CITY OF NORTH MYRTLE BEACH 1018 Second Avenue South BOARD OF ZONING APPEALS May 10, 2018 MINUTES Dan Moore- Absent Linda Braswell Robert Terrell Cynthia Lover William McGonigal- Absent Zoning Administrator Paul Blust Assistant Zoning Administrator Ben Caldwell Secretary Merideth Smith City Attorney Chris Noury CALL TO ORDER: Mr. Terrell Called the Meeting to order. MINUTES – The motion to approve the minutes of the April 12, 2018 meeting was made by Ms. Braswell and seconded by Ms. Lover. Motion passed 3-0. COMMUNICATIONS: Mr. Blust stated that he had a call from Lennar who asked for postponement until June agenda. A. VARIANCE #V11-18: LENNAR COASTAL CAROLINAS, LLC has made application for a variance to clear-cut properties prior to obtaining building permits for development of the property in the Phase II section of Seabrook Plantation abutting Lake Egret Drive. Asked to be Postponed B. VARIANCE #V12-18: Mr. Reggie Klossner has made application for a variance of 2.5 feet from the required 5-foot side and rear yard setback for an accessory storage shed at 1117 Forest Drive. No one in attendance. Postponed NEW BUSINESS: The Secretary swore in those to speak. B.VARIANCE #V13-18: Mr. Oron Earnhardt has made application for a variance to install a swimming pool in the front yard of a lot in the R-2 (Medium Density Residential) district at 1520 Holly Drive. Asked to be postponed until June. C. VARIANCE #V14-18: Mr. Elliot Liebman has made application for a variance to remove a tree in excess of the 24-inch caliper measurement that is protected by the ordinance at 923 Tidewater Drive. Mr. Liebman stated that the tree has limbs that overhang the garage and is close to the house. He is concerned that the root system will damage the foundation. A tree company stated that the tree is dying. He does have many trees in the backyard. STAFF REPORT: Ben Caldwell presented the report for the staff. He stated that the tree is 35” in diameter. The replacement would be 17 ½ inches. The Board discussed the need to remove the tree. Ms. Braswell made the motion to grant the variance. There was no second and the motion died. Ms. Lover made the motion to deny the variance because she did not think that there was a hardship. Mr. Terrell seconded the motion to deny. The motion passed 3-0. C. VARIANCE #V16-18: Mr. Jon Bundy has made application for a variance to Install a swimming pool in front of a house in the R-2 (Medium Density Residential) district where swimming pools are only permitted in the rear yard at 502 16th Avenue South. Mr. Peter Needham with Backyard creations stated that the house is being renovated. It is an old structure and sits 81’ from the road. There is no backyard. The owner stated that in the future they might build a house closer to the road that would then make this pool in the back yard. STAFF REPORT: Mr. Caldwell presented for the staff. Motion: After much discussion by the Board with the applicant, Mr. Terrell called for a motion. Ms. Lover made the motion to deny because there is no hardship on the land. Ms. Braswell seconded the motion. The motion to deny passed 3-0. D. VARIANCE #V17-18: Mr. Jeff Duggins has made application for a variance to remove a tree in excess of the 24-inch caliper measurement that is protected by the ordinance at 403 46th Avenue South. Mr. Duggans stated that the tree in question has damaged the slab of their house. He agreed to replant 13” of trees. 2 STAFF REPORT: Mr. Caldwell presented the report for the staff. MOTION: Ms. Braswell made the motion to grant the variance and require 13” of replacement of hardwoods. Mr. Terrell seconded the motion. The motion passed 3-0. F. APPEAL #D1-18: Mr. Al Shotwell has filed an appeal of the decision of the Zoning Administrator that a second detached living unit on a single property is a violation of the Zoning Ordinance allowing one living unit on the property. (Postponed) G. VARIANCE #V19-18: Mr. Michael Toole has made application for a variance to exceed the impervious surface ratio limitation on a property by 6% above the allowed 50% coverage in the R-2 (Medium Density Residential) district at 829 Arbor Lane. (Asked to be postponed) H. VARIANCE #V20-18: Brighton Construction has made application for a variance of 27 inches from the required 25 feet front yard setback in the R-2 (Medium Density Residential) district at 860 Cardinal Circle.(Asked to be Postponed) The meeting adjourned at 5:54 p.m. Respectfully submitted, Merideth Smith, Secretary 3
