CALL TO ORDER: Mr. Terrell called the meeting to order.
MINUTES – The minutes of the August 9 and June 14 meetings were approved.

NEW BUSINESS:
The Secretary swore in those to speak.
B. VARIANCE #V26-18: Mr. Gunning Berry has made application for a variance to install a
swimming pool in the side yard of a property in the R-1 (Single-Family Residential) district
where the district only permits swimming pools in the rear yard at 303 Oak Lake Circle.
Mr. Berry stated that the house is partially completed foundation poured, the framing done. The
plans were approved by the city in March.
The Board questioned the applicant concerning the approval by the City of the pool deck on the
side.
After discussion it was determined the City approved the plans and there was no way to move the
pool to another area of the property at this point.
Mr. Terrell called for a motion.
Ms. Lover made the motion to approve the variance based on the hardship created by the city and
that it will not be visible from the street.
Ms. Braswell seconded the motion. The motion to approve passed 4-0.
C. VARIANCE #V27-18: Mr. Bill Seay has made application for a variance of 5 feet from the
required 5-foot side yard setback in the R-1 (Single-Family Residential) district to place pool
equipment adjacent to the HVAC unit at 317 57th Avenue North.
Mr. Seay is a pool contractor and stated that an application to change the code to allow the pumps
in the side yards has been submitted to the City. There are certain locations that do not have
another area. The new systems are very quiet.
The Board discussed the issue but was uncomfortable about making a decision until the ordinance
change has been discussed. Ms. Braswell made the motion to table this until the City can look at
this issue. Ms. Lover seconded the motion. Motion to table passed 4-0.
D. VARIANCE #V28-18: Ms. Lesley Clark has made application for a variance to remove a
tree in excess of the 24-inch caliper measurement that is protected by the ordinance at 2107
Hillside Drive South.
Ms. Clark stated that the tree posed a threat to her house and it interfered with the power lines on
the street.
Mr. Terrell called for a motion.
After discussion by the board concerning the condition of the tree Ms. Lover made a motion to
deny the request because there is no apparent hardship. It was recommended that she could trim
the tree rather than cut it.
Ms. Braswell seconded the motion. Motion passed 4-0
E. VARIANCE #V29-18: Prestige Custom Homes has made application for a variance of 3 feet
from the required 22-foot front yard setback and 1.5 feet front the required side yard setback of
10 feet for a set of stairs in the R-1 (Single-Family Residential) district at 1716 25th Avenue
North. (Tabled)
F. VARIANCE #V30-18: Mr. Robert Hensley has made application for a variance of 3 feet
from the required 5-foot side yard setback for a storage building at 2607 Walnut Street.
Mike Carswell son in law of Mr. Hensley stated that his father in law wanted to acquire a golf
cart for him and his wife to get around the neighborhood. He has an existing shed and wants to
build a lean to to protect the golf cart.
Many options were discussed but there was no other area available to construct the shelter.
Mr. Terrell called for the motion.
Ms. Lover made the motion to deny the variance due to no hardship on the property.
Ms. Braswell seconded the motion. The motion passed 4-0.
G. VARIANCE #V31-18: Mr. Larry Allen has made application for two variances; one is a
variance of 6.5 feet from the required 7.5-foot front yard setback and the other is a variance of 6
inches from the required 10-foot side yard setback in a zero lot line, single-family subdivision at
117 Live Oak Court.
