CITY COUNCIL OVERSIGHT COMMITTEE MINUTES January 18, 2018 The City Council Oversight Committee of the City of Norman, Cleveland County, State of Oklahoma, met at 8:37 a.m.in the City Council Executive Conference Room on the 18th day of January, 2018, and notice and agenda of the meeting were posted in the Municipal Building at 201 West Gray 48 hours prior to the beginning of the meeting. PRESENT: Councilmember Holman and Chairman Allison ABSENT: Councilmembers Castleberry and Karjala OTHER STAFF PRESENT: Mayor Miller Mr. Terry Floyd, Development Coordinator Ms. Brenda Hall, City Clerk Ms. Regina Oliphant, Administrative Tech III Ms. Katherine Walker, Assistant City Attorney Ms. Aley Crestilli, Achieve a Healthy Living Program Representative Item 1, being: DISCUSSION REGARDING A REQUEST FROM THE PUBLIC ART BOARD TO CONSIDER AMENDMENTS TO THE ART IN PUBLIC PLACES ORDINANCE. Ms. Brenda Hall, City Clerk, said a request has been received from the Public Art Board to consider changes to the ordinance regarding board membership. The Board has stated the current membership outlined in the Ordinance no longer reflects what is actually taking place in the community. Currently, they have two members that are appointed by the Norman Gallery Association; however, the Norman Gallery Association is no longer a working association. She said the Board discussed changing those two appointees by increasing the Norman Arts Roundtable with an additional appointee and giving the Norman Arts Council Board one appointee. She said the Board also requested adding the NORMAN FORWARD Project Manager or his/her designee to serve as an ex-officio member but the Oversight Committee may want to discuss that more because NORMAN FORWARD is an ad hoc committee. Mayor Miller said this reads “Project Manager,” and ADG could be considered as project manager. Ms Hall said it could be Mr. Jud Foster; Director of Parks and Recreation, or Mr. Terry Floyd, Development Coordinator, as well, but codifying something that is temporary may not be a good idea. She said they currently have Ms. Debbie Williams who works with the Arts Council, and actually the designated person assigned to working with the Arts in Public Places program through the NORMAN FORWARD projects. The City of Norman has contracted with them to oversee the process for NORMAN FORWARD and Ms. Williams attends all of those meetings. Mayor Miller asked if Ms. Hall was interpreting this to be Ms. Williams’ position. Chairman Allison said he had communicated with Mr. Mike Tower, Chairman of the Public Arts Board, and Ms. Erinn Gavaghan, Executive Director, Norman Arts Council (NAC), and this was their original intention; however, they did not write it up as such but they internally call that position the “Project Manager.” He said some of the confusion comes from what they call the “project manager” and what the City refers to as “project manager” being separate positions. Chairman Allison said he did not discuss his concerns with the process regarding adopting an ordinance for a temporary position in relation to the ad hoc committee with Ms. Gavaghan but had discussed it with Ms. Hall. He said traditionally ad hoc and non- voting positions would not be necessary. Ms. Hall said the PAB board can request the person from the Arts Council attend their meetings, which is absolutely appropriate. City Council Oversight Committee Minutes January 18, 2018 Page 2 Councilmember Holman asked if any other group on the Board has more than one member. Ms. Hall said the Mayor and the Council appoints three members, the Gallery Association had two appointee positions, and everyone else has one position. Councilmember Holman asked for clarification that other than Council there is only one other group that has two. Ms. Hall said yes, and instead of it being the Gallery Association it would now be the Norman Arts Roundtable. Councilmember Holman asked if they approve of having the two positions. Ms. Hall said yes, once the Public Arts Board (PAB) made their recommendation, as a subcommittee of the NAC, their proposed recommendation was forwarded to the NAC, who approved and voted to move it forward; therefore, they are both recommending those revisions. Chairman Allison said the Arts Council Roundtable Advisory Group includes the executive directors or directors of all the different art organizations, and is the advisory group who selects all the grant recipients. They are not the governing body of NAC but are the advisors due to their involvement surrounding the art community and organizations. Mayor Miller said they are considered the art experts. Chairman Allison said yes, and Ms. Gavaghan and Mr. Tower are very supportive of the revision, as well as, Mr. Ron Collett, President, Norman Arts Council Board of Directors. Chairman Allison said it appears staff has everything the Oversight Committee needs to move forward with the proposed changes to the ordinance. Ms. Hall said yes, this revision will move forward to a City Council Study Session or City Council Conference. Mayor Miller asked Ms. Aley Crestilli if she would like to speak to the Committee about something. Ms. Crestilli said they had discussed her coming to the Oversight Meeting to discuss an update to the tobacco ordinance sometime in the future to make all City property smoke-free. Councilmember Holman said he is not sure how he feels about it exactly, but he has been approached by several bar owners who voluntarily implement this program into their bars and would like to see it banned in all bars. Ms. Crestillli said there is a “Take Back the Night” program that does free marketing for bars to ban smoking. Chairman Allison said definitely the first step would be the City’s policy. Ms. Crestilli said they could even go big, i.e., vape free. Mayor Miller said the Council talked about the subject two to three years ago during the time she was the Oversight Chair and they got hung up on the Westwood Park and vaping issues. She said it is something Ms. Crestilli reached out to her about and asked if the Oversight Committee would consider putting on a future agenda. Chairman Allison said he thinks it is something they should definitely consider. Ms. Hall said they will work this into the schedule of subjects. Items submitted for the record 1.
