CITY OF NORTH MYRTLE BEACH BOARD OF ZONING APPEALS 1018 Second Avenue South June 13, 2019 5:00 p.m. 1. CALL TO ORDER AND ROLL CALL Dan Moore, Chairman Cynthia Lover Roger Quinn- Absent Ricky Martin Trey Skidmore Linda Braswell Bill McGonigal 2. MINUTES – May 9, 2019 approved as presented 3. COMMUNICATIONS: Mr. Blust stated that new officers need to be elected at the next meeting. DISCUSSION: A. A request to rehear Variance #V15-19 at 1304 Kings Street that was denied at the April 11, 2019 Meeting . Motion to rehear on July 11, 2019 granted. Motion made by Ms. Braswell and seconded by Mr. McGonigal. Motion passed 6-0. NEW BUSINESS: A. SWEAR IN THOSE PERSONS TO SPEAK. B. VARIANCE #V18-19: Mr. Jorge Alvorez has made application for a variance to reduce the required 7.5 foot side yard setback to zero and reduce the required 10 foot rear yard setback to zero for a storage building larger than 150 square feet and a variance to permit a storage building larger than the maximum 180 square feet allowed by the ordinance at 4500 Heron Street. STAFF REPORT: Mr. Blust presented the report for the staff. He stated that the building was an old building but the addition now puts it in the setbacks. The addition was not permitted. The building cannot be moved closer to the house. DECISION: The Board discussed all possible ways that this problem could be remedied. Mr. Martin made the motion that Mr. Alvorez remove the addition that is in violation and renew the build to 180 sf. Have it inspected. Ms. Lover seconded the motion. The motion passed 6-0. C. VARIANCE #V19-19: Ms. Cassandra Cornell has made application for a variance to allow an accessory storage building in the front yard that is larger than the 180 square feet permitted by the ordinance and greater than the 15-foot maximum height for an accessory building in the R-1 (Single- Family Residential) district at 1000 27th Avenue South. STAFF REPORT: Mr. Blust presented the report for the staff. DECISION: The Board made the motion to table this item until more information. Motion by Mr. McGonigal and second by Ms. Lover. Motion to table passed 6-0. D. VARIANCE #V20-19: Mr. David Philips has made application for a variance of 4 feet from the required 20-foot front yard setback in the R-3 (Mobile Home Residential) district at 2411 Douglas Street. STAFF REPORT: Mr. Blust presented the report for the staff. He stated that this is a lot that is considered to be double front DECISION: E. VARIANCE #V23-19: Mr. Joseph Blake has made application for a variance of 15 feet from the required 20-foot rear yard setback for a townhouse project in the R-2 (Medium Density Residential) district at 803 11th Avenue South, Unit J. STAFF REPORT: Mr. Blust presented the report for the staff. DECISION: Mr. Martin made the motion to deny this variance because there is no hardship shown and the property is not unique to the surrounding properties. Ms. Lover seconded the motion. The motion passed 6-0. F. VARIANCE #V24-19: RIOZ BRAZILIAN STEAKHOUSE has made application for a variance to permit 52 square feet of signage more than the 150 square feet allowed and permit the business name to be on the building more than one time in the HC (Highway Commercial) district at 1315 Highway 17 North. STAFF REPORT: Mr. Blust presented the report for the staff. DECISION: Mr. McGonigal made the motion to grant the variance due to the conditions of the highway. This is a divided road Southbound and is hard to see until you reach the building. The motion was seconded by Mr. Skidmore. Motion passed 6-0. G. SPECIAL EXCEPTION #SE4-19: Cottages on the Marsh Subdivision has made application for a special exception to develop an amenity center in a new subdivision in the R-2B (Medium-Low Density Residential) district at Cottages on the Marsh Subdivision near the intersection of Seaside Drive and Ye Olde Kings Highway. STAFF REPORT: Mr. Blust presented the report for the staff. DECISION: The Board discussed the guidelines for a special exception and agreed that this meets the standards. The motion to grant the Special Exception was made by Ms. Braswell and seconded by Mr. Martin. The motion passed 6-0. H. VARIANCE #V25-19: Cottages on the Marsh Subdivision has made application of one foot from the required 5-foot side yard setback in the R-2B (Medium Low Density Residential) district at Cottages on the Marsh Subdivision near the intersection of Seaside Drive and Ye Olde Kings Highway. DECISION: Withdrawn I. VARIANCE 26-19; Ms. Teresa Freeman has made application for a variance of 4.6 feet from the required front yard setback in the R-2 (Medium Density Residential )district at 501 26th Avenue South. STAFF REPORT: Mr. Blust presented the report for the staff. DECISION: After much discussion by the Board and the representatives for the applicant the Board decided that they would like to wait on the applicant to be present. The motion to table was made by Ms. Lover and seconded by Mr. Martin. The motion passed 6-0. J. VARIANCE V26-19: Ms. Deborah Melton has made application for a variance to remove a tree in excess of the 24 inch caliper measurement that is protected by the ordinance at 2429 Ridge Street. STAFF REPORT: Mr. Blust presented the report for the staff. Ms. Melton stated that this is due to health issues of her husband. They need to build a ramp and the tree is in the way. DECISION: Mr. McGonigal made the motion to approve the removal of the tree and to grant some compassionate help by reducing the trees to be replaced from 13’ to 6”.Ms. Lover seconded the motion. The motion passed 6-0. K. VARIANCE #28-19: Mr. Kenny Hyatt has made application for a variance of 15 feet from the required 25 foot front yard setback in the R-2( Medium Density Residential) district at the Reserve Subdivision being developed at 2003 Ye Olde Kings Highway. This lot is currently unnumbered and the only lot on the right side of a proposed street called Hyatt Road. STAFF REPORT: Mr. Blust presented the report for the staff. DECISION: The motion to grant the variance for this irregular shaped lot was made by Ms. Lover and seconded by Ms. Braswell. Motion passed 6-0.
