BOARD OF ZONING APPEALS

CALL TO ORDER AND ROLL CALL:
Mr. Moore called the meeting to order.
The City Clerk called the roll and declared a quorum present

MINUTES – July 11, 2019 were approved as presented. Motion Mr. Martin and seconded by
Ms. Lover. 6-0.
COMMUNICATIONS:
Mr. Blust stated that there Mr. John Howard had requested a continuance until he could be
present at the meeting. The Board agreed to postpone until the September meeting.
The Secretary swore in those that had signed up to speak.
OLD BUSINESS:
A. SPECIAL EXCEPTION #SE5-19: Mr. Scott Jackson has made application for a special exception to
build an amenity center for a single-family project in the R-2 (Medium Density Residential) district at 501
9th Avenue South. This is an unimproved property and there is no street address physically on the
property. It is located on the south side of 9th Avenue South near the intersection of 9th Avenue South and
South Hillside Drive.
Mr. Sean Hoelcher, DDC Engineering presented for the applicant. He presented a new proposal for the
project to move the proposed amenity center away from the existing neighbors. He stated that because
there are new rules for the fire lanes that they can be more flexible than previously submitted. They also
contacted by letter the adjoining neighbors and received no objection to the project. The pool house will
be further away from the houses and they will put up fencing.
PUBLIC: Mr. Rick Liepert a resident of Hillside commons asked for some information. Mr. Hoelcher
showed him the plans and he had no further questions.
BOARD DECISION:
The Chairman called for a motion. Ms. Lover made the motion to approve the variance request for a
special exemption as requested . The SE meets all the requirements for approval.
Mr. McGonigal seconded the motion. The motion to approve passed 6-0.
NEW BUSINESS:
B. VARIANCE #V15-19: Mr. John Howard has made application for a variance to remove a
tree in excess of the 24-inch caliper measurement that is protected by the ordinance at 1304 King
Street. ( Postponed until September)
Both Variance requests will be heard together but voted on separately for the record.
C. VARIANCE #32-19: Mr. Tim Duncan has made application for a variance of 2 feet 4 inches
from the required 5-foot rear yard setback and one foot from the required 5-foot side yard
setback for a swimming pool in the R-2A (Midrise Multifamily Residential) district at 206 54th
Avenue North.
D. VARIANCE #V33-19: Mr. Tim Duncan has made application for a variance of 2 feet 5
inches from the required 5-foot rear yard setback and 2 feet 4 inches from the required 5-foot
side yard setback for a swimming pool in the R-2A (Midrise Multifamily Residential) district at
207 54th Avenue North.
The Applicant was represented by his attorney Roger Roy. Mr. Roy stated that there were several
circumstances that brought them to this application. The properties in question are zoned
differently but were considered to be all one zoning for the permits. The City issued the permits
based on the wrong zoning. It was not discovered until the pools were in place. The property was
very hard to access and the pool had to be lifted and lowered by a crane due to the existing power
lines.
The pool variance needed is minimal. This was a human error. They plan to fence around the
area with a 6’ vinyl fence.
PUBLIC COMMENT:
Mrs. Melissa Hildebrand stated that she is the adjoining property owner. They have their house
on the market and have been told that the pool being so close is an issue. She asked for 8’
fencing instead of 6’.
Mr. Duncan spoke to the request. He stated that due to the fact that the adjoining property is at
least 2 feet higher, he is having to put in a retaining wall which will be at least 2 feet. They will
than put a 6’ fence on top of the wall.
The Board agreed to this concession.
The Chairman called for a motion. The motion to grant the Variance- 33-19 with the
requirement of the 8’ fencing due to the unusual circumstances of this variance was made by
Mr. McGonigal and seconded by Ms. Braswell. Motion passed 6-0.
The Motion to approve the variance for Variance -32-19 was made by Mr. McGonigal and
seconded by Mr. Skidmore. The motion passed 6-0.
SPECIAL EXCEPTION #SE6-19: Mr. Bob Pyle has made application for a special exception to
construct a dry storage boat facility on the dry land portion of Anchor Marina located at 2200 Little River
Neck Road.
Mr. Chad Hatley presented the request for the Special Exception. He provided a detailed report on the
different aspects of the request and explained the project.
There were a few questions by the Board concerning noise and the surrounding area but in general the
board felt it was a good project that would meet the criteria for a special exception.
There was no public comment and the Chairman called for a motion. The motion to grant the Special
Exception because it meets the requirements for approval was made by Ms. Lover with the additional
requirement that the large Oak Tree on the property be protected and saved.
The motion was seconded by Ms. Braswell. The motion passed 6-0.
Mr. Blust announced that they had received a resignation letter from Mrs. Braswell and would like to
thank her for her service. She has served for 13 years. The Board wished her well in the future,
Being no further business Mr. Moore adjourned the meeting at 6:05 p.m.
