BACKGROUND: l The Warwick Boulevard over Lake Maury Bridge was built in 1931 and widened on both sides in 1960. l The superstructure is in poor condition, the substructure is in fair condition and the bridge is reaching the end of its useful life. l The new bridge will accommodate three lanes of traffic in each direction. l The bridge is surrounded by the property of the Mariners' Museum and several land acquisitions and easements are required for right-of-way, construction, drainage and utilities. l The Mariners' Museum has recommended pursuing a friendly condemnation to acquire the required properties. l The aggregate appraised value of the easements is $45,000. l Funding is available from previously appropriated project funds. l The City Manager recommends approval. BE IT ORDAINED by the Council of the City of Newport News, Virginia: 1. That Chapter 32, Police, of the Code of the City of Newport News, Virginia, Article II., Property in Custody of Police, Division 2., Unclaimed Property, be, and the same hereby is, amended and reordained by adding thereto a new section, namely: Section 32-27, Unclaimed bicycles, electric power-assisted bicycles, mopeds, and electric personal assistive mobility devices, as follows: CHAPTER 32 POLICE ARTICLE II. PROPERTY IN CUSTODY OF POLICE DIVISION 2. UNCLAIMED PROPERTY Sec. 32-27. Unclaimed bicycles, electric power-assisted bicycles, mopeds, and electric personal assistive mobility devices. (a) Notwithstanding the provisions of section 32-21 above, any bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or moped which has been in the possession of the police department, unclaimed, for more than thirty (30) days may be sold at public auction or donated to a charitable organization. The police department shall comply with the provisions of sections 32-22 and 32-23 prior to any such sale or donation. (b) If requested by the finder at the time of the delivery of the item to the police department, any bicycle, electric personal assistive mobility device, electric power-assisted bicycle, or moped found and delivered to the police department by a private person which thereafter remains unclaimed for more than thirty (30) days after the final date of publication required herein shall be given to the finder, provided the location and description of the bicycle or moped shall have been published at least once a week for two (2) successive weeks in a newspaper of general circulation in the city.  (c) For purposes of this section, a “charitable organization” means a charitable institution or association located within the city limits, or outside the city limits if such institution or association provides services to residents of the city; provided, however, that such institution or association shall not be controlled in whole or in part by any church or sectarian society. The words “sectarian society” shall not be construed to mean a nondenominational Young Men’s Christian Association, a nondenominational Young Women’s Christian Association, Habitat for Humanity, or the Salvation Army. 2. That this ordinance shall be in effect on and after the date of its adoption, November 12, 2014. 2 G. Other City Council Actions 1. BACKGROUND: l A final inspection has been made of the Bexley Park Subdivision. l The inspection indicates compliance with all requirements. l Once accepted, the streets which were constructed at the developer's expense will be eligible for State Maintenance reimbursements to the City. l The City Manager recommends approval. WHEREAS, WAVERTON ASSOCIATES, INC., a Virginia corporation, owner of a certain subdivision in the City of Newport News, as shown on a certain plat entitled, "Bexley Park", dated July 7, 2005, made by Coenen & Associates, Inc., Engineers, Surveyors and Planners, which was recorded on August 26, 2005, in the Clerk's Office of the Circuit Court for the City of Newport News, Virginia, in Deed Book 2056, Page 1481, has requested the City of Newport News to accept into the City System of Streets for public maintenance those certain streets named Bexley Park Way and Sparrow Court, and the physical improvements which were required and constructed pursuant to the various ordinances of the City of Newport News and which have been approved by the City for acceptance; and WHEREAS, the said streets and improvements have been constructed to City standards; and WHEREAS, a public need exists for the said streets and the physical improvements contained therein and thereon. Ordinance Renaming a Public Right-of-Way from Middle Ground Boulevard to City Center Boulevard ACTION: A REQUEST TO ADOPT AN ORDINANCE RENAMING A PUBLIC RIGHT-OF-WAY FROM MIDDLE GROUND BOULEVARD TO CITY CENTER BOULEVARD. BACKGROUND: l The new east-west extension of this major thoroughfare between Jefferson Avenue and Warwick Boulevard is on schedule to open near the end of this calendar year as City Center Boulevard. l A public informational meeting was held at the City Center Marriott Hotel on October 23, 2014 to brief area businesses on the programmed activities related to the street name change, including efforts by the City to minimize impacts to business operations. l This change will not affect building address numbers, only the street name. l The U. S. Postal Service has acknowledged they will deliver mail at the former address name of "Middle Ground Boulevard" for a period of twelve months beyond the effective date of the name change. l The effective date of the name change will be January 12, 2015 to allow for proper notifications to businesses, the U. S. Postal Service, and online mapping services. l The City Manager recommends approval. Resolution Authorizing the City Manager to Execute a Lease By and Between the Economic Development Authority (EDA) and the City for a New South Police Precinct Located in the Brooks Crossing Project ACTION: A REQUEST TO APPROVE AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE BY AND BETWEEN THE ECONOMIC DEVELOPMENT AUTHORITY OF THE CITY OF NEWPORT NEWS, VIRGINIA (EDA) AND THE CITY, FOR A NEW SOUTH POLICE PRECINCT LOCATED IN THE BROOKS CROSSING PROJECT. BACKGROUND: l The Developer of the Brooks crossing Project, southeast Commerce Center Associates, L.L.C. (SECCA) will soon acquire an approximately 19,200- square-foot police precinct building, associated surface parking and greenspace. l Upon the Developer's completion of the building and the site improvements, the EDA will acquire the site and facility for an estimated $6.6 million for lease to the City to serve as the City's south Police Precinct (SPP). FISCAL IMPACT: l The City's lease of the SPP from the EDA is structured for an initial term of ten years, with two five-year renewal options, at an annual lease rate of $1.00. l Under the lease, the City will be responsible for full operation of the SPP including maintenance, repair, utilities and insurance. l The lease structure includes an option at the end of the initial term and each renewal term for the City to request that the EDA transfer ownership of the SPP to the City. l The City Manager recommends approval. The term of the lease shall be for a period of ten (10) years, with two five (5) year renewal options. B. The leased premises shall consist of a two-story, approximately 19,200 square foot building and the approximately 3 acre site on which it is built. C. Rent shall be at a rate of $1.00 per year. D. The City shall be responsible for utilities, maintenance, and repairs to the leased premises during the term of the lease. E. The City shall have the right to request that the Economic Development Authority of the City of Newport News transfer title of the premises to the City at the end of the initial term and any renewal term(s). 2. That the City Attorney shall review and approve all documents prior to their execution. 3. This resolution shall be in effect on and after the date of its adoption, November 12, 2014. H. Department of Homeland Security to purchase and install four surveillance cameras along the shoreline to enhance port security and to install an electronic navigation system on two of the department's boats. FISCAL IMPACT: l The grant will provide $51,975 in federal funds to purchase the equipment. l A local grant match of 25% ($17,325) is required. l The total grant (federal and local grant match) is for $69,300. l The City Manager recommends approval. FISCAL IMPACT: l In addition to the $80,217 in State and Federal grant funds, this transaction includes Community Support (local funds) in the amount of $78,000. l The City Manager recommends approval. BACKGROUND: l A flooding problem exists behind several properties along 28th Street from Oak Avenue to Short Street. l The flooding issues on Short Street, Parrish Avenue, and 28th Street will be corrected by installing a new storm sewer system, which will discharge into Salter's Creek. l A permit from the U. S. Army Corps of Engineer's was required and has been approved for this project. l The City Manager recommends approval. BACKGROUND: l Infrastructure mapping and modeling is an annual stormwatwer initiative to evaluate the drainage systems throughout the City. l This program provides City staff the ability to assess the City's drainage system infrastructure and how it functions relative to current design standards. l Actual structure location, condition, and assessment are captured for asset management and for modeling the drainage systems to identify flooding and capacity issues. l The City will benefit from the program by being able to more accurately determine where flooding and drainage problems occur and correlate that information to general complaints to determine how best to utilize funding for improvement, rehabilitation, and restoration projects within the City. l The City Manager recommends approval. BACKGROUND: l The Developer of the Brooks Crossing Project, Southeast Commerce Center Associates, L.L.C. (SECCA) will soon acquire an approxiamtely 3-acre site and develop a 2- story, approximately 19,200-square-foot police precinct building, associated surface parking and greenspace. l Upon the Developer's completion of the building and site improvements, the EDA will acquire the site and facility for an estimated $6.6 million for lease to the City to serve as the City's South Police Precinct. l The $6.6 million is to be funded from the FY 2015 Bond Authorization approved by Council at its October 28, 2014 City Council meeting. l The City Manager recommends approval.
