(JRFP) AND AUTHORIZING THE CITY MANAGER TO EXECUTE ANY DOCUMENTS NECESSARY TO EFFECTUATE THE TRANSACTION. BACKGROUND: l The City recently closed the James River Fishing Pier due to structural issues, and it is now undergoing demolition and replacement. l The closure of the pier has negatively impacted financial conditions related to the City's lease with JRFP. l An amendment to the lease to provide some financial accommodation for a limited period of time is being proposed to address the consequences of closure of the pier. FISCAL IMPACT: l The amendment includes forgiveness of the remaining balance of $22,450 plus accrued interest on a promissory note and adjustment of the additional rent percentage from 10% to 7% beginning March 17, 2014 until the pier is rebuilt and available for public use. l The City Manager recommends approval. BACKGROUND: l Robert E. Yancey, owner of 808 Triton Court, requests vacation and conveyance of the 15-foot easement located on this parcel. l The City acquisition of the easement was originally part of a transaction memorialized in a Land Exchange Agreement dated November 23, 2010. l As part of the transaction set forth in the Agreement, a lot for a sanitary sewer pump station known as 809 Triton Court and the easement on 808 Triton Court were conveyed. l The pump station parcel was transferred to the Hampton Roads Sanitation District (HRSD) by the City and HRSD installed the sewer main in the City right-of-way of Triton Court rather than in the easement rendering the easement unnecessary. l This first amendment to the Land Exchange Agreement will mutually release reciprocal duties of the parties. l The City Manager recommends approval. Resolution Endorsing a Transportation Alternatives Program (TAP) Project for the Washington Avenue Streetscape and Pedestrian Improvements ACTION: A REQUEST TO APPROVE A RESOLUTION ENDORSING THE CITY'S APPLICATION FOR A TRANSPORTATION ALTERNATIVES PROGRAM (TAP) PROJECT FOR THE WASHINGTON AVENUE STREETSCAPE AND PEDESTRIAN IMPROVEMENTS. BACKGROUND: l This Federal grant provides localities funding to improve pedestrian and bicycle facilities. l The City is applying for funding to improve the sidewalks, crosswalks, and lighting on Washington Avenue between 30th Street and 34th Street. l The first phase of the Washington Avenue improvements was completed in conjunction with the Apprentice School. FISCAL IMPACT: l The grant request is for $400,000 with a 20% City match of $100,000 for a total project cost of $500,000. l If the application is approved in June 2015, the City will potentially receive $400,000. l The City Manager recommends approval. WHEREAS, in accordance with the Commonwealth Transportation Board selection procedures, a local jurisdiction requesting that the Virginia Department of Transportation establish a Transportation Alternatives project in such jurisdiction must pass a resolution authorizing the same; and WHEREAS, the City of Newport News is seeking to develop a Transportation Alternatives project for the Washington Avenue Streetscape and Pedestrian Improvements in the City of Newport News. NOW, THEREFORE, BE IT RESOLVED, that the City of Newport News requests the Commonwealth Transportation Board to establish a Transportation Alternatives project for the Washington Avenue Streetscape and Pedestrian Improvements that is included as an implementation element of the City’s adopted comprehensive plan (Framework for the Future 2030). BE IT FURTHER RESOLVED, that the City of Newport News hereby agrees to provide a minimum 20 percent matching contribution for this project. BE IT FURTHER RESOLVED, that the City of Newport News hereby agrees to enter into a project administration agreement with the Virginia Department of Transportation and provide the necessary oversight to ensure the project is developed in accordance with all state and federal requirements for design, right of way acquisition, and construction of a federally funded transportation project. BE IT FURTHER RESOLVED, that the City of Newport News will be responsible for maintenance and operating costs of any facility constructed with Transportation Alternatives Program funds unless alternative arrangements are made with the Department of Transportation. BE IT FURTHER RESOLVED, that if the City of Newport News subsequently elects to cancel this project, it hereby agrees to reimburse the Virginia Department of Transportation for the total amount of costs expended by the said Department through the date the Department is notified of such cancellation. The City of Newport News also agrees to repay any funds previously expended by the Virginia Department of Transportation for the project, in the event the Federal Highway Administration later deems such project to be ineligible for funding. 2 H. BACKGROUND: l The City applied for and was awarded an $8,000 Troy- Bilt and Keep America Beautiful Taking Root Gardening Grant from the MTD Products Company. l The Department of Public Works will manage the grant which will fund the development of new outdoor classrooms and enhance existing outdoor spaces at Newport News Public Schools (NNPS). l In addition to the grant award, the City also received $1,500 in gardening tools to complete the green space project through its partnership with The Newport News Green Foundation, NNPS, and Christopher Newport University (CNU). Department of Development – FY 2014 Bond Authorization, Community Development Category: Southeast Community – $2,000,000 ACTION: A REQUEST TO APPROVE A RESOLUTION APPROPRIATING $2 MILLION FROM THE FY 2014 BOND AUTHORIZATION, COMMUNITY DEVELOPMENT CATEGORY FOR THE SOUTHEAST COMMUNITY REDEVELOPMENT INITIATIVES. BACKGROUND: l The first phases of Jefferson Avenue streetscape improvements are completed and Phase II is under design. l Numerous redevelopment activities have been undertaken and are arising to complement the investment already made. l In addition to ongoing initiatives, the commencement of the Brooks Crossing Project is imminent. l The strategy of maintaining fiscal readiness through our Capital Improvements Plan (CIP) will be vital to the continued revitalization of the Southeast Community. FISCAL IMPACT: l The FY 2014 Bond Authorization, Community Development Category has $2 million remaining to be appropriated for project investments in the Southeast Community. l The City Manager recommends approval.
