CITY OF NORTH MYRTLE BEACH BOARD OF ZONING APPEALS 1018 Second Avenue South July 11, 2019 5:00 p.m. CALL TO ORDER AND ROLL CALL: Mr. McGonigal presided as Vice Chair of the meeting. Dan Moore, Chairman Absent Cynthia Lover Roger Quinn Ricky Martin- Absent Trey Skidmore Linda Braswell- Absent Bill McGonigal MINUTES – June 13, 2019 were approved as presented. COMMUNICATIONS: Mr. Blust stated that there were several changes to the Agenda. 1. Variance V19-19 is withdrawn 2. Variance V26-19 is withdrawn 3. Variance 15-19 – postponed due to sickness 4. Variance 29-19- postponed for full Board 5.Variance 32-19 and 33-19 postponed 6. Variance 31-19- Withdrawn for advertising reasons. Old BUSINESS: A. VARIANCE #V19-19: Ms. Cassandra Cornell has made application for a variance to allow an accessory storage building in the front yard that is larger than the 180 square feet permitted by the ordinance and greater than the 15-foot maximum height for an accessory building in the R-1 (Single- Family Residential) district at 1000 27th Avenue South. STAFF REPORT: Withdrawn B, I. VARIANCE #V26-19; Ms. Teresa Freeman has made application for a variance of 4.6 feet from the required front yard setback in the R-2 (Medium Density Residential )district at 501 26th Avenue South. STAFF REPORT: Withdrawn NEW BUSINESS: A. SWEAR IN THOSE PERSONS TO SPEAK. The Secretary swore in those that had signed up to speak. B. VARIANCE #V15-19: Mr. John Howard has made application for a variance to remove a tree in excess of the 24-inch caliper measurement that is protected by the ordinance at 1304 King Street. The applicant was sick and asked to postpone. The motion to grant postponement was made by Ms. Lover and seconded by Mr. Quinn. Motion passed 4-0. C. VARIANCE #V29-19: Mr. Barry Green has made application for a variance of 8 feet from the required 10-foot side yard setback on a lot in a zero lot line, single-family residential project in the R-2 (Medium Density Residential) district at 607 B 28th Avenue South. The applicant asked to defer until the next meeting when a full Board is present. Motion by Ms. Lover to grant postponement. Seconded by Mr. Quinn. Motion passed 4-0. D. VARIANCE #V30-19: Mr. Steven Greene has made application for a variance to install a swimming pool in the front yard on a double fronting street in the R-1 (Single-Family Residential) district at 4506 Hedrick Street. The ordinance only permits swimming pools in the rear yard in R-1. By definition, no rear yard exists on this property. The applicant stated that they were requesting this variance due to their property having two front yards. They are requesting using Hedrick Street as back yard for the pool. Ms. Lover asked if the pool would fit in the back yard. Mr. Caldwell stated that it would. Ms. Lover asked if the Lewis street side would be designated as the front. Mr. Caldwell stated that it would. Ms. Lover made the motion to grant the variance due to the unusual circumstances of the property and to designate Lewis Street as the front of the house. Mr. Skidmore seconded the motion and the variance request passed 4-0. E. SPECIAL EXCEPTION #SE5-19: Mr. Scott Jackson has made application for a special exception to build an amenity center for a single-family project in the R-2 (Medium Density Residential) district at 501 9th Avenue South. This is unimproved property and there is no street address physically on the property. It is located on the south side of 9th Avenue South near the intersection of 9th Avenue South and South Hillside Drive. Mr. Hoelcher represented the applicant. The Board discussed their concern of the proximity of the pool to the existing neighbors. They asked if the developer could consider another are of the property and communicate with the existing property owners. After more discussion with the Board, Mr. Hoelcher asked to table the special exception until he could talk to the developer and the neighbors. The motion to grant the request to table was made by Mr. Quinn and seconded by Mr. Skidmore. The motion passed 4-0. F. VARIANCE #V31-19: Mr. Bob Pyle has made application for a variance of 113 feet from the required 200-foot setback from a residential district line for a dry storage boat facility in the HC (Highway Commercial) district at 2200 Little River Neck Road. Withdrawn to be advertised as a Special Exception. G. VARIANCE #32-19: Mr. Tim Duncan has made application for a variance of 2 feet 4 inches from the required 5-foot rear yard setback and one foot from the required 5-foot side yard setback for a swimming pool in the R-2A (Midrise Multifamily Residential) district at 206 54th Avenue North. H. VARIANCE #V33-19: Mr. Tim Duncan has made application for a variance of 2 feet 5 inches from the required 5-foot rear yard setback and 2 feet 4 inches from the required 5-foot side yard setback for a swimming pool in the R-2A (Midrise Multifamily Residential) district at 207 54th Avenue North. The applicant asked to postpone these variances until his attorney could be present for the presentation of the variance request. PUBLIC COMMENT: Mr. Steve Hildebrand stated that he and his wife had driven from Charlotte to attend this meeting and requested the Board not postpone the decision. They were granted permission to address this application and have their statement entered into the record. They are adjoining property owners. If the Variance is granted they would ask that an eight foot 8’ fence be required of the builder. The Vice Chairman called for a motion. The motion to allow postponement until the next meeting and to include the public comments was made by Ms. Lover. The motion was seconded by Mr. Skidmore. The motion passed 4-0.
