SPECIAL MEETING OF THE BOARD OF COMMISSIONERS
Wednesday, August 28, 2019
MINUTES
CALL TO ORDER / ROLL CALL
The meeting was called to order by Mayor Peluso at 4:00 p.m. in the Multi-Purpose Room of the
Newport Municipal Building at 998 Monmouth Street.
In attendance were: Commissioners Thomas Guidugli, Jr., Frank Peluso, Ken Rechtin, and Mayor
Jerry Peluso. Absent: Commissioner Beth Fennell Commissioner. Also in attendance were: City
Manager Thomas Fromme, City Attorney Daniel Braun, Assistant City Attorney Robert List, Assistant
City Attorney John Hayden, Fire Chief Bill Darin, Assistant City Manager Larisa Sims, Police Chief
Tom Collins, and City Clerk Amy Able.
EXECUTIVE SESSION
Commissioner Guidugli made a motion to enter into an executive session as allowable under KRS
61.810 (1) for “(c) discussions of proposed or pending litigation against or on behalf of the public
agency”; and “(e) collective bargaining negotiations between public employers and their
employees or their representatives”. Second to the motion was offered by Commissioner Peluso.
Upon hearing there were no questions, the mayor called for a roll call vote.
Commissioner Guidugli: Yes Commissioner Rechtin: Yes
Commissioner Peluso: Yes Mayor Peluso: Yes Motion carried 4-0.
Mr. Braun explained the hearing would be conducted in closed session and only counsel, the
executive committee and active members of the fire department, city staff, and the police
department (for control purposes) would remain in the room during these discussions.
Two representatives of the AFL-CIO and Kentucky Firefighters Association President Joe Baer
stated they represent the Fire Department and asked to remain in attendance.
Mayor Peluso asked about response to calls for service during the meeting. Mr. Silvati stated he
was not on shift; those present in uniform were. Chief Darin stated those on duty are typically
permitted to attend Board meetings and leave if a call comes in.
Mr. Braun stated that once the hearing is complete the Board would deliberate but no return to
regular session for action this evening will follow. The contract indicates that a decision in writing
will be presented within fifteen days and this is the Board’s intent. Mr. Braun stated for those
present giving testimony, the matter is limited to discussion of the four grievances presented only,
not in a capacity to change the current collective bargaining agreement as it stands.
Attorneys Clement Tsao and Pamela Newport of Branstetter, Stranch and Jennings, PLLC and
IAFF Local 45 President M. “Jake” Silvati were present to represent IAFF Local 45.
Approximately twenty-nine members of IAFF Local 45 remained in attendance.
The mayor asked all others to clear the room for the hearing.
ADJOURNMENT OF SPECIAL MEETING
There being no further business on the special meeting agenda, Commissioner Rechtin made a
motion to adjourn the hearing and reconvene in executive session. Commissioner Guidugli
offered a second to the motion. The Mayor asked for a roll call vote.

The hearing portion of the meeting adjourned at 5:25 p.m., the Board reconvened in executive
session on the second floor of the city building at approximately 5:30 for deliberation with
Commissioners Guidugli, Peluso, Rechtin, Mayor Peluso, and City Attorney Daniel Braun present.
Following a motion and second to exit the executive session, carried by voice vote, there being
no further business, the meeting adjourned at approximately 6:30 p.m.
