BOARD OF ZONING APPEALS

CALL TO ORDER AND ROLL CALL:
Mr. Moore called the meeting to order.
The City Clerk called the roll and declared a quorum present

MINUTES – The minutes were not available.
COMMUNICATIONS:
Mr. Blust stated that There were two items tabled at the last meeting. One is on the agenda
tonight and one has asked to be postponed until January. The Board agreed.
The Secretary swore in those that had signed up to speak.
OLD BUSINESS:
A. Variance #47-19: Mr. John Kendall has made application for a variance to permit more impervious
surface area than is allowed in the R-1 (single family residential) district at 3101 Inland Street.
Mr. Kendall presented the documents from Pyramid Engineering stated that the chamber system would
work for the property. Ms. Lover asked how much 82 cubic feet of water would this be. No one knew
exactly how much this would be. Mr. Blust stated that the Public Works Department looks at 25 year
storms when calculating rainfall amounts.
Mr. Martin asked if an engineer had looked at these calculations.
Mr. Moore stated that he has experience with Pyramid Engineering and never has had a problem.
Mr. Skidmore asked if an engineer from the city has looked at this. Proposal. The City Attorney stated
that the Public Works Department would not review this. Mr. Moore asked if the Board could condition
this on the City Engineer approving this.
Mr. Noury stated that he does not feel that it is a good idea.
Ms. Lover stated that she felt that he could adjust to the pavers and maybe only use them in the turn of the
driveway. The Board discussed his options.
Ms. Lover stated that they are charged with finding a hardship and asked Mr. Kendall what his hardship
is.
Mr. Kendall stated that the main reason is maintenance for the future.
Mr. Moore asked Mr. Kendall if he had gotten a price to do this. He stated that it will be about $3,000.00.
Mr. Moore asked if there were any more questions. Hearing none he called for a motion. The motion to
deny the variance request was made by Mr. Martin and seconded by Ms. Lover. The motion to deny
passed 7-0.
NEW BUSINESS:
B. VARIANCE #V52-19: Mr. Tim Kirby has made application for variance of 5 feet from the
required 25 foot front yard setback in the R-2( Medium Density Residential ) district at 2005
Hillside Drive South.
Ms. Kirby presented the request. She stated that they would like to build a 10 foot porch on the
front of the house for protection from the elements. This would still leave 20 feet frontage.
Ms. Lover asked what the hardship would be.
Ms. Kirby stated that this would protect the front of the house from the elements.
Mr. Martins stated that the hardship has to be n the property not the house.
Ms. Lover stated that this is a good size lot with no irregularities and they could build a 5 foot
porch.
Mr. Caldwell stated that according to code you can have a 7 foot covered porch.
After further discussion Mr. Moore called for a motion.
The motion to deny was made by Mr. Tomas and seconded by Mr. Skidmore.
The motion to deny passed 7-0.
Being no further business Mr. Moore adjourned the meeting at 5:30 p.m.
