AND JOAN MINARIK FOR THEIR SERVICE AND CONTRIBUTIONS TO THE CITY OF NEWPORT NEWS BACKGROUND: Joan Minarik, a retired Register Nurse is a committed and actively engaged citizen, who has served, and continues to serve on various committees and organizations within the City. In 2012 and 2013, Mrs. Minarik was named the Most Outstanding Community Emergency Response Team (CERT) Volunteer by the Virginia Department of Emergency Management. Michael R. Minarik, Jr., is a veteran of the U.S. Navy, a former Honeywell employee, and after moving to Virginia, performed computer programming for schools. Mr. Minarik has also served on various committees and organizations within the City and currently serves as a member of the Board of Directors of the Lee Hall Train Station Foundation, Inc. Both Michael and Joan are very active, civic-minded citizens and consistently attend regular City Council meetings and the North District Town Hall meetings. It is with heartfelt appreciation that Michael R. Minarik, Jr. and Joan Minarik are recognized for their service and contributions to the City of Newport News. Minarik, Jr. and Joan Minarik for their service and contributions to the City of Newport News; and WHEREAS, Joan Minarik served on the Newport News Efficiency Task Force on City Government in 2010 and is currently serving on the City’s Human Services Advisory Board and Commemoration Advisory Committee as a General Public Representative from the North District; and WHEREAS, in 2011, Joan Minarik, a retired Registered Nurse, joined the Newport News Community Emergency Response Team (NN CERT) and has been a very active member freely giving of her time and talents. Resolution to Comply with the Budget Public Hearing Notice Provisions of the Code of Virginia, Chapter 25; Title 15.2, as Amended, Entitled Budgets, Audits and Reports ACTION: A REQUEST TO APPROVE A RESOLUTION THAT ALLOWS THE CITY TO COMPLY WITH THE STATE CODE ON SETTING A SEVEN (7) DAY PUBLIC HEARING NOTICE FOR THE FY 2018 PROPOSED OPERATING BUDGET. BACKGROUND: The City Charter in Section 6.09 requires that the proposed budget public hearing notice be advertised fifteen (15) days prior to the hearing date. The State Code in Section 15.2-2506 requires that the proposed budget public hearing notice be advertised seven (7) days prior to the hearing date. The Acting City Manager plans on submitting the FY 2018 Recommended Budget on March 28, 2017 at the City Council work session. The tentative Public Hearing dates for the FY 2018 Recommended Budget are April 11, 2017 and April 13, 2017. There are insufficient number of days between the proposed budget submission date of March 28, 2017 and the public hearing date of April 11, 2017 to advertise the public hearing, as required by the City Charter. In order to avoid the necessity of holding a special meeting of City Council, this Resolution allows for the City to comply with the State Code. The Acting City Manager recommends approval. Ordinance Amending Chapter 41, Vehicles for Hire, Article III., Taxicabs, Division 8., Taxicab Operating Regulations, Section 41-131, Adequate and efficient service required, and Section 41-142, Driver’s Manifest ACTION: A REQUEST TO ADOPT AN ORDINANCE AMENDING CITY CODE, CHAPTER 41, VEHICLES FOR HIRE; ARTICLE III., TAXICABS; DIVISION 8., TAXICAB OPERATING REGULATIONS; SECTION 41-131(c), ADEQUATE AND EFFICIENT SERVICE REQUIRED; AND SECTION 41-142, DRIVER'S MANIFEST. BACKGROUND: Chapter 41, Vehicles for Hire, outlines requirements for taxicabs operating in the City of Newport News. The change recommended for Section 41-131, Adequate and efficient service required, is to change the time period allowing taxicabs to be out of service before notifying the Chief of Police from 48 or more consecutive hours to ten days. The change recommended for Section 41-142, Driver’s Manifest, is to allow electronic creation and storage of the manifest. The Acting City Manager recommends approval. BE IT ORDAINED by the Council of the City of Newport News, Virginia: 1. That Chapter 41, Vehicles for Hire, of the Code of the City of Newport News, Virginia, Article III., Taxicabs, Division 8., Taxicab Operating Regulations, Section 41-131, Adequate and efficient service required, and Section 41-142, Driver’s manifest, be, and the same hereby is, amended and reordained as follows: CHAPTER 41 VEHICLES FOR HIRE ARTICLE III. TAXICABS DIVISION 8. TAXICAB OPERATING REGULATIONS Sec. 41-131. Adequate and efficient service required. (a) All taxicab companies shall provide adequate and efficient service throughout the city at all times by: (1) Providing radio, mobile telephone or other electronic dispatch service; (2) Maintaining a business office and business records within the city; and (3) Providing twenty-four-hour service. (b) For purposes of this section, a taxicab company includes an association of certificate holders operating taxicabs under the same trade name. (c) No taxicab for which a certificate has been issued shall be out of service for a period of ten (10) forty-eight (48) or more consecutive hours days unless authorized by the chief of police for good cause shown prior to being out of service. Sec. 41-142. Driver's manifest. (a) A vehicle manifest shall be maintained by the certificate holder and taxicab driver in and for each vehicle used as a taxicab in the city. The certificate holder shall furnish the driver with a driver's manifest on in a format approved by the chief of police, which form shall have spaces provided for a record of the following: (1) Certificate holder's full name and business trade name, business telephone number, and Newport News business address. (2) Taxicab driver's full name and taxicab driver's permit number. (3) Date and time taxicab driver begins duty and ends duty. (4) Taxicab vehicle number. (5) Odometer reading at beginning of duty and ending of duty. (6) Starting point of the trip (address or place), finishing point of the trip (address or place) and time of each trip. (7) Number of passengers for each trip. (8) Taximeter rates for each trip. (9) Additional fees and total amount charged to passengers, including tolls. (b) A manifest shall be in the possession of and maintained by the taxicab driver in the taxicab at all times during the operation of the taxicab, and a separate manifest shall be kept for each day of operation of the vehicle, provided that a driver operating a taxicab at 12:00 midnight may continue to use the manifest bearing the date the work period commenced through the end of such work period. The manifest shall be delivered to the certificate holder within twenty-four (24) hours of the termination of each driver's assignment. (c) Each taxicab driver shall maintain the manifest in a clear, neat and readable condition. (d) At the beginning of each trip, the taxicab driver shall record on the manifest the time of beginning the trip and the place where the passenger is picked up. At the end of the trip, the driver shall record the total trip meter rate, time of ending and place where the passenger was discharged. The fare collected for each trip shall be recorded immediately after collection. (e) For the purpose of this section, the word "trip" shall mean the entire time and distance that one (1) person, or more than one (1) person, as provided for in section 41-53 of this article, has engaged the service of a taxicab beginning with the actual service until such time as service has been terminated and the fare has been paid. (f) Manifests and any other record required by this article shall be available for inspection, either in the taxicab while it is in operation, or at the certificate holder's place of business in the city, by any law enforcement officer. All such manifests and records shall be preserved for at least twelve (12) months; however, a manifest may be required to be preserved for a longer period as the chief of police shall require upon written notice to the certificate holder. 2  (g) It shall be unlawful for a driver or certificate holder to refuse or fail to immediately make the driver's current manifest available for inspection upon request by a law enforcement officer. (h) Manifests required by this article shall not include records of non-emergency medicaid transportation provided under the authority of the Virginia Department of Medical Assistance Services, or paratransit services provided under the authority of the Transportation District Commission of Hampton Roads. Any logs required for those trips shall be kept separately from the manifest required herein. (i) A manifest required by this article may be maintained in a written or electronic format, so long as the manifest meets all of the requirements of this article. 2. That this ordinance shall be in effect on and after the date of its adoption, March 14, 2017. 3 H. BACKGROUND: The Criminal Justice Training Academy Fees were established to allow the Clerks of Courts to assess and collect a fee of five dollars ($5.00) in every case in which costs are assessable. All funds collected are to be used to support the Police Department’s Criminal Justice Training Academy, which includes sending employees to specialized training and purchasing equipment. FISCAL IMPACT: The current balance in the Criminal Justice Training Academy fees account is $227,417. This appropriation will reduce the Criminal Justice Training Academy fees account by $175,000. The Department relies on funding from the City's CIP to undertake many of the repairs, replacements and refurbishments needed to keep these assets safe, accessible, appealing and serviceable. This funding is currently needed to undertake several projects in Newport News Park, King-Lincoln Park, Anderson Park, Brittingham-Midtown Aquatic Center, and the Huntington Park Tennis Center.
