MINUTES OF THE REGULAR CITY COUNCIL MEETING March 4, 2025; 5:30 p.m. CALL TO ORDER A regular meeting of the Council of the City of North Platte, Nebraska was convened in open and public session at 5:30 p.m. in the City Hall Council Chambers at 211 West 3rd Street. Invocation was given by Daniel Ramsey and the pledge of allegiance was recited. ROLL CALL Present were Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. Council President Jim Nisley presided, and City Clerk Angela Gilbert recorded the proceedings. OPEN MEETINGS Council President Nisley stated that a current copy of the Open ACT Meetings Act of Nebraska is posted on the wall at the back of the Council Chambers. Notice of the meeting was given in advance thereof by posting in three public places in the City as follows: North Platte Public Library, Lincoln County Courthouse and City Hall; the designated method for giving notice (Certificate of Posting) is attached to these Minutes. Proceedings shown hereafter were taken while the meeting was open to the attendance of the public. CONSENT AGENDA Rieker moved and Garrick seconded the motion to approve the Consent Agenda as follows: A. Approve the Minutes of, 2025. B. Place on file Treasurer’s report for January 2025. C. Accept and place on file the City of North Platte Audit for fiscal year ended September 30, 2024. D. Send the application of Venue 304 for a Class C Liquor License (Beer, Wine, Distilled Spirits, On & Off Sale) for their location at 304 East 5th Street to the Nebraska Liquor Control Commission with no recommendation. E. Send the application of McCabes Pub & Lounge for a Class CK Liquor License (Beer, Wine, Distilled Spirits, On & Off Sale and Catering) for their location at 402 North Dewey Street to the Nebraska Liquor Control Commission with no recommendation. F. Council President Nisley removed the Agreement for Sale of Real Property with Sustainable Beef, LLC for property on which the City is constructing an electrical substation from the Agenda. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. ITEM #2 Garrick moved and Dye seconded the motion to adopt the TRANSIT GRANT Resolution to submit the 2025-2027 Grant Application to the APPLICATION FOR Nebraska Department of Transportation for the State and Federal 2025-2027 Assistance for the North Platte Public Transit Department. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, McNew. "NAY": Rieker. Motion carried. ITEM #3 Garrick moved and Rieker seconded the motion to adopt the CITY ATTORNEY TO Resolution authorizing the City Attorney to participate in the PARTICIPATE IN Sheriff’s sale for the property located at 2103 West 2nd Street on SHERIFF’S SALE behalf of the City of North Platte. Roll call vote: "AYE": Nisley, FOR 2103 WEST 2ND Dye, Volz, Lucas, Garrick, Flanders, McNew. "NAY": Rieker. Motion carried. Council President Nisley instructed Ordinance No. 4199 to ITEM #4 Amend Title IX, Chapter 91 of the Code of the City of North APPROVE ORDINANCE 4199 Platte, to revise Section 91.21, relating to the clearing of ON 2ND READING sidewalks, and to add Section 91.29, relating to penalties for the violation of sidewalk ordinances to be read by title on its second reading. Rieker moved and Garrick seconded the motion to approve Ordinance No. 4199 on its second reading. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. Council President Nisley instructed Ordinance No. 4194 to ITEM #5 rezone certain land from a B-1 Neighborhood Commercial APPROVE District to an R-3 Dwelling District located at 4005 and 4015 ORDINANCE 4194 ON 3RD READING West A Street to be read by title on its third reading. Garrick moved and McNew seconded the motion to approve Ordinance No. 4194 on its third reading. Roll call vote: "AYE": Nisley, Dye, Volz, Garrick, Flanders, Rieker, McNew. "NAY": None. “ABSTAIN”: Lucas. Motion carried. Council President Nisley removed an application by Luis Mario ITEM #6 and Alicia Tacuri for an amendment to the City of North Platte REMOVED FROM 2011 Future Land Use Map amending certain land from Medium THE AGENDA Density – Single family, Duplex and Multi-family to Commercial on property located at 603 East 5th Street and 503 North Cottonwood Street and described as Lot 5, Block 110, Original Town of North Platte, Lincoln County, Nebraska from the Agenda. ITEM #7 Council President Nisley removed Ordinance No. 4200 to rezone REMOVED FROM certain land from an R-3 Dwelling District to a B-3 Downtown THE AGENDA Commercial District on property located at 603 East 5th Street and 503 North Cottonwood Street and described as Lot 5, Block 110, Original Town of North Platte, Lincoln County, Nebraska from the Agenda. Garrick moved and Dye seconded the motion to approve the ITEM #8 Claims. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, CLAIMS Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried.
