WHEREAS, Canon Virginia, Inc. has offered to donate camera equipment to the City of Newport News; and WHEREAS, this equipment will be used by the Newport News Police Department to enhance the City’s law enforcement capabilities; and WHEREAS, the City Manager recommends to City Council that this gift be accepted. BACKGROUND: l Chapter 41 of the City Code regulates the operation of vehicles for hire. l City Code outlines regulations for advertising on a taxicab; it does not outline specifications for posting contact information for the taxicab company, specifically advertising a smartphone application. l The new sub-section allows taxicabs to display contact information related to the taxicab services. l The Police Department supports the amendment and feels citizens will benefit from it. l The City Manager recommends approval. BE IT ORDAINED by the Council of the City of Newport News, Virginia: 1. That Chapter 41, Vehicles for Hire, of the Code of the City of Newport News, Virginia, Article III., Taxicabs, Division 8., Taxicab Operating Regulations, Section 41-130, Lettering and numbering; display of advertising; lights other than those required by law, be, and the same hereby is, amended and reordained as follows: CHAPTER 41 VEHICLES FOR HIRE ARTICLE III. TAXICABS DIVISION 8. TAXICAB OPERATING REGULATIONS Sec. 41-130. Lettering and numbering; display of advertising; lights other than those required by law. (a) All taxicabs operated under certificates issued pursuant to the provisions of this article which are operated under one (1) trade name shall be of unique and uniform color and lettering as approved by the chief of police, shall display the trade name of the taxicab on both sides and rear of the vehicle in letters at least three (3) inches in height, and shall be uniquely numbered with numbers at least three (3) inches in height on both sides and the rear of the taxicab. Such numbers shall be placed on both sides and the rear of each taxicab in a prominent place. Lettering and numbers shall be affixed to the taxicab by painting thereon or by stick-on letters and numbers that are not easily removed without damage to the letters and numbers. Letters and numbers shall not be magnetically attached to the taxicab. (b) No advertising shall be displayed in or on a taxicab, except advertising on a panel affixed to the rear bumper of the taxicab. Such panel shall neither obscure the rear view vision of the driver, nor shall it obscure any licensing, lettering, lights or signals required to be displayed on the rear of the taxicab.  (c) No lights shall be added to a vehicle used as a taxicab other than the outside roof mounted light designating the vehicle as a taxicab and those lights otherwise required by law. (d) Outside roof mounted lights shall be turned on and in proper operating order during all times as the taxicab is hired or available for hire. (e) Taxicabs may display telephonic, internet, or other contact information that can be used to arrange taxicab service, which displays shall not be considered advertising for purposes of this section. A maximum of three means of contact may be displayed on a taxicab. Each means of contact may be displayed once on both sides and the rear of the vehicle, provided that such displays shall not obscure any licensing, lettering, lights or signals required to be displayed on the taxicab. Any changes to contact information must be pre-approved by the chief of police or his designee before such changes are made to ensure compliance with the specifications of the certificate, per section 41-69 of this code. Changes to contact information displayed on a taxicab will require that taxicab to be subject to inspection, including applicable fees, in accordance with section 41-121 of this code. 2. Resolution Approving the Amendment and Restatement of Each of the Creation Agreement and Service Agreement of the Hampton Roads Regional Jail Authority (HRRJ) ACTION: A REQUEST TO APPROVE A RESOLUTION AMENDING AND RESTATING EACH OF THE CREATION AGREEMENT AND SERVICE AGREEMENT OF THE HAMPTON ROADS REGIONAL JAIL AUTHORITY (HRRJ). BACKGROUND: l On June 18, 2014, the HRRJ Authority voted to approve amendments to the Creation Agreement and the Service Agreement in order to admit the City of Chesapeake as a member jurisdiction. l As a result of HRRJ action, the local governing body of each HRRJ member jurisdiction must now approve these amendments no later than October 1, 2014. l As a member jurisdiction, the City of Chesapeake will have the same rights and obligations as the current HRRJ members. l HRRJ projected an $8.2 million revenue decrease due to the rapid loss of U.S. Immigration and Customs Enforcement detainees. l The addition of the City of Chesapeake will alleviate a considerable loss in revenue for HRRJ and provides a decrease to the City's FY15 per diem rate increase. l The City Manager recommends approval.
