MINUTES OF THE SPECIAL CITY COUNCIL MEETING October 29, 2024; 5:30 p.m. CALL TO ORDER A special meeting of the Council of the City of North Platte, Nebraska was convened in open and public session at 5:30 p.m. in the City Hall Council Chambers at 211 West 3rd Street. Present were Nisley, Tryon, Volz, Lucas, Garrick, Flanders, ROLL CALL Woods. Rieker was absent. Mayor Brandon Kelliher presided and City Clerk Angela Gilbert recorded the proceedings. OPEN MEETINGS Mayor Kelliher stated that a current copy of the Open Meetings ACT Act of Nebraska is posted on the wall at the back of the Council Chambers. Notice of the meeting was given in advance thereof by posting in three public places in the City as follows: North Platte Public Library, Lincoln County Courthouse and City Hall; the designated method for giving notice (Certificate of Posting) is attached to these Minutes. Proceedings shown hereafter were taken while the meeting was open to the attendance of the public. ITEM #1 Action to approve License Agreement with NPICE, Inc. and PULLED FROM authorize the Mayor to negotiate and sign necessary documents THE AGENDA was pulled from the Agenda. ITEM #2 Lucas moved and Volz seconded the motion to award bid to LEVEL, LLC FOR Level, LLC of North Platte in the amount of $741,137.90 and PAVING 838 authorize the Mayor to sign contract for Paving District No. 838 located on Golden Road from Newberry Access east approximately 2600 feet. Roll call vote: "AYE": Nisley, Tryon, Volz, Lucas, Garrick, Flanders, Woods. "NAY": None. “ABSENT”: Rieker. Motion carried. ITEM #3 Flanders moved and Garrick seconded the motion to adopt the SANDHILLS recommendation by the City Planning Commission for MIXED USE preliminary and final approval of Sandhills Mixed Use ADMINISTRATIVE Administrative Subdivision and a variance to the City Code of SUBDIVISION, 1105 Ordinances Section 155.093(D) to allow the depth of lot to SOUTH DEWEY exceed three times the width located at 1105 South Dewey. Roll call vote: "AYE": Nisley, Tryon, Volz, Garrick, Flanders, Woods. "NAY": None. “ABSTAIN”: Lucas. “ABSENT”: Rieker. Motion carried. ITEM #4 Volz moved and Garrick seconded the motion to adopt the MURPHY TRACTOR recommendation by the City Planning Commission for 1ST REPLAT, 3402 preliminary and final approval of Murphy Tractor First Replat SOUTH JEFFERS located at 3402 South Jeffers Street. Roll call vote: "AYE": Nisley, Tryon, Volz, Lucas, Garrick, Flanders, Woods. "NAY": None. “ABSENT”: Rieker. Motion carried. ITEM #5 Mayor Kelliher instructed Ordinance No. 4180 to amend the City ORDINANCE 4180 of North Platte Code of Ordinances to add Solar Farms under ON 3RD READING Supplementary Regulations by adding: Section 156.313 Commercial Solar Conversion Systems (CSCS) Regulations (Solar Farms) to be read by title on its third reading. Flanders moved and Garrick seconded the motion to approve Ordinance No. 4180 on its third reading. Roll call vote: "AYE": Nisley, Volz, Lucas, Garrick, Flanders. "NAY": Tryon, Woods. “ABSENT”: Rieker. Motion carried. ITEM #6 Mayor Kelliher instructed Ordinance No. 4181 to amend the City ORDINANCE 4181 of North Platte Code of Ordinances Section 156.042 Conditional ON 3RD READING uses in an A-1 Transitional Agricultural District to add: 156.042 (A)(34) Commercial Solar Conversion Systems (Solar Farms) provided the project conforms to provisions set forth in Section 156.313, and Section 156.237 Conditional Uses in an I-1 Light Industrial District to add: (E) Commercial Solar Conversion Systems (Solar Farms) provided the project conforms to provisions set forth in Section 156.313 to be read by title on its third reading. Lucas moved and Volz seconded the motion to approve Ordinance No. 4181 on its third reading. Roll call vote: "AYE": Nisley, Volz, Lucas, Garrick, Flanders. "NAY": Tryon, Woods. “ABSENT”: Rieker.
