BACKGROUND: l The City of Newport News (City) has leased Parcel 11 to B & C Shoreside, LLC, (B & C) since September 1, 2001. l This lease is set to expire on May 31, 2014. l The current lease allows for the tenant to request a lease renewal of up to twenty (20) years at the sole approval and discretion of the City, provided all the terms and conditions of the existing lease have been met. l B & C requested a twenty (20) year renewal by letter dated March 1, 2014. l In addition to improving and maintaining the property, all lease payments are current, leasehold taxes have been paid and insurance requirements have been met. l All terms and conditions of the existing lease will remain in effect for the lease renewal. l The City Manager recommends approval. A final inspection has been made of Tudor Court (40-foot right-of-way), Beauregard Way (50-foot right-of-way), and Whitaker Court (40-foot right-of-way) and this inspection reveals that the owners have complied with all requirements as stated in the City’s Subdivision Ordinance. Resolution Authorizing the City Manager to Execute a Memorandum of Agreement (MOA) Establishing the Hampton Roads Regional Water Quality Monitoring Program ACTION: A REQUEST TO APPROVE A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT (MOA) ESTABLISHING THE HAMPTON ROADS REGIONAL WATER QUALITY MONITORING PROGRAM. BACKGROUND: l In preparation for the implementation of the Chesapeake Bay Total Maximum Daily Load (TMDL), the six Phase I Municipal Separate Storm Sewer System (MS4) Localities in Hampton Roads are interested in regionally monitoring stormwater and requested that this effort be coordinated by the Hampton Roads Planning District Commission (HRPDC). l HRPDC is requesting that the six participating Phase I Localities execute a MOA that memorializes the obligations of the participating entities. FISCAL IMPACT: l The Regional Monitoring Program being proposed is based on a five-year work plan and will represent an annual cost to each locality of $84,000 for a total of $420,000. l The City's portion of this annual payment will be funded from the annually appropriated Stormwater Management Operating Budget. l The City Manager recommends approval. Supporting Material CM Memo re Executing MOA to Establish HR Water Quality Prog sdm12469 Authorizing re MOA re Hampton Roads Regional Water Quality Monitoring Program  CITY OF NEWPORT NEWS OFFICE OF THE CITY MANAGER April 16, 2014 TO: The Honorable City Council FROM: City Manager SUBJECT: MOA Establishing the Hampton Roads Regional Water Quality Monitoring Program City Council is requested to approve a resolution authorizing the City Manager to execute a Memorandum of Agreement (MOA) establishing the Hampton Roads Regional Water Quality Monitoring Program. In preparation for the implementation of the Chesapeake Bay TDML (Total Maximum Daily Load), the six (6) Phase I MS4 Localities (Chesapeake, Hampton, Newport News, Norfolk, Portsmouth, and Virginia Beach) in the Hampton Roads Region are interested in monitoring stormwater in a manner which quantifies the nitrogen, phosphorous and sediment loads associated with specific land uses. The Phase I MS4 Localities have asked that this effort be coordinated by the Hampton Roads Planning District Commission (HRPDC). HRPDC is requesting that the six participating Phase I localities execute a MOA that memorializes the obligations of the participating entities. The proposed monitoring program is based on a five-year workplan with acquisition of equipment and services amortized over the entire term of the initial program. The data generated will be submitted to the Virginia Department of Environmental Quality (VDEQ) to update and improve the accuracy of existing Chesapeake Bay TMDL computer models and to help formulate action plans needed to meet both the Chesapeake Bay and “other” TMDLs. The proposed monitoring program is also intended to satisfy, in part, the monitoring requirement which will be a compliance provision under the next five-year term of the City's MS4 Permit. The Honorable City Council Page 2 MOA Establishing the HR Regional Water Quality Monitoring Program April 16, 2014 Program costs will be divided equally between the Localities and the annual cost to each Locality for each year of the five-year term of this agreement is $84,000, for a total of $420,000. Hairston Seawell. The bequest is made with no restrictions. Mr. Seawell was a former member of the Newport News Public Library System Advisory Board of Trustees. The funds will be used to continue the development the Library System and will help the Library System reach the goals of its strategic plan.
