vice-Chair of the Plan Commission for one year. MaryKay Rice seconded the motion. Carried unanimously. ETJ CERTIFIED SURVEY MAP APPLICATION - TAMMY AND RICHARD WHITE Amber Toutge explained that G&S Land Solutions, on behalf of Tammy and Richard White, submitted an extraterritorial certified survey map (ETJ CSM) application for 1634 100th Street (PID 026-1025- 30-100). The parcel is located in the Town of Richmond. The applicant is seeking to subdivide the parcel to create a total of two lots. Proposed Lot 2 is 4 acres in area, including right-of-way. Proposed Plan Commission Meeting June 3, 2025 Lot 3 is 2 acres in area, including right-of-way. The property is subject to the City of New Richmond’s extraterritorial plat review authority as it is located within the 3-mile extraterritorial plat approval jurisdiction, in accordance with Wis. Stat. § 236.02(5). City staff have reviewed and recommended approval of the ETJ CSM. Mike Kastens made a motion to approve the ETJ Certified Survey Map Application from Tammy and Richard White. Ben Kurth seconded the motion. Carried unanimously. ONE-YEAR CONDITIONAL USE PERMIT/SITE PLAN EXTENSION REQUEST - WILLOW RIVER APARTMENTS Amber Toutge reported that Ben Thone, on behalf of Londyn Land II, LLC, has submitted a request for an additional one-year extension of the Conditional Use Permit (CUP) and Site Plan for Willow River Apartments originally approved on June 6, 2023. It was explained that a one-year extension was previously granted administratively by City staff, extending the approval through June 6, 2025. It was noted that this was a request for an extension only, no changes to the CUP or Site Plan were discussed. Ben Thone was asked to explain the request for extension. Discussion included timeline, budgeting, contractors, etc. A motion was made by Ron Volkert to deny the request. Due to no second the motion failed. Jim Zajkowski made a motion to allow a One-Year Conditional Use Permit/Site Plan Extension for Londyn Land II LLC / Willow River Apartments. Ben Kurth seconded the motion. Plan Commission Meeting June 3, 2025 MEMO Prepared for: Plan Commission Staff Contact: Amber Toutge Meeting: Plan Commission - 08 Jul 2025 Subject: Preliminary Plat Application - Cattail Villas BACKGROUND INFORMATION: St. Croix Homes submitted a preliminary plat application for a new development to be known as Cattail Villas. The proposed development is located at the northwest corner of the intersection of Ponderosa Lane and West Richmond Way (PID 261-1039-60-059). The proposed development consists of 10 twin home lots and will be accessible via a new private drive accessed via Ponderosa Lane. The parcel is located within the Evergreen Valley Planned Unit Development (PUD). City staff will bring forward a rezoning application with the final plat application to amend the PUD. The amendment will allow the parcel to comply with the current standards of the Z2 Sub-Urban District, which is the underlying zoning district. PROCESS The preliminary plat application is subject to review by City staff, the Plan Commission, and the City Council. A public hearing shall be held at the Plan Commission meeting on July 8, 2025 at 5:00 p.m. A Class 2 Notice, notifying the public of the hearing, was published in the Star Observer on June 19 and 26, 2025. The hearing notice was also mailed to property owners located within 100 feet of the proposed preliminary plat on June 12, 2025 in accordance with local ordinances. DETAILED ANALYSIS COMPREHENSIVE PLAN The Future Land Use Map, found in the City of New Richmond’s Comprehensive Plan, guides the site as a Mixed-Use Corridor. This land use category includes a mixture of regional commercial, retail, office, lodging, and multi-family residential uses in a mixture of building forms, oriented either vertically or horizontally. The proposed twin homes are consistent with the Future Land Use Map. ZONING The site has a zoning designation of Z2 Sub-Urban District. The purpose of the Z2 Sub-Urban District is to provide opportunities for low density residential neighborhoods, limited neighborhood commercial uses, and complementary uses. The proposed twin homes are allowed uses, subject to building permit applications. WELLHEAD PROTECTION OVERLAY DISTRICT The northeastern corner of the property in question is located within the Wellhead Protection Overlay District. Per NRMC 121-60, land in Wellhead Protection Areas are subject to additional land use and development restrictions due to their close proximity to the City’s wells and the corresponding higher risk of contamination. Twin homes are allowed in the Wellhead Protection Overlay District, as they do not pose a serious threat to the City’s water supply. SURROUNDING USES The table below identifies the existing and planned uses directly surrounding the subject site. The proposed development is compatible with the surrounding uses and is unlikely to have an adverse impact on the future development of the surrounding properties. Page 2 of 10 LOT OCCUPATION Per NRMC 121-38, twin home lots shall have a minimum width of 40 feet. The 10 lots identified on the plat are consistent with the lot width requirements. Additionally, no more than 40% of each lot may be impervious surface. It is the developer’s responsibility to verify each dwelling unit meets the lot coverage requirements and setbacks when applying for building permits and building plans are prepared for each individual parcel. SETBACKS Per NRMC 121-38, the minimum setbacks for principal structures are: Front: 25 feet; Secondary Front: 20 feet; Side: 5 feet; Rear: 20 feet. The typical building setbacks shown on the plat are consistent with the City setback requirements. The developer shall verify each dwelling unit meets the setback requirements when applying for building permits.  Standard setbacks shall be added on the plat as an exhibit BUILDING DESIGN Per NRMC 121-38, future principal buildings shall be limited to a maximum of three stories in height. Future buildings shall also comply with the building material standards identified in NRMC 121-49. STREETS & ACCESS The proposed development will be accessible via a private drive off Ponderosa Lane. No access will be allowed directly onto West Richmond Way. The private drive ranges in width from 24’ wide to 26’ wide with an 18” mountable curb. An access easement has been provided on the plat. Per NRMC 117-28, private streets shall be allowed based on City Staff Development Review approval.  A maintenance agreement for the private drive shall be provided to the City for review, and recorded with the final plat  A fire truck turning radius plan sheet shall be provided to the City for review STREET LIGHTING Street lighting is not required with a private drive, and has not been provided.  The Electric Superintendent recommends adding a streetlight at the intersection of the private drive and Ponderosa Lane STREET SIGNAGE Per NRMC 121-29, the applicant shall develop a street signage plan to be approved by the City. The applicant is responsible for all costs associated with street signage. Page 3 of 10  A stop sign and private drive sign shall be added at the end of the private drive, prior to Ponderosa Lane BICYCLE AND PEDESTRIAN ACCOMMODATIONS The development is currently served by an existing sidewalk along Ponderosa Lane and an existing off-street trail along W Richmond Way. The Applicant shall be responsible for all costs associated with the removal of a portion of the existing sidewalk where the private drive will access Ponderosa Lane, as well as any costs associated with damage to the existing sidewalk shall it occur. PARK DEDICATION No parkland is proposed to be dedicated with the plat. The developer shall pay park impact fees in accordance with the fee schedule established by the Common Council at the time of the building permit applications, along with all other impact fees. STORMWATER AND EROSION CONTROL The applicant submitted a grading and erosion control plan, and stormwater report, which was reviewed by the City’s engineering consultant, Short Elliott Hendrickson. The site is tributary to a regional stormwater facility, constructed as a part of the Evergreen Valley Subdivision, that addresses the total suspended solids and peak discharge rate. The stormwater plans shall be revised on accordance with the following comments:  Provide a long-term maintenance and monitoring agreement per NRMC Sec 109-289. The agreement must be in a recordable format. Please include specific details on cleaning and accessing the infiltration areas or bioretention filters.  Include or describe the imperviousness of the proposed improvements with respect to NR 151.124 (1).  If the ‘infiltration areas’ are intended to be bioretention filters, include information in the construction plans on their construction and address them specifically in the stormwater management plan and maintenance & monitoring agreement.  Include or describe the pretreatment prior to infiltration with respect to NR 151.124 (6) & (7).  Validate the design methodology of including a 1 in/hr infiltration rate in WinSLAMM CP#1 and evidence of an evaluation for stormwater infiltration per the WDNR Technical Standards.  Provide the input data for control practice 2 (CP#2).  In WinSLAMM, route the south infiltration area to the north infiltration area, as shown on the plan.  Include the total phosphorus reduction performance in the WinSLAMM Output.  Show the extent of the ‘Post Developed Area – Undetained’ on the Drainage Map for Infiltration.  Provide hydraulic calculations per NRMC Sec 109-290(b)(5).  Sheet C104: Extend erosion mat from the infiltration areas to the edge of the surrounding pavement (streets and pickle ball court).  Sheet C104: Show silt fence between the existing pond and lots 3 through 10.  Sidewalk thickness shall be 6” UTILITIES The utility plans were reviewed by the City’s Water Superintendent who provided the following comments:  Abandon existing 6” water service at tee on Ponderosa Lane  Show location of curb stops  Sanitary sewer services should be on the downstream side of water services  Extend water main to STA 10+40 and place Hydrant 1 at the end Page 4 of 10  Add 8x8 cross on water main at approximately STA 10+70 and extend water main to the north and south; with a hydrant on each dead end. Water services for lots 3, 4, 5, 6 7, and 8 should come off this main  Sanitary sewer main should be SDR 35  Sanitary sewer main should extend north out of SAN 4 Structure with a manhole at the end. Main should include sanitary service wyes for Lots 6, 7 and 8  Sanitary sewer main should extend south out of SAN 4 Structure with a manhole at the end. Main should include sanitary service wyes for Lots 3, 4 and 5  Provide stationing for north/south road  Provide profile for north/south road  Insulate water and storm sewer crossings  A permit shall be required for work being done in the right-of-way ELECTRIC The applicant is proposing a drainage and utility easement overlaying the private drive. Lots 9 and 10 have a proposed 10-foot-wide drainage and utility easement along the north property line, and Lot 10 and Lot 1 have an additional proposed 10-foot-wide drainage and utility easement along the east property line. There is a proposed 5-foot-wide drainage and utility easement between Lots 4 and 5. The applicant is proposing a 10-foot-wide drainage and utility easement along the south property lines of Lot 3, Outlot 1, Lot 2, and Lot 1. Per NRMC 117-41, the lots shall have a 10’ front and rear drainage and utility easement, and 5’ side easement. The typical drainage and utility easements shown on the plat are consistent with City requirements. LANDSCAPING Per NRMC 121-55, all single-family and two-family dwellings shall have hardy turf grass, one tree (front or side yard) and five shrubs. The applicant is proposing one tree per lot and outlot, for a total of 11 trees. The proposed plant species include Autumn Blaze Maple, Northwood Maple, Northern Pin Oak, Red Oak, River Birch, American Linden, Little Leaf Linden, Hackberry, Thornless Honeylocust, Skyline Locust, Kentucky Coffee Tree, Colorado Blue Spruce and Black Hills Spruce. The landscaping plan is consistent with City requirements. Tree diversity and selection shall be prioritized when planting. No spruce trees shall be planted that will encroach the right-of-way or block the vision triangle at intersections.  Tree locations shall be adjusted to not be planted over lot lines or utilities  The following note shall be added to the landscaping plan: “Shrubs to be field located” ADDITIONAL COMMENTS  Plats are approved via a motion and second, recorded in the minutes of the meeting, rather than a resolution. The proposed development is located on the northwest corner of Industrial Boulevard and Liberty Drive, on PIDs 261-1207-60-050 (639 Industrial Boulevard) and 261-1207-50-001. The applicant is proposing to construct two buildings on each parcel, with eight units per building. This is a total of four multi-family buildings with 32 units. The proposed multifamily dwellings are allowed uses, subject to site plan/stormwater applications. However, conditional use permits are required to allow more than one principal building on each lot. Therefore, the applicants also submitted two separate conditional use permit applications (one for each parcel). For clarity and brevity, staff have combined the review of the project into one single memo. PID 261-1207-60-050 (639 Industrial Boulevard) will be referred to as the “southern” parcel. PID 261-1207-50-001 will be referred to as the “northern” parcel. PROCESS The site plan and stormwater review applications are subject to review by City staff and the Plan Commission. The conditional use permit applications are subject to review by City staff, the Plan Commission and City Council. For clarity and brevity, all of the applications are reviewed on one memo. In addition, the proposed development is consistent with the following goals and policies of Mixed- Use Corridors in the Comprehensive Plan:  Goal: Promote development, redevelopment and improvements to create inviting, distinct, and complementary mixed-use corridors for residents, employees, and visitors.  Policy LU-4.1: Support the development of mixed-use corridors along STH 64 and STH 65 that complement rather than compete with downtown.  Policy LU-4.2: Encourage a mix of complimentary uses including commercial, office, multi- family residential, light industrial, public/institutional, and park uses in the mixed-use corridors. ZONING The parcels have a zoning designation of Z3 Multi-Use/Corridor District. The purpose of the Z3 District is to provide a mixture of regional commercial, retail, office, lodging and residential uses in a mixture of building forms. The proposed multifamily dwellings are allowed in the Z3 District via approval of site plan and stormwater review applications. SURROUNDING USES Page 2 of 12 The table below describes the existing uses surrounding the parcels. The proposed multifamily dwellings are compatible with the surrounding uses and is unlikely to have an adverse impact on the future development of the surrounding properties. LOT OCCUPATION Per NRMC 121-39 Table 6, the minimum lot width for parcels with a zoning designation of Z3 is 80 feet. The existing lot width of both parcels meet the City’s requirements. Additionally, no more than 70% of the lot may be impervious surface. The proposed impervious surface is 58.3% for the southern parcel, and 57.6% for the northern parcel, respectively, which is consistent with City requirements. SETBACKS Per NRMC 121-39 Table 6, the minimum setbacks for principal structures are: Front: 25 feet; Secondary Front: 20 feet; Side: 10 feet; Rear: 35 feet. Per NRMC 121-39 Table 6, the minimum setbacks for accessory structures are: Front: 25 feet; Secondary Front: 20 feet; Side: 5 feet; Rear: 20 feet. Page 3 of 12  The applicant shall provide an updated plan sheet with the setbacks from all respective lot lines, including each individual building, the storage garage, trash enclosure and off-street parking BUILDING CONFIGURATION AND MATERIALS Per NRMC 121-39 Table 6, principal buildings are limited to four stories in height. Stories may not exceed 14 feet in height from finished floor to finished ceiling, excluding vaulted spaces. Per NRMC 121-49, all buildings shall maintain a high standard of architectural and aesthetic compatibility with surrounding properties.  The applicant shall provide updated exterior elevations for the principal buildings and storage garage, which include exterior finishes and building heights ACCESS The southern parcel will be accessible via a new driveway on Industrial Boulevard. The proposed driveway is 24 feet wide, which is consistent with City requirements. The northern parcel will be accessible via a new driveway on Liberty Drive. The proposed driveway is 24 feet wide, which is consistent with City requirements. The internal drive isle is also 24’ wide. A shared access and maintenance agreement shall be prepared by the applicant and recorded with the property, which allows residents to drive between parcels and addresses maintenance and snow removal. The applicant has also proposed a private 6’ wide concrete sidewalk at the north end of the internal access drive, which will connect to an existing asphalt trail in Freedom Park. Maintenance of the sidewalk shall be the responsibility of the property owner. The applicant also provided an emergency vehicle turning radius diagram, for a pumper fire truck.  A driveway easement and shared maintenance agreement shall be provided  The applicant shall clarify if the internal access drive is a one-way or two-way drive  Striping shall be added to the curb adjacent to the driveways to prohibit parking  Signage shall be added for private parking only, to prevent Freedom Park users from parking in the development  The 6’ wide concrete sidewalk, which connects to the trail in Freedom Park, shall be shifted so residents are not walking through the middle of the driveway to access it  A sidewalk shall be constructed from the southern driveway, east to Liberty Drive, to provide a pedestrian connection to the existing trail on the east side of Liberty Drive  ADA compliant curb ramps, pavement marking and fluorescent yellow/green pedestrian crossing signage shall be added to the north sides of the intersection of Industrial Boulevard and Liberty Drive to provide a pedestrian connection to the existing trail on the east side of Liberty Drive  City staff recommend adding a sidewalk on the west side of Liberty Drive  The plan sheet shall clarify the length of the pumper truck shown on the diagram PARKING Per NRMC 121-52, off-street parking shall be provided to meet the demand for the proposed land use. The applicant shall calculate this demand based on generally accepted engineering standards, such as published in the Institute of Transportation Engineer's Parking Generation Reports, or the Urban Land Institute Shared Parking Study. Analysis should give consideration to peak hour parking demand, proximity to on-street parking or public parking lots, shared parking agreements with adjacent properties, number of employees, number and type of dwelling units and corresponding anticipated occupancy, and vehicle-ownership ratios, among other factors. Residential uses shall endeavor, but are not required, to provide 1.5 off-street parking stalls per dwelling unit. The applicant has proposed one attached garage stall per unit (32 total). Per NRMC Section 121-52, the stall, aisle, and driveway design for all off-street parking shall comply with the following standards:  The applicant shall provide the dimensions of the proposed external parking stalls, consistent with NRMC 121-52 Table 13 CURB AND GUTTER Per NRMC 121-52, a 6-inch high, poured-in-place concrete curb shall be provided at the periphery of all parking lots and internal access drives. The applicant has proposed a variety of concrete curb and gutter.  The applicant shall label the curb type and locations on the site plan WATER AND SEWER The plans were reviewed by the City Water Superintendent, who provided the following comments:  A permit shall be required for work in the right-of-way  Existing water services shall be abandoned at the tee  Water service connect on Liberty Dr should be 8” wet tap  Show 8x6 reducer on water service  The applicant shall clarify how many water meters will be in each building  Area Drain 4 is on top of water service  Insulate water and storm water crossings  Hydrant shall be Waterous WB67-250, 8’ 6” bury depth with 16” upper standpipe  Recommend review City of New Richmond specifications for utility installations  Show asphalt and curb replacement for both driveway entrances ELECTRIC The proposed development will be served by New Richmond Utilities. Electric service must be installed in accordance with New Richmond Utilities Electric Service Rules and regulations. The developer will be responsible for costs associated with any rerouting of primary electric, installation or removal of transformers, or other work required to provide reliable electric service to the proposed building. All electric utility plans are subject to review and approval by the Electric Superintendent, prior to the issuance of a building permit. The City of New Richmond will relocate a riser pole along Industrial Boulevard at the developer’s expense.  A street light shall be installed mid-block, on the west side of Liberty Drive Page 5 of 12  City staff recommend adding street lighting to the relocated power pole at the intersection of Industrial Boulevard and Liberty Drive  City staff recommend installing street lighting on south side of the northern driveway LIGHTING Per NRMC 121-51, all light fixtures and freestanding luminaires shall have a cutoff angle of less than or equal to 90 degrees. Lighting shall not exceed 1 foot candle as measured at the property line or road center line. The height of a freestanding luminaire shall not exceed 35 feet. Accent lighting used to highlight building facades, foliage, or selected architectural features shall be permitted provided the light source is shielded. The applicant submitted a photometric plan and details for exterior lighting, which are consistent with City requirements. The applicant is proposing 25 wall-packs, and one area light. The lighting does not exceed 1 foot candle at the property line or road center line.  The applicant shall provide the proposed height of the area light DRAINAGE AND UTILITY EASEMENTS Per NRMC 117-41, an easement shall be provided for drainage and utilities at least 10 feet wide along front and rear lot lines and 5 feet wide along all abutting side lot lines.  An easement for drainage and utilities, consistent with NRMC 117-41, shall be recorded separately, or with a future certified survey map GRADING, EROSION CONTROL, & STORMWATER The applicant submitted a grading and erosion control plan, and stormwater report, which was reviewed by the City’s engineering consultant, Short Elliott Hendrickson. Stormwater from the new buildings and pavement will be routed to a total of three infiltration basins. Two basins are located on the northern parcel, and one basin is located on the southern parcel. Stormwater will be conveyed to the three infiltration basins via three storm water pipes. The basins are intended to act as the principal stormwater control practice for the site and will be utilized to meet post-construction peak discharge, water quality, and infiltration requirements. There is one 15” outlet pipe for drainage from the overall site. The following comments shall be addressed:  Provide a sizing methodology/design to show a minimum 80% TSS reduction (pretreatment) prior to each of the three infiltration basins. Another design option to consider would be the construction of a bioretention basin or sand filter per WDNR Technical Standard 1004, which does not require pretreatment. Include or describe the pretreatment prior to infiltration with respect to NR 151.124 (6) & (7) and WDNR Technical Standard 1003 V.B.2.(60% for residential).  Include or describe the imperviousness of the proposed improvements with respect to NR 151.124 (1) in the narrative of the report.  If the ‘infiltration basins’ are intended to be bioretention filters, include information in the construction plans on their construction and address them specifically in the stormwater management plan and maintenance & monitoring agreement.  Section 1.7 of the report mentions a copy of the geotechnical report is to be found in Appendix B of the report, but it was not found. Please include a copy of the said report in the next submittal, and address a site and soil evaluation that is consistent with the WDNR Technical Standard 1002 for the stormwater infiltration BMPs (validate the use of an infiltration rate of 18.78 in/hr in the stormwater modeling and outline which correction factor and textural rates were used). Page 6 of 12  Update the Storm Type or NRCS Rainfall Distribution in the HydroCAD model to MSE3 per NRMC Sec 109-290(a)(6) and Section 2.3 of the report.  Provide hydraulic calculations per NRMC Sec 109-290(b)(5).  Provide a table or analysis in the report narrative addressing NRMC Sec 109-290(c): for new development sites…., the post-development runoff volume must be maintained or reduced compared to the runoff volume from the site in a pre-developed condition for the 25-year, 24- hr. rainfall event. It appears that the pre-to-post is 0.350-af-to-0.219-af in the HydroCAD model. PARK DEDICATION No parkland is proposed to be dedicated as part of the project. The developer shall pay park impact fees in accordance with the fee schedule established by the Common Council at the time of the building permit applications, along with all other impact fees. LANDSCAPING Per NRMC 121-55, the landscaping plan is subject to review of City staff. The proposed landscaping plan consists of 4 Japanese Lilac Trees, 3 Red Jewel Crabapple Trees and 4 Prairifire Crabapple Trees. The landscaping plan provides adequate screening from surrounding properties.  City staff recommend replacing the crabapple trees with different species that do not produce fruit  Additional landscaping, such as shrubs, flowers, and grasses, shall be added throughout the development REFUSE AND RECYCLING Per NRMC 121-48, loading areas and trash/refuse collection areas shall be screened from view from the front of the lot, public rights-of-way and adjacent properties, and located on the lot. The screening shall be accomplished with an enclosed structure constructed of materials consistent with that of the principal building and solid gate, as well as evergreen landscaping, earth berms, or a combination of these items. The applicant is proposing dumpsters.  The applicant shall provide additional information for the dumpster enclosure, including the height, materials consistent with the principal building and a solid gate AGREEMENTS A shared maintenance agreement shall be provided for the dumpster enclosure, storage garage and mailboxes. RECOMMENDATION: City staff recommend approval of the conditional use permit applications with no conditions. City staff recommend approval of the site plan and stormwater review applications with the following conditions: 1. The right-of-way is not being used for its platted purpose. Therefore, it is in the public interest to discontinue it. 9th Street East The portion of 9th Street East highlighted below was never constructed. The New Richmond Middle School (formerly New Richmond High School) was built over the right-of-way. Park Avenue The portion of Park Avenue highlighted below was never constructed. Riley Avenue The portion of Riley Avenue highlighted below was constructed as a street. However, it was closed to assist with traffic flow for pick-up and drop-off at the school. The City has water and sewer mains under Riley Avenue, which the School District will provide an easement to the City for. PROCESS The discontinuation process is described as follows: 1. City Council Preliminary Resolution 2. Notice of Pending Action (Lis Pendens) 3. Class 3 Notice and Service of Summons 4. Plan Commission Public Hearing and Recommendation 5. City Council Final Resolution Preliminary Resolution #052502 to initiate the discontinuance process was passed by the City Council on May 12, 2025. The Notice of Pending Action (Lis Pendens) was recorded with the Register of Deeds on May 6, 2025. A Class 3 Notice was published in the Star Observer on June 12, 19 and 26, 2025. A public hearing will be held at the Plan Commission on July 8, 2025. The Plan Commission will make a recommendation to the City Council, who will take final action on July 14, 2025. Pursuant to Wisconsin Statutes § 66.1005, when land is discontinued, it will revert to the owner or owners of the adjoining land. The adjoining landowner is the School District of New Richmond.
