BACKGROUND: At the November 22, 2016 meeting, City Council received one bid in response to a request to receive bids for a utility easement over City-owned property at 100 Yorktown Road, located in Lee Hall, Newport News, Virginia. The successful bidder was Dominion Virginia Power who had asked the City to formally grant a Deed of Easement over watershed property. Acquiring this easement will not impact City operations or access. The City Manager recommends approval. Any structure erected on real property or attached to another structure that supports broadcast or receiving equipment of any frequency or electromagnetic wave, or any system of wires, poles, rods, reflecting discs or similar devices used for transmission or reception of electromagnetic waves. Television antennas for home reception, satellite dishes one (1) meter or less in diameter, and amateur radio tower/antenna(s) shall not be deemed communication towers/antennas under this definition. The term communication tower/antenna shall not include any structure located in a public right-of-way less than fifty (50) feet in height, measured from the top of the closest adjacent curb or edge of pavement where no curb exists. 2. ACTION: A REQUEST TO ADOPT AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE ONE (1) LEASE AND THREE (3) LICENSE AGREEMENTS TO THE HAMPTON ROADS COMMUNITY ACTION PROGRAM, INC. (HRCAP) FOR CONTINUED USE OF SPACE IN FOUR (4) CITY-OWNED BUILDINGS LOCATED AT 392 MAPLE AVENUE, 2410 WICKHAM AVENUE, 328 30TH STREET AND 14302 OLD COURTHOUSE WAY. BACKGROUND: The current lease agreements for this usage were established in 2012 and are due to expire at the end of 2016. HRCAP has requested that the City consider renewing these agreements. The agreements are for a five year period, with an initial period of one year and four additional one year extensions at the sole discretion of the City. The agreements stipulate that HRCAP pay for utilities based on the percentage of space they occupy. The agreements can be canceled by either the City or HRCAP with 90 days advance notice. BACKGROUND: Youth Challenge, Inc. has applied for Real Estate Tax Exempt status for four properties owned by the corporation. Following the City Council policy for such applications, the City Attorney has reviewed the application for compliance. Two of the four properties owned by Youth Challenge, Inc. are eligible for consideration by City Council for tax exempt status. The two eligible properties are located at 323 34th Street and 3305 Warwick Boulevard. Upon City Council approval, the tax exempt status would be effective July 1, 2017. FISCAL IMPACT: Under the current properties assessed value and at the current Real Estate Tax rate, the City would forego an annual Real Estate Tax collection from these two properties of $9,218.32 permanently. WHEREAS, the Virginia Constitution Article X § 6(a)(6) permits a locality to exempt from taxation property used by its owner for religious, charitable, patriotic, historical, benevolent, cultural, or public park and playground purposes as may be provided by classification or designation by an ordinance adopted by the local governing body and subject to such restrictions as provided by general law; and WHEREAS, pursuant to the aforementioned section of the Virginia Constitution, the Newport News City Council did in fact adopt City Code §§ 40-8 & 40-8.01, which permit tax exemption by the designation of City Council, and specify certain factors that must be considered when determining whether or not to grant an application for tax exemption by designation; and WHEREAS, the City Council has considered the application for tax exemption filed by Youth Challenge of Hampton Roads, Inc. for properties located at 332 34th Street and 3305 Warwick Boulevard, and the City Council has considered the factors specified in City Code §§ 40-8 & 40- 8.01, and does find that the application filed by Youth Challenge of Hampton Roads, Inc. for tax exemption for the aforesaid properties should be granted; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Newport News, Virginia: That Chapter 40, Taxation, of the Code of the City of Newport News, Virginia, Article I., General Provisions and Exemptions, Division 3., Property Exempted by Designation, be, and the same hereby is, amended and reordained, by adding thereto a new section, namely: Section 40-8.12, Property of Youth Challenge of Hampton Roads, Inc., as follows: CHAPTER 40 TAXATION ARTICLE I. BACKGROUND: The City is in the process of completing an application to submit to HHS regarding surplus federal property known as the USMC Reserve parcel and located at 7401 Warwick Boulevard. The City is interested in utilizing the property to facilitate a Day Service Center for the homeless population. The application requires that the governing body of the applicant complete a resolution authorizing a representative to act on behalf of the applicant organization. FISCAL IMPACT: N/A ATTACHMENTS: Description CM Memo re Application for Federal Property for Day Center sdm15026 Authorizing CM to Make App to US Dept of Health and Human Svcs (7401 Warwick Blvd) sdm15026 RESOLUTION NO. _______________ A RESOLUTION OF THE COUNCIL OF THE CITY OF NEWPORT NEWS, VIRGINIA, AUTHORIZING THE CITY MANAGER TO MAKE AN APPLICATION TO THE UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES REGARDING THE OPERATION OF A DAY SERVICE CENTER FOR THE HOMELESS AT FEDERAL PROPERTY LOCATED AT 7401 WARWICK BOULEVARD WHEREAS, certain real property owned by the United States, located in the City of Newport News, State of Virginia, has been declared surplus and is subject to assignment for homeless purposes by the Secretary of Health and Human Services under the provisions of Section 203(k)(1) of the Federal Property and Administrative Services Act of 1949, as amended, and Title V of the McKinney-Vento Homeless Assistance Act, as amended; and the rules and regulations promulgated pursuant thereto, more particular described as follows: Marine Corps Reserve Training Facility Federal Property Number 77201510001 7401 Warwick Boulevard, Newport News, Virginia 23607 WHEREAS, the City of Newport News, Virginia needs and can utilize said property for homeless purposes in accordance with the requirements of said Acts and the rules and regulations promulgated pursuant thereto, of which this Council is fully informed, including commitments regarding use and time within which such use shall commence. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Newport News, Virginia: 1. That the City of Newport News, Virginia has legal authority, is willing, and is in a position financially and otherwise to assume immediate care and maintenance of the property, and that James M. Bourey, City Manager, is hereby authorized, for and on behalf of the City of Newport News, Virginia, to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution, including the preparing, making, and filing of plans, applications, reports, and other documents; the execution, acceptance, delivery, and recordation of agreements, leases and other instruments pertaining to the transfer of said property; and payment of any and all sums necessary on account of the purchase price thereof, including fees or costs incurred in connection with the transfer of said property for surveys, title searches, appraisals, recordation of instruments, or escrow costs, together with any payments by virtue of nonuse or deferral of use of the property. 2. If the City of Newport News, Virginia is unable to place the property into use within 12 months after the date of the lease, or 36 months where construction or major renovation is contemplated, it is understood that the City of Newport News, Virginia will rescind the lease.  3. If the Department of Health and Human Services approves the application, this Council will cause a copy of the application and standard lease to be filed with its permanent minutes. 4.
