MINUTES OF THE REGULAR CITY COUNCIL MEETING February 4, 2025; 5:30 p.m. CALL TO ORDER A regular meeting of the Council of the City of North Platte, Nebraska was convened in open and public session at 5:30 p.m. in the City Hall Council Chambers at 211 West 3rd Street. Invocation was given by Doug Lee and the pledge of allegiance was recited. ROLL CALL Present were Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. Mayor Brandon Kelliher presided, and City Clerk Angela Gilbert recorded the proceedings. OPEN MEETINGS Mayor Kelliher stated that a current copy of the Open Meetings ACT Act of Nebraska is posted on the wall at the back of the Council Chambers. Notice of the meeting was given in advance thereof by posting in three public places in the City as follows: North Platte Public Library, Lincoln County Courthouse and City Hall; the designated method for giving notice (Certificate of Posting) is attached to these Minutes. Proceedings shown hereafter were taken while the meeting was open to the attendance of the public. CONSENT AGENDA Rieker moved and Volz seconded the motion to approve the Consent Agenda as follows: 1. A. Approve the Minutes of January 21, 2025. B. Place on file Treasurer’s report for December 2024. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. ITEM #2 Garrick moved and Volz seconded the motion to authorize the KENO FUNDS Parks & Recreation Department to expend up to $83,743 from FOR DOWHOWER the Keno fund for renovations to the Softball Fields at SOFTBALL Dowhower Complex and award a contract to Golf & Sport COMPLEX Solutions. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. ITEM #3 Mayor Kelliher instructed Ordinance No. 4193 to amend Title APPROVE IX, Chapter 90, Section 90.99 of the Code of the City of North ORDINANCE 4193 Platte, relating to penalties for the violation of Animal Control ON 2ND READING Ordinances to be read by title on its second reading. Rieker moved and Garrick seconded the motion to approve Ordinance No. 4193 on its second reading. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. Garrick moved and McNew seconded the motion to adopt the ITEM #4 Resolution for the 2025 NebraskaLand Days Parade. Roll call NEBRASKALAND DAYS PARADE vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. Lucas excused himself from the meeting at 5:50 p.m. due to a possible conflict of interest concerning Items #5, #6, and #7. Mayor Kelliher declared a Public hearing to amend the City of ITEM #5 North Platte Comprehensive Plan 2011 Future Land Use Map AMEND FUTURE amending certain lands from Commercial to Medium Density – LAND USE PLAN, Single family, Duplex and Multi-family and to rezone certain 4005 AND 4015 land from a B-1 Neighborhood Commercial District to an R-3 WEST A STREET Dwelling District on property located at 4005 and 4015 West A Street. No one appeared. Garrick moved and Volz seconded the motion to close the hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSENT”: Lucas. Motion carried. Garrick moved and Volz seconded the motion to amend the City of North Platte Comprehensive Plan 2011 Future Land Use Map. Roll call vote: "AYE": Nisley, Dye, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSENT”: Lucas. Motion carried. Mayor Kelliher instructed Ordinance No. 4194 to rezone certain ITEM #6 land from a B-1 Neighborhood Commercial District to an R-3 APPROVE Dwelling District located at 4005 and 4015 West A Street to be ORDINANCE 4194 read by title on its first reading. Rieker moved and McNew ON 1ST READING seconded the motion to approve Ordinance No. 4194 on its first reading. Roll call vote: "AYE": Nisley, Dye, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSENT”: Lucas. Motion carried. ITEM #8 Garrick moved and Volz seconded the motion to approve the CLAIMS Claims. Roll call vote: "AYE": Nisley, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSTAIN”: Dye. “ABSENT”: Lucas. Motion carried. CLOSED SESSION Rieker moved and Nisley seconded the motion to go into Closed Session at 5:55 p.m. for the sole purpose of discussing contract negotiations, in order to protect the public’s interest. Roll call vote: "AYE": Nisley, Dye, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSENT”: Lucas. Motion carried. Mayor Kelliher stated the reason for the Closed Session is for the sole purpose of discussing contract negotiations, in order to protect the public’s interest. RETURN TO Volz moved and Dye seconded the motion to come out of Closed REGULAR SESSION Session and return to Regular Session at 7:01 p.m. Roll call vote: "AYE": Nisley, Dye, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSENT”: Lucas. Motion carried. Mayor Kelliher stated the only topic discussed in the Closed Session was contract negotiations, in order to protect the public’s interest. ITEM #7 Volz moved and Flanders seconded the motion to adopt the APPROVE NP Resolution to approve the Amended Redevelopment Contract for MALL AMENDED the North Platte Mall Project and approval of related actions. REDEVELOPMENT Roll call vote: "AYE": Nisley, Dye, Volz, Flanders, McNew. PLAN "NAY": Garrick, Rieker. “ABSENT”: Lucas. Motion carried. Rieker moved and Volz seconded the motion to adjourn.
