MINUTES OF THE REGULAR CITY COUNCIL MEETING April 1, 2025; 5:30 p.m. CALL TO ORDER A regular meeting of the Council of the City of North Platte, Nebraska was convened in open and public session at 5:30 p.m. in the City Hall Council Chambers at 211 West 3rd Street. Invocation was given by Pastor John Stone and the pledge of allegiance was recited. ROLL CALL Present were Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. Mayor Brandon Kelliher presided, and City Clerk Angela Gilbert recorded the proceedings. OPEN MEETINGS Mayor Kelliher stated that a current copy of the Open Meetings ACT Act of Nebraska is posted on the wall at the back of the Council Chambers. Notice of the meeting was given in advance thereof by posting in three public places in the City as follows: North Platte Public Library, Lincoln County Courthouse and City Hall; the designated method for giving notice (Certificate of Posting) is attached to these Minutes. Proceedings shown hereafter were taken while the meeting was open to the attendance of the public. ITEM #1 Lucas moved and Nisley seconded the motion to approve the CONSENT AGENDA Consent Agenda as follows: A. Approve the Minutes of March 18, 2025. B. Send the application of Wilkinson Development Inc. dba Fat Dogs Exit 179 Travel Center for a Class D Liquor (Off Sale Only) for their location at 3400 Halligan Drive to the Nebraska Liquor Control Commission with no recommendation. C. Approve the application by Pals Brewing Company for Special Designated Licenses on May 23 and 24, 2025 from 8:00 a.m. to 1:00 a.m. at the D&N Event Center, 501 East Walker Road for a Bucking Bull Bash. D. Approve the application by Wilkinson Development, Inc. for a Special Designated License on June 20, 2025 from 3:00 p.m. to 7:00 p.m. at Fat Dogs North, 1313 South Dewey Street for a Tasting Event. E. Adopt the Resolution consenting to the sale and consumption of alcoholic liquor on East 5th Street and North Dewey Street during Music on the Bricks on May 16 and 17, 2025. F. Approve the application by BJ Stenger Sales, LLC dba The Cedar Room for Special Designated Licenses on May 16 and 17, 2025 from 12:00 p.m. to 1:00 a.m. on East 5th Street and North Dewey Street during Music on the Bricks. G. Adopt the Resolution consenting to the sale and consumption of alcoholic liquor on North Dewey Street between 5th and 6th Streets for The Cedar Room’s Five- Year Celebration on July 18, 2025. H. Approve the application by BJ Stenger Sales, LLC dba The Cedar Room for a Special Designated License on July 18, 2025 from 6:00 p.m. to 12:00 a.m. at 505-507 North Dewey Street for their Five-Year Celebration. I. Authorize the Mayor to execute the purchase of one (1) 2025 Chevrolet 2500 truck for the Fire Department from Jerry Remus Chevrolet in the amount of $53,854. J. Authorize the Mayor to execute the purchase of forty-five (45) SCBA and auxiliary equipment for the Fire Department from Macqueen Group in the amount of $391,115. K. Authorize the Mayor to negotiate and sign the covenant agreements for 2107 West 2nd Street, 1106 East 14th Street and 1418 West 14th Street between the Nebraska Department of Economic Development and the City of North Platte. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. ITEM #2 Mayor Kelliher instructed Ordinance No. 4201 authorizing the APPROVE issuance by the City of North Platte, Nebraska of its Municipal ORDINANCE 4201 Improvement Bonds, in the aggregate principal amount of not to exceed $42,100,000, in one or more series, for the purpose of expanding and renovating the North Platte Recreation Center and Cody Pool to be read by title on its first reading. Garrick moved and Volz seconded the motion to approve Ordinance No. 4201 on its first reading. Volz moved and Lucas seconded the motion to waive the three readings and approve Ordinance No. 4201. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. Roll call vote on Ordinance No. 4201 as amended: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. ITEM #3 Lucas moved and Garrick seconded the motion to adopt the SETTLEMENT Resolution to authorize a Settlement Agreement for new natural AGREEMENT WITH gas rates with NorthWestern Energy and related actions. Roll NORTHWESTERN call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, ENERGY Rieker, McNew. "NAY": None. Motion carried. ITEM #4 Mayor Kelliher instructed Ordinance No. 4200 to rezone certain APPROVE 2ND land from an R-3 Dwelling District to a B-2 Highway READING OF Commercial District on property located at 603 East 5th Street ORDINANCE 4200 and 503 North Cottonwood Street to be read by title on its second reading. Rieker moved and Flanders seconded the motion to approve Ordinance No. 4200 on its second reading. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. ITEM #5 Mayor Kelliher declared a Public hearing on Ordinance No. APPROVE ORDINANCE 4202 4202 to rezone certain land from an R-2 Dwelling District to a PR-3 Planned Dwelling District located at 1202-1220 West 15th Street and 1102 West 17th Street. Gary Person, President of North Platte Chamber/DEVCO, stated the rezoning is being done to allow three four-plex residential units to be built in addition to the eight single-family homes on North Adams. Garrick moved and Rieker seconded the motion to close the hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None. Motion carried. Mayor Kelliher instructed Ordinance No. 4202 to be read by title on its first reading. Garrick moved and Volz seconded the motion to approve Ordinance No. 4202 on its first reading. AND SOUTH State Farm Road and South Buffalo Bill including proposed BUFFALO BILL ANNEXATION PLAN annexations of Parcel ID Numbers 0055513.02, 0055513.01, 0054951.20 and 0054624.70; Ordinance No. 4195 annexing Lot 1, Otter Second Subdivision into the City of North Platte Corporate Limits; Ordinance No. 4196 annexing Lot 2, Otter First Subdivision into the City of North Platte Corporate Limits; Ordinance No. 4197 annexing Lot 1, Majors 3 Brothers Administrative Subdivision into the City of North Platte Corporate Limits and Ordinance No. 4198 annexing Block 1, Glennfield’s 3rd Subdivision into the City of North Platte Corporate Limits. Paul Oettinger, Otter Investments LLC, said he has no objection to the annexation and is looking forward to being part of the North Platte community. ITEM #10 Mayor Kelliher instructed Ordinance No. 4198 annexing Block 1 APPROVE 1ST Glennfield’s 3rd Subdivision into the City of North Platte READING OF Corporate Limits to be read by title on its first reading.
