The Police and Fire Commission of the City of New Richmond was called to order on Thursday,
December 22, 2022, at 6:00 PM, in the Council Chambers, with the following members present:
PRESENT: Kirk Lindell, Jon Hailey, Andrea Kier, Michael Hedges
ABSENT: Jorden Aufderhar
OTHERS PFC Attorney James Kalny (virtual), Michelle Scanlan, Noah Wiedenfeld, Nick
PRESENT: Vivian, Robin Haffner, Attorney Stephen Weld (virtual)
CALL TO ORDER
The meeting was called to order at 6:00pm. by President Jon Hailey.
ROLL CALL
ADOPTION OF AGENDA
Andrea Kier made a motion to adopt the Agenda. Michael Hedges seconded the motion. Carried
unanimously.
APPROVAL OF MINUTES
Kirk Lindell made a motion to approve the Minutes from November 16, 2022. Andrea Kier seconded
the motion. Carried unanimously.
HEARING
PFC President Jon Hailey reviewed the record of the matter of the charges filed against firefighter
Robin Haffner by City Administrator Noah Wiedenfeld so far to date. There was considerable
discussion regarding the pre-hearing timeline including deadlines for dispositive motions, witness and
document lists, pre-hearing motions and responses, and subpoenas, as well as the dates for the
evidentiary hearing (if needed). Key dates discussed are as follows:
• Dispositive Motion(s): Attorney Weld to submit by January 13, Response from Eckberg
Lammers law firm by January 27, Reply by Attorney Weld by February 3, Decision by February
10th
• Witness List and List of Documents: March 3
• Motions and Briefs: March 17
• Simultaneous Exchange of Responses: March 31

• Witness Subpoenas completed: April 17
• Hearing: May 16-17, 2023 commencing at 9:00 am each day (May 18, 2023 at 1:00 pm if
needed)
Kirk Lindell moved to direct PFC Attorney Kalny to draft and circulate the pre-hearing timeline and
evidentiary hearing dates as discussed, Seconded by Andrea Kier, and carried unanimously.
COMMUNICATION AND MISCELLANEOUS
ADJOURNMENT
Andrea Kier made a motion to adjourn at 6:41pm. Kirk Lindell seconded the motion. Carried
unanimously.
