3. APPROVAL OF AGENDA

5. CITY COUNCIL MEETING(S) RECAP – Director Schugel summarized the past month’s City Council
5.1 Meetings and work sessions:
September 16, 2025 Regular – Accepted Donations
October 7 2025 Regular – Approved surplus item (Fitness Equipment)
October 21, 2025 Regular – No Park and Rec related items
October 21, 2025 Work sessions – Discussion on how staff should proceed relating to the restoration
of the Hermann Monument base. A proposal was presented by the architects who performed the
assessment and feasibility study. They are proposing hard cost estimates in preparation of funding the
project. Options included reconstruction or demo. Reconstruction was recommended. The goal is to
present this to the Legislature in 2026 and beyond for Legacy funding. K Johnson asked if the
monument would remain standing. Director Schugel confirmed it is inspected each year.
November 4, 2025 – Regular – Approved a professional services contract to be signed by City Manager
for Hermann Monument Restoration Cost Estimates.
Christian made a motion to accept and order filed the City Council meeting recap that was seconded by
A Johnson. Motion carried unanimously.
6. OLD BUSINESS – Park and Recreation Comprehensive Master Plan Update
6.1 Director Schugel reported ISG held a staff workshop October 3 and went through their
presentation. The purpose of this is to develop a 15-year plan with planning process goals. The 50%
plan draft is due in November. As part of previous planning efforts, ISG did use our prior plans and
analysis. The consultants went through Community demographics; some were brought into the plan.
ISG addressed evolving recreational trends, including pickleball, splash pads and water amenities and
growing demand for trails. There has been good community engagement throughout the planning
process. The maintenance staff were praised for cleanliness and safety with ongoing request for
consistent upkeep and smoother trails. Survey Findings were summarized. Staff participated in a

visioning exercise. The department staff met and discussed program areas, what we feel good about
and challenges we face. Commissioner Jensen made a motion to receive and order filed the Park and
Recreation Master Plan update with a second by K Johnson. Motion carried unanimously.
7. NEW BUSINESS
7.1 2026 Career Expo request – The Career Expo, designed for area 8th and 10th graders to experience
exposure to local businesses on a personal level, held each year at the Civic Center. This location is
better positioned to give vendors more flexibility to showcase businesses and opportunities. The
committee is requesting the rental fee and any additional fees be waived, as there is no budget or
funding for the event. Requests for this event in the past have been approved. A Johnson made a
motion that was seconded by Luneburg to recommend the City Council offer a resolution and
waive the rental fee and all associated fees to hold the Career Expo at the New Ulm Civic Center,
South and North Arenas, on Wednesday, March 25, 2026. Motion carried unanimously.

7.3 Park and Recreation Department Vision Statement
New Ulm's Park and Recreation Department is rooted in historic and collaborative efforts,
fostering a vibrant, collaborative system that offers diverse, accessible facilities and activities to
promote an active and engaged community.
Motion was made by Jensen and seconded by K Johnson to adopt the proposed Park and
Recreation Department Vision Statement. Chair Buegler mentioned the word “collaborative” used,

emphasizing the importance of it. Commissioners liked the proposed statement and the motion
carried unanimously.
8. REPORTS FROM COMMISSIONER AND STAFF

• North Park Dugout project is ongoing
• Mueller Park backstop project is underway
• Lincoln Park playground work continues
• Washington Park bathroom shelter is getting new siding
• Facilities Maintenance Supervisor Weier took a new position in the private sector and Director
Schugel wanted to recognize him for the extensive and quality work he did for the City. Chair
Buegler also thanked Weier for his work.
K Johnson made a motion that was seconded by A Johnson to accept and order filed the Park and
Recreation Department Staff report. All voted in favor of the motion. Motion carried unanimously.
8.3 Department Activity Report highlights
• Great ribbon cutting for Washington Park playground project with Mayor Backer
• New family and theme skating sessions are being offered at the Civic Center

Overview:
1. The Park and Recreation Department was approached by Tavern 507 with the idea of donating a Communication
Board to be installed at one of the playgrounds.
2. Tavern 507 held a fundraiser promotion on Friday evenings for a six-week period and raised $1,700.00 towards the
cost of the Communication Board.
3. The Optimist Club of New Ulm also donated $500.00, which fully funded the Board at a cost of $2,200.00.
4. Communication Boards have pictures and symbols as an effective way for non-verbal, speech-challenged, and early-
learning individuals to communicate with friends and caregivers.
5. The Communication Board would be placed at an entrance to a play area for individuals to use the board for non verbal
expressions.
6. Park and Recreation Staff would install the communication board at a location to be determined in the spring.

PRESS RELEASE
The City of New Ulm Park and Recreation Department is proud to announce a generous donation
from Tavern 507, located inside New Ulm’s Best Western.
Kallie Schugel is a Brown County Autism Social Worker with a passion for serving. In fact, she
enjoys serving others so much, she has a waitressing gig at Tavern 507, a job that she enjoyed in her
high school and college days. Tavern 507 opened in May of this year. Kallie feels strongly about
the importance of giving back to the community and wondered if the new, now local business,
separate of a corporation like the former Green Mill, could possibly do more, so she approached
General Manger Bethany Scott, who said “the rest was history.” Kallie, being a mom and autism
advocate, asked if they would be interested in fund raising for a Communication Action Board to be
placed in one of New Ulm’s popular and frequently visited parks. This idea took on a whole new
level for Bethany, who has a daughter that is neurodivergent, a condition that means they have a
differing in neurological function from what is considered “normal” which frequently references
autism spectrum disorders, where communication barriers may exist. These individuals depend on
non verbal ways to communicate, so the fundraising effort was particularly close to her heart.
A Communication Action Board is a visual tool designed to support individuals who, for various
reasons, experience challenges expressing themselves verbally. Using symbols, pictures, and action
cues, the board helps people communicate needs, feelings, and requests, ensuring that everyone can
fully participate in community spaces. The board will provide a different option to communicate
and will benefit individuals with language delays or barriers and designed for those that need
visuals; after all, everyone wants to play at the park!
Funds were raised by Tavern 507 by donating 10 percent of sales Friday nights for six weeks. The
fundraising effort was promoted through social media and in-restaurant advertising. Both Kallie and
Bethany agreed that people tend to be even more kind and generous when they can see the donation
going directly back into the community. Bethany said that the “Bird Dog (Tavern 507’s parent
owner) leadership team was truly honored to be able to give back in this way.” The New Ulm
Optimist Club added the additional $500 to Tavern 507’s $1,700 donation so that the
Communication Action Board will be fully funded and exact location to be determined soon.
Thanks to these donations, visitors of all abilities will have a clearer and more accessible way to
engage with others; an important step in making our facilities welcoming and inclusive for everyone.
We extend our sincere gratitude to Kallie, Bethany and Tavern 507 and their supporters for their
dedication to autism awareness and helping create a more inclusive community.

Overview:
1. The current lease agreement between the Turner Gymnastics Academy and the City of New Ulm expires on December
31, 2025.
2. The City values a local youth gymnastics program.
3. With almost four full years of operational history City staff was able to identify costs associated with operating this
facility and that is reflected in the rental amount.
4. New Ulm High School ISD 88 will also utilize this Gymnastics Center during their Minnesota State High School
League season and sublease the space from TGA.
5. This agreement has added language for advertising within the Gymnastics Center.
5. This proposed lease agreement has been reviewed multiple times, by all parties involved, including attorneys on both
sides.
6. The Gymnastics Center in the former swim pool room has 11,067 square feet on the ground floor level and 720 square
feet on the upper second floor level, for a grand total of 11,787 square feet.
7. This Gymnastics Center hosts numerous area, conference, regional and sectional competitions and meets along with a
wide variety of youth programming.

LEASE AGREEMENT
THIS LEASE AGREEMENT (the “Agreement”) is made this 16 day of
December 2025, between the City of New Ulm, a municipal corporation (“Owner”),
and New Ulm Turnverein, Inc., a Minnesota non-profit corporation, DBA as Turner
Gymnastics Academy (TGA), (“Tenant”).
RECITALS
WHEREAS, the City of New Ulm is the owner of the New Ulm Recreation
Center (NURC) located at 122 South Garden Street in the City of New Ulm,
Minnesota, and
WHEREAS, Tenant desires to rent a portion of the facilities located at NURC
to operate gymnastics activities, gymnastic programming, gymnastics competitions,
and related activities inside the Gymnastics Center portion of the NURC, as more
fully described below.
NOW, THEREFORE, it is agreed as follows:
Article 1. Premises
Owner will rent to Tenant the herein defined facilities of the NURC, including
the Gymnastics Center, as more fully described herein (the “Premises”), and as
depicted in Exhibit A, which is attached hereto and incorporated herein by reference.
The Gymnastics Center described herein may also be known as the “Turner
Gymnastics Academy.”
Article 2. Term and Termination
The term and conditions of this Agreement shall be binding upon the parties
for an initial period commencing January 1, 2026, and concluding December 31, 2027.
Thereafter, no later than ninety (90) days prior to the end of the term, Tenant
may make a written application to the Owner for a renewal of this Agreement. Upon
Tenant’s application for renewal, the parties shall enter into exclusive negotiations
for the terms of a renewal Agreement for a period of sixty (60) days. If the parties do
not agree to the terms of a renewal of this Agreement within sixty (60) days, or if
Tenant fails to provide timely written application for renewal of this Agreement, this
Agreement shall terminate at the conclusion of the term.

Notwithstanding any provision of this Agreement, the Owner may terminate
this Agreement upon sixty (60) days written notice to the Tenant at any time during
the term hereof or any renewal term.

monthly rent:
$4,180.00 (four thousand one hundred eighty dollars and zero cents)
commencing January 1, 2026, and on the first day of each month thereafter, as
base rent during the full term of this Agreement. Base rent includes use of the
Premises, including the Gymnastics Center and all common areas in the
NURC, including lobbies, hallways, restrooms, locker rooms, entrance area,
parking lots and exterior grounds, as approved by the Park and Recreation
Director.
Base rent shall not include the use of all other user-fee areas, of the NURC
including Vogel Fieldhouse, racquetball courts, multipurpose rooms and
fitness center. Use and/or reservation of these areas by Tenant will require
Tenant to pay normal user fees according to the adopted City Park and
Recreation fee schedule.
Article 4. Utilities and Refuse.
During the term of this Agreement, Owner shall provide the following utilities
to the Premises at no additional cost to Tenant: heat, air conditioning, electricity,
water and sewer services. If the Tenant desires telephone, cable TV or internet
services, the same shall be the responsibility of Tenant. Refuse and recycling
materials generated through Tenant’s normal operations may be deposited by Tenant
in the Owners’ refuse and recycling receptacles in the rear of the building.
Article 5. Use of Premises
Tenant shall use the Premises for the operation of amateur gymnastics
programs, including gymnastics classes and competitions. Tenant agrees that,
during the full term of this Agreement, Tenant shall provide gymnastics activities or
programming, available to the public, without a TGA membership, on a regular
basis, and on a schedule to be approved by Owner.
Tenant understands that the NURC is a multiple use facility, and that except
as is specifically provided for herein, Tenant does not have the exclusive use of the
facility.

Article 6. Assigning and Subletting.
Tenant may not assign, sublet, or mortgage this lease or any right hereunder
without the express written consent of Owner. Any assignee of Tenant approved by
Owner shall be obligated to assume all of Tenant’s rights and obligations under the
term of this Lease Agreement.
Tenant may sublet the Premises, such as to Independent School District 88
(ISD88), provided that all such sub-leases shall be subject to the advance written
approval by Owner.
Article 7. Gymnastics Equipment.
Owner agrees that Tenant may, at Tenant’s sole expense, install, clean and
maintain gymnastic equipment in the Gymnastics Center. Tenant shall be solely
responsible for the cleaning, maintenance, repair and replacement of all such
equipment.
Article 8. Maintenance, Repair and Custodial.
During the full term of this Agreement, Tenant shall be required to provide all
custodial services required and to otherwise keep the Gymnastics Center, including
gymnastics equipment, gymnastic activity areas, spectator areas, multipurpose room
areas, restroom, storage areas and office areas in the Gymnastics Center on the
Premises in a clean, orderly and sanitary condition. Tenant will provide its own
cleaning equipment. Owner may sell at cost to Tenant, toilet paper, hand soap, and
other cleaning supplies. Owner will provide Tenant access to a mop sink, including
hot and cold water. Owner shall be responsible for all cleaning, custodial services,
repair and maintenance to the Non- Gymnastics Center areas of the NURC including
common areas, restrooms, locker rooms, hallways, multi-purpose rooms, fieldhouse,
racquetball courts, aquatic center, playground, storage areas and office areas.
Tenant will not deface, injure or damage the Premises and will not do, or
permit to be done, on the Premises or adjoining ways, anything that would constitute
a nuisance. Tenant shall, at its own expense, keep the Gymnastics Center and
portions of the Premises over which they have exclusive use during the term of this
Agreement, including equipment, fixtures, and appliances located thereon in good
repair and in good sanitary condition. The Owner shall in all cases be responsible
for regular custodial services and for general building maintenance including but not
limited to the maintenance and repair of all HVAC, plumbing, electrical systems and
Non- Gymnastics Center sound systems, unless the same are damaged by Tenant. If
Tenant does not repair or replace any portions of the Premises as required by this

Agreement, Owner may repair the same at its discretion, after having given written
notice of such need to Tenant. In such event, Tenant shall pay the Owner the cost of
such repairs within thirty (30) days of repair completion. In the event that any part
of the NURC is damaged as a result of the intentional acts of Tenant, its team
members or representatives, the team members or representatives of visiting teams
or other users, or in the event that any of the foregoing create situations requiring
greater than normal custodial services, Tenant shall be responsible for the costs
associated with cleaning or repairing the NURC as a result of such activities.
Article 9. Concessions
A. Concessions in the Gymnastics Center. Tenant shall have an exclusive right
to operate all food and beverage concessions within the Gymnastics
Center, provided that Owner reserves the right to approve all vended and
concessions food and beverage items.
B. Concessions in Other Areas of NURC. Owner reserves the right to allow
other entities to vend food and beverages within the NURC, with the
exception of the Gymnastics Center.
C. Special Events. Owner may allow Tenant use of appropriate areas for
special event concessions for special events which are not held in the
Gymnastics Center, if requested by Tenant. Tenant will pay to Owner five
percent (5%) of gross concessions revenue from any concessions operated
by Tenant for special events which are not held within the Gymnastics
Center. Tenant will give Owner full accounting reports of event sales,
expenses and revenues related to concessions.
D. Permits and Licenses Required. Tenant’s operation of any concession stand
or area within the NURC shall be contingent upon Tenant obtaining and
maintaining all necessary concession permits and government licenses.
E. Liquor Sales Prohibited. Tenant shall not permit the sale of alcohol or
liquor at the Premises during Tenant’s operation of any food and beverage
concessions.
Article 10. Advertising in the Gymnastics Center
A. Scope of Authority. Owner delegates to Tenant the exclusive right to sell,
arrange for, and contract for advertising to be placed in the Gymnastics
Center during the term of this Agreement, commencing January 1, 2026,
and any renewal term of this Agreement, subject to the standards and
limitations provided by Owner and as described herein.

B. Fee for Advertising Right. For the exclusive right to sell, arrange for, and
contract for advertising within the Gymnastics Center, Tenant agrees to
pay Owner an amount equal to ten percent (10%) of the total gross sales
made by Tenant for advertising in the Gymnastics Center each year (the
“Total Fee Amount”). Tenant shall pay the Total Fee amount for each Term
on September 1st and include an accounting of all applicable sales. Owner
may negotiate an increase to the percentage of the Total Fee Amount due
to Owner after the completion of the first renewal term and upon any
subsequent renewal of this Agreement by providing written notice of such
increase to Tenant at least sixty (60) days prior to the date of expiration of
the renewal term then in effect.
C. Advertising and Signage. Owner reserves the right to approve all
advertising prior to installation in the Gymnastics Center. Owner will not
unreasonably withhold its approval of any request by Tenant submitted
under this Article. Tenant shall only sell, arrange for, or contract for
advertising within the Gymnastics Center.
D. Advertising Expenses. All expenses related to advertising material(s)
and/or sign(s) (including but not limited to, installation and sign
maintenance and upkeep) shall be borne exclusively by the Tenant. Tenant
shall be responsible for the removal of all advertising at the expiration or
earlier termination of this Agreement.
E. Primary Facility Sponsor Exclusivity. Tenant acknowledges that there is a
sponsor with the exclusive naming rights for the NURC (the “Primary
Sponsor”) and that Owner may also grant naming rights or advertising
rights to other areas or portions of the NURC. Tenant acknowledges and
agrees that Tenant will not sell, arrange for, or contract for the advertising
of any competitor of the Primary Sponsor. “Competitor” is defined as a
retail business engaged exclusively or primarily in financial services,
including checking and savings accounts, credit card, loans, and financial
planning. By way of example, this would include, but not be limited to,
businesses such as Citizens Bank, Blaze Credit Union, Wings United
Prairie Bank, Edward Jones, etc. Competitors do not include businesses
such as Target, Walmart, Menards, etc., that may offer credit cards, but are
not engaged exclusively or primarily in financial services.
F. No Public Forum. The parties agree that the Owner, in permitting Tenant
to sell and install advertising in the Gymnastics Center, is not creating a
forum for public speech protected by the United States or Minnesota
constitutions. In furtherance of the Owner’s objectives of minimizing

opportunities for abuse, the appearance of favoritism, and the risk of
imposing on a captive audience, Owner hereby reserves the right to reject
or remove any banner, sign, or other advertising media that it deems
inappropriate or offensive, and expressly prohibits the display of religious
or political signage in any portion of the Gymnastics Center. This
prohibition includes any materials endorsing or promoting or otherwise
related to candidates for political office or political parties.
In addition, Tenant shall not sell, arrange, or contract for, and Owner shall
not approve, advertising if it relate to the following:
1. Companies whose business is substantially derived from the
sale of alcohol, tobacco, cannabis and other products regulated
under Minnesota Statutes, Chapter 342, gambling, firearms or
pornography; or
2. Businesses regarded as “Adult Uses” as defined in Chapter
13.3 of the Zoning Ordinance of the City of New Ulm.
G. Owner’s Right to Cover or Remove. Owner reserves for itself the right to
temporarily cover or remove any affixed signs, logos, and/or
advertisements in the Gymnastics Center as necessary or convenient to
meet Owner’s contractual obligations to the Primary Sponsor or other
sponsors or if the signs, logos, and/or advertisements otherwise violate the
standards and limitations of this Article.
Article 11. General Liability Insurance
Tenant, at its expense, shall obtain and keep in force during the term of this
Agreement, the following insurance coverages in at least the listed minimum
amounts:
A.Worker’s Compensation coverage in statutorily required amounts.
B.Employees Liability coverage in limits of One Hundred Thousand
Dollars ($100,000.00) per employee.
C. Comprehensive General Liability coverage in limits of not less than
Two Million Dollars ($2,000,000.00) per occurrence for personal
bodily injury and death, and limits of Two Million Dollars
($2,000,000.00) for leased premises damages liability. Such liability
insurance shall additionally cover:

1. Public liability, including premises and operations coverage.
2. Independent contractors—protective contingent liability.
3. Personal injury.
4. Owned, non-owned and hired vehicles.
5. Contractual liability covering the indemnity obligations set
forth herein.
Tenant shall name Owner as an additional insured under its comprehensive general
liability policy. Tenant shall furnish copies of insurance policies or certificates of
insurance which shall be delivered to Owner prior to the commencement of this
Agreement and on the annual anniversary date of each year of this Agreement.
All policies listed above shall be written on an “occurrence” form (“claims made”
and “modified occurrence” forms are not acceptable) and shall apply on a “per
occurrence” basis.
With the exception of the Worker’s Compensation policies, all policies listed above
shall insure the defense and indemnity obligations assumed by Tenant under this
Agreement, and shall name Owner as an additional insured under the policy.
All polices listed above shall contain a provision that coverages afforded thereunder
shall not be canceled or non-renewed, nor shall coverage limits be reduced by
endorsement, without thirty (30) days prior written notice to Owner.
Article 12. Indemnity
A. Indemnification of Owner. Tenant shall indemnify, protect, save, hold
harmless and insure Owner, and its respective officers, employees and
members and agents, from and against any and all claims and demands for,
or litigation with respect to, all damages which may arise out of or be caused
by Tenant or its agents, employees, contractors or subcontractors with
respect to Tenant’s performance of its obligations under this Agreement or its
presence on or use of the Premises, or that of Tenant’s employees, members,
board, officers, agents, volunteers, clients and invitees. Tenant shall defend
Owner against the foregoing, or litigation in connection with the foregoing,
at Tenant’s expense, with counsel reasonably acceptable to Owner. Owner,
at its expense, shall have the right to participate in the defense of any Claims
or litigation and shall have the right to approve any settlement, which
approval shall not be unreasonably withheld. The indemnification provision

of this Section shall not apply to damages or other losses proximately caused
by or resulting from the negligence or willful misconduct of Owner. All
indemnification obligations shall survive termination, expiration or
cancellation of this Agreement.
B. Assumption of Risk. Tenant knows, understands and acknowledges the
risks and hazards associated with using the Premises for the purposes stated
herein and hereby assumes any and all risks and hazards associated
therewith. Tenant hereby irrevocably waives any and all claims against the
Owner or any of its officials, employees or agents for any bodily injury
(including death), loss or property damage incurred by Tenant as a result of
Tenant’s use of the Premises, and hereby irrevocably releases and discharges
the Landlord and any of its officials, employees or agents from any and all
claims of liability.
Article 13. Alterations
Tenant shall make no alterations, changes, or improvements to the Premises
without the written consent of Owner or the person designated by the Owner.
Article 14. Security
Tenant shall provide security at and during Tenant’s activities, sufficient to
maintain order and provide adequate safety for all people attending the activities,
and to ensure Tenant’s compliance with Tenant’s legal obligations, as may be
required by Owner.
Article 15. Damage or Destruction
If the NURC shall be destroyed or damaged by fire or other casualty to any
extent which prevents the NURC from being used for the purposes intended by this
agreement, Owner may elect to rebuild/repair or give notice terminating this
Agreement. Owner shall give written notice to Tenant of its election within thirty (30)
days after such damage or destruction. If Tenant is unable to use NURC facilities, a
proportionate part of the rent shall be abated for any time during which Tenant is
unable to utilize the rental Premises. Tenant shall also be entitled to elect to
terminate this Agreement upon written notice in the event of damage or destruction
detrimentally affecting Tenant’s operations, practices, or competitive events.
In the event of damage by fire or other casualty resulting in damage to
Tenant’s property, Tenant may repair or replace all its fixtures, furniture, equipment,
and other personal property and improvements originally installed by Tenant at its
expense.

Article 16. Liens
Tenant shall not permit any mechanic’s or other lien against the rental
Premises or the Owner arising out of any act or omission of Tenant. Tenant may
contest the validity or amount of any lien if Tenant shall give Owner security
required by Owner to ensure payment or prevent any forfeiture of the Premises.
Tenant shall pay any judgments and have all liens released or judgments satisfied at
Tenant’s expense.
Article 17. Default
If Tenant shall default on any of the provisions of this Agreement, or if Tenant
shall make an assignment for the benefit of creditors, enter bankruptcy, receivership
or insolvency proceedings, Owner, at its election, may give notice to Tenant in
writing specifying the default. Tenant shall have thirty (30) days after notice is sent
to cure the default. If default continues thereafter, Owner may declare the term of
this Agreement ended and re-enter the Premises and the Agreement shall thereupon
terminate. In such event, Owner may, either with or without process of law, enter the
Premises and expel Tenant and all other persons on the Premises using such force as
may be necessary to repossess and enjoy the Premises without prejudice to any other
remedy which might be available.
If Owner is in default under this Agreement, Tenant, at its election, may give
notice to Owner in writing specifying the default. Owner shall have thirty (30) days
after notice is sent to cure default.
In the event of a catastrophic failure, Owner agrees to discuss possible
solutions with Tenant to cure default. Owner also notifies Tenant that Owner has no
insurance coverage for Tenant’s loss of revenue.
Article 18. Non-Waiver
No waiver by Owner of any breach by Tenant of its obligations hereunder
shall be a waiver of any other subsequent or continuing breach. Forbearance by
Owner to seek a remedy for any breach by Tenant shall not be a waiver of its rights
or remedies with respect to the breach.
Article 19. Surrender
At the termination of this Agreement for any reason, Tenant shall, within
thirty (30) days of the termination of the Agreement, quit and surrender the Premises

in as good condition as when received, reasonable wear and tear and damages by the
elements or causes beyond Tenant’s control excepted.
Upon the termination of this Agreement, Tenant shall remove its trade
fixtures, equipment and other personal property owned by Tenant at its expense,
provided it shall repair all damage caused by removal.
Article 20. Obligation of Parties
The agreements in this lease shall be binding upon and enforceable by the
parties, their personal representatives, successors and assigns.
Article 21. Relationship of Parties
Nothing contained in this Agreement shall be construed to create a
relationship of principal and agent, partnership, joint venture or association between
Owner and Tenant. Neither the method of computing rent nor any act of the parties
shall create any relationship between the parties other than the relationship of
Landlord and Tenant.
Article 22. Modification of Agreement
Any agreement made between the parties shall be ineffective in changing,
modifying, or discharging this Agreement in whole or in part unless the agreement is
in writing and signed by both parties. An oral agreement for the modification of the
Lease Agreement in any manner shall be void and of no force and effect.
Article 23. Notices
Any notices relating to this Lease Agreement shall be submitted to the
following representatives of the parties at the following addresses:

Parks
Crews performed routine maintenance, including mulching leaves at the parks. Dirt was added and dormant
seeded at Lincoln and Washington Park playgrounds. Tar was replaced with cement in the North Park
dugouts. Permanent shade structures are supposed to be installed this year yet, weather depending. Work on
the wading pools wrapped up. Pickleball nets were removed from the parks.
Civic Center
Routine maintenance was done at the Civic Center and special colored program lighting added to the South
Arena. Both high school teams started their season.

Two sessions of swim lessons were completed in November. This marks the end of lessons for the year.
New sessions will begin in January. One lifeguard training class was held; three individuals were certified.
We are offering a high school physical education class focused on aquatics for the fall semester, including
physical conditioning, games and optional lifeguard certification. All students from NUHS and CHS passed
their physical benchmarks and should finish all lifeguard requirements by December 20 if they chose to be
certified. Volleyball and Tennis leagues and lessons started.
