City OF NEWPORT, KY SPECIAL MEETING OF THE BOARD OF COMMISSIONERS Monday, June 17, 2019 MINUTES CALL TO ORDER / ROLL CALL The meeting was called to order by Mayor Peluso at 4:00 p.m. in the Multi-Purpose Room of the Newport Municipal Building at 998 Monmouth Street. Mayor Peluso noted the special meeting agenda does not include a public forum but anyone wishing to address the Board about items on the agenda will be given an opportunity. In attendance were: Commissioner Beth Fennell Commissioner Thomas Guidugli, Jr., Commissioner Frank Peluso, Commissioner Ken Rechtin, and Mayor Jerry Peluso. Also in attendance were: City Manager Thomas Fromme, Assistant City Manager Larisa Sims, City Attorney Daniel Braun, Police Chief Tom Collins, Director of Finance Leonard Kuntz, Fire Chief Bill Darin, Community Liaison Bev Holiday, and City Clerk Amy Able. OLD BUSINESS The city clerk gave second reading by title and summary to O-2019-015. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AMENDING THE BUDGET FOR THE CITY FOR THE FISCAL YEAR JULY 1, 2018 TO JUNE 30, 2019, INCLUDING AN ESTIMATE OF REVENUES AND RESOURCES AND MAKING THE ANNUAL APPROPRIATION IN ACCORDANCE THEREWITH. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Fennell. Upon hearing there were no comments or questions, the mayor called for a roll call vote. Commissioner Guidugli: Yes Commissioner Rechtin: Yes Mayor Peluso: Yes Commissioner Fennell: Yes Commissioner Peluso: Yes Motion carried 5-0. The city clerk gave second reading by title and summary to O-2019-016. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY ADOPTING THE BUDGET FOR THE CITY FOR THE FISCAL YEAR JULY 1, 2019 TO JUNE 30, 2020, INCLUDING AN ESTIMATE OF REVENUES AND RESOURCES AND MAKING THE ANNUAL APPROPRIATION IN ACCORDANCE THEREWITH. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Guidugli. Upon hearing there were no comments or questions, the mayor called for a roll call vote. Commissioner Peluso: Yes Commissioner Fennell: Yes Mayor Peluso: Yes Commissioner Guidugli: Yes Commissioner Rechtin: Yes Motion carried 5-0. The city clerk gave second reading by title and summary to O-2019-017. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY CREATING SECTION 111.52 OF THE NEWPORT CODE OF ORDINANCES CREATING A REGULATORY LICENSE FEE. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Fennell. The mayor called for any questions or comments. Ms. Karen [Schiltz], Wooden Cask, asked if the credit could be given quarterly. Mr. Kuntz noted the first collection will not be a full-year but a six-month period and there will be reconciliation with various Board of Commissioners of Newport, KY June 17, 2019 Meeting Minutes other reporting requirements and forms. Mr. Fromme said the suggestion will be reviewed by staff and notice will be given to license holders. Commissioner Rechtin asked if temporary licenses are included. Mr. Fromme said the regulatory fee will apply to temporary licenses and were sent to all license holders. Exceptions (by State law) include classifications such as wholesalers and rectifiers. Commissioner Rechtin asked about language in the letter indicating an initial rate of 2.5%. Mr. Fromme stated the wording mimicked the statute, by law the fee can be up to 5% (if justifiable and reviewed annually, the proposed fee is 2.5%). Mr. Peter Newberry stated after the last meeting an apology is due. Upon hearing there were no further comments or questions, the mayor called for a roll call vote. The city clerk gave second reading by title and summary to O-2019-018. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AMENDING AND CREATING VARIOUS SECTIONS OF CHAPTER 111 OF THE CODE OF ORDINANCES CONCERNING ALCOHOLIC BEVERAGES. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Peluso. Upon hearing there were no comments or questions, the mayor called for a roll call vote. Commissioner Guidugli: Yes Commissioner Fennell: Yes Mayor Peluso: Yes Commissioner Peluso: Yes Commissioner Rechtin: Yes Motion carried 5-0. The city clerk gave second reading by title and summary to O-2019-019. AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AMENDING SECTION 99.06 AND 99.10 OF THE CODE OF ORDINANCES CONCERNING RENTAL DWELLING LICENSES AND INSPECTIONS. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Peluso. The mayor called for any comments or questions. Mr. Steve Saunders asked if this includes all apartments or hotels planned to come. Mr. Fromme said this is for all rental property. Mr. Terry Bond asked about the cap and Mr. Fromme said the cap is being raised (from $5k to $8k.) Upon hearing there were no further comments or questions, the mayor called for a roll call vote. NEW BUSINESS The city clerk read R-2019-056 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY, AUTHORIZING AND APPROVING A CREDIT OF THE OCCUPATIONAL LICENSE FEE FOR NEW EMPLOYEES AS PART OF AN ECONOMIC DEVELOPMENT PROJECT BY COMPREHENSIVE MEDICAL MANAGEMENT, LLC UNDER THE KENTUCKY BUSINESS INVESTMENT PROGRAM PURSUANT TO KRS 154.32-010 THROUGH 154.32-100. Commissioner Peluso made a motion to approve; second to the motion was offered by Commissioner Fennell. Mrs. Sims stated the local incentive (JDIP) was approved at the last meeting, this allows access to the State program as well. Upon hearing there were no comments or questions, the mayor called for a roll call vote. The city clerk read R-2019-057 AN ORDER OF THE BOARD OF COMMISSIONERS OF THE CITY OF NEWPORT, KENTUCKY AUTHORIZING AND DIRECTING CITY MANAGER THOMAS J. FROMME TO EXECUTE A CONTRACT WITH SUNESIS FOR RIVERFRONT COMMONS BRIDGES PROJECT, TIP (SNK) GRANT #6-434. Commissioner Guidugli made a motion to approve; second to the motion was offered by Commissioner Fennell. Mrs. Sims stated this is for pedestrian bridges to the Taylor Southgate Bridge. The bid was under the grant award amount. The next step will be a MOA. The project will be timed either to be complete by Riverfest or not begin until after. A twenty percent (20%) match is required by the City. Commissioner Fennell noted this includes over $1m from OKI SNK funds. Commissioner Peluso asked if security cameras can be added since the amount is under the estimate and Mrs. Sims replied they are waiting on some ACE costs, but if that is an approved item it can be modified to include such addition. Upon hearing there were no further questions or comments, the mayor called for a roll call vote. ADJOURNMENT The mayor stated the next regular meeting will be July 22 at 7 p.m. and thanked everyone for attending.
