MINUTES OF THE REGULAR CITY COUNCIL MEETING
November 4, 2025; 5:30 p.m.
CALL TO ORDER A regular meeting of the Council of the City of North Platte,
Nebraska was convened in open and public session at 5:30 p.m.
in the City Hall Council Chambers at 211 West 3rd Street.
Invocation was given by Craig Fabik and the pledge of
allegiance was recited.
ROLL CALL Present were Nisley, Dye, Volz, Lucas, Garrick, Flanders,
Rieker, McNew. Mayor Brandon Kelliher presided, and City
Clerk Angela Gilbert recorded the proceedings.
OPEN MEETINGS Mayor Kelliher stated that a current copy of the Open Meetings
ACT Act of Nebraska is posted on the wall at the back of the Council
Chambers.
Notice of the meeting was given in advance thereof by posting in
three public places in the City as follows: North Platte Public
Library, Lincoln County Courthouse and City Hall; the
designated method for giving notice (Certificate of Posting) is
attached to these Minutes. Proceedings shown hereafter were
taken while the meeting was open to the attendance of the public.
ITEM #1 Rieker moved and Volz seconded the motion to approve the
CONSENT AGENDA Consent Agenda as follows:
A. Approve the Minutes of October 21, 2025.
B. Send the application of Locora Fusion Inc. dba Locora Grill
for a Class C Liquor License (On & Off Sale) located at 2102
South Jeffers Street to the Nebraska Liquor Control
Commission with no recommendation.
C. Adopt the Resolution for Signing of the Year-End
Certification of City Street Superintendent for 2025 and
authorize the Mayor to sign the Year-End Certification of
City Street Superintendent for 2025.
Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick,
Flanders, Rieker, McNew. "NAY": None. Motion carried.
ITEM #2 Mayor Kelliher declared a Public hearing to approve a
DEVCO HOUSING Resolution regarding the City of North Platte DEVCO Housing
REDEVELOPMENT Project Redevelopment Plan on property described as Lots 6, 7,
PROJECT PLAN 8, 9 and 10 Mulligan Meadows Fourth Subdivision, North Platte,
Lincoln County, Nebraska, pursuant to Nebraska Community
Development Law.
Greg Wilke, Community Redevelopment Authority Chairman,
explained that this is a replat of the original plan, with an
addition of three four-plex’s for multi-family housing and a plan
of how they are going to reroute the drainage ditch.
Gary Person, President of North Platte Chamber/DEVCO, said
there is still a need for additional single-family homes and this
project will help fill that much needed gap. He said twelve
houses have been built so far, with three bedrooms, two baths, a
two-car garage, and fencing; they also plan to add three four-
plex’s for multi-family housing. He stated that as the loan is
repaid, they can reinvest it in additional housing for the
community.
Volz moved and Dye seconded the motion to close the hearing.

Volz moved and McNew seconded the motion to approve the
Resolution regarding the City of North Platte DEVCO Housing
Project Redevelopment Plan. Roll call vote: "AYE": Nisley,
Dye, Volz, Garrick, Flanders, McNew. "NAY": Rieker.
“ABSTAIN”: Lucas. Motion carried.
ITEM #3 Flanders moved and Volz seconded the motion to approve the
INTERLOCAL renewal of two Interlocal Agreements between the City of North
AGREEMENTS FOR Platte and Lincoln County for Maintenance of Roads and
MAINTENANCE OF
authorize the Mayor to execute all documents for the City.
ROADS
Jerry Vieyra said the Lincoln County Commissioner’s reviewed
a quitclaim deed from 1981 and dedicated Vieyra Road as a
County road; he asked the City to maintain the road and correct
the name to Vieyra Avenue.
Rieker moved and Lucas seconded the motion to remove D.
Vieyra Road (NW part of City) from the Interlocal Agreement.
Roll call vote: "AYE": Nisley, Dye, Lucas, Garrick, Flanders,
Rieker. "NAY": Volz, McNew. Motion carried.
Lucas moved and Dye seconded the motion to add the words:
subject to the City's/County’s established maintenance policies,
in paragraph 2. PURPOSE. Roll call vote: "AYE": Nisley, Dye,
Volz, Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None.
Motion carried.
Roll call vote on the Interlocal Agreements as amended: "AYE":

ITEM #4
SECOND Volz moved and Rieker seconded the motion to approve the
AMENDMENT TO Resolution to adopt the Second Amendment to the City of North
POLICE OFFICERS’
Platte, Nebraska Police Officers’ Pension Plan. Roll call vote:

ITEM #5
SECOND Rieker moved and Nisley seconded the motion to approve the
AMENDMENT TO Resolution to adopt the Second Amendment to the City of North
FIREFIGHTERS’ Platte, Nebraska Firefighters’ Pension Plan. Roll call vote:
PENSION PLAN "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker,
McNew. "NAY": None. Motion carried.
ITEM #6 Flanders moved and Volz seconded the motion to approve the
MIDLANDS
bid and authorize the Mayor to sign contract with Midlands
CONTRACTING
FOR SEWER Contracting, Inc. of Kearney, NE for Sanitary Sewer Connection
CONNECTON 23 District No. 23 (east of Buffalo Bill Avenue, starting north of
Spring Road thence south along the west alley of Valley Drive to
State Farm Road approximately 1,575 feet) in the amount of
$169,146.94. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.
ITEM #7 Rieker moved and Volz seconded the motion to approve the
JEO CONSULTING proposal with JEO Consulting Group for an Engineering
GROUP FOR
Corridor Study for Buffalo Bill Avenue starting at Rodeo Road
BUFFALO BILL AVE
CORRIDOR STUDY south to Walker Road and authorize the Mayor to sign the
proposal. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.
ITEM #8 Mayor Kelliher instructed Ordinance No. 4229 to amend Section
APPROVE 54.10 of the Code of the City of North Platte relating to the
ORDINANCE 4229 collection of bulky trash to be read by title on its second reading.
Rieker moved and Nisley seconded the motion to waive the third
reading and approve Ordinance No. 4229. Roll call vote: "AYE":
Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew.
"NAY": None. Motion carried.
ITEM #9 Mayor Kelliher instructed Ordinance No. 4226 to rezone certain
APPROVE land from an A-1 Transitional Agricultural District to a B-2
ORDINANCE 4226 Highway Commercial District located at 4684 and 4602 Rodeo
ON 3RD READING Road to be read by title on its third reading. Rieker moved and
McNew seconded the motion to approve Ordinance No. 4226 on
its third reading. Roll call vote: "AYE": Nisley, Dye, Volz,
Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None.
Motion carried.
ITEM #10 Lucas moved and Dye seconded the motion to adopt the

recommendation by the City Planning Commission for
SUBDIVISION,
4602 RODEO ROAD preliminary and final approval of Herrick Subdivision located at
4602 Rodeo Road. Roll call vote: "AYE": Nisley, Dye, Volz,
Lucas, Garrick, Flanders, Rieker, McNew. "NAY": None.

ITEM #11
TABLED UNTIL Mayor Kelliher declared a Public hearing to approve the
THE NEXT CITY Agreement for Sale of Real Estate with Tyler Bush for property
COUNCIL MEETING located at 1021 North Bryan.
Tyler Bush, property owner, told the Council the funds from the
sale of this property will go towards tearing down another
property he owns at 1201 East 6th Street.
McNew moved and Nisley seconded the motion to close the
hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.
Flanders moved and Volz seconded the motion to approve the
Agreement for Sale of Real Estate with Tyler Bush for property
located at 1021 North Bryan and authorize the Mayor to sign
necessary documents.
Lucas moved and Garrick seconded the motion to table the
Agreement for Sale of Real Estate until the next City Council
Meeting. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.
ITEM #12 Mayor Kelliher declared a Public hearing on Ordinance No.
ORDINANCE 4241 4241 to amend the City of North Platte Code of Ordinances
FAILED Section 76.22 regarding Parking and Storing of RV’s.
No one appeared.
Lucas moved and Volz seconded the motion to close the hearing.
Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick,
Flanders, Rieker, McNew. "NAY": None. Motion carried.
Mayor Kelliher instructed Ordinance No. 4241 to be read by title
on its first reading. Rieker moved and Volz seconded the motion
to leave the RV Ordinance as it is.
Rieker withdrew his motion, with the consent of Volz.
Rieker moved and Volz seconded the motion to approve
Ordinance No. 4241 on its first reading. Roll call vote: "AYE":
None. "NAY": Nisley, Dye, Volz, Lucas, Garrick, Flanders,
Rieker, McNew. Motion failed.
ITEM #13
APPROVE Mayor Kelliher declared a Public hearing on Ordinance No.
ORDINANCE 4230 4230 annexing Parcel 0054535.00 described as Lot 13 Cody
ON 1ST READING Land & Cattle and Part of Tract E, Lincoln County, Nebraska,
into the corporate limits of the City of North Platte, consisting of
approximately 2.00 acres.
No one appeared.
Volz moved and Dye seconded the motion to close the hearing.
Roll call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick,
Flanders, Rieker, McNew. "NAY": None. Motion carried.
Mayor Kelliher instructed Ordinance No. 4230 to be read by title
on its first reading. Rieker moved and McNew seconded the
motion to approve Ordinance No. 4230 on its first reading. Roll
call vote: "AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders,
Rieker, McNew. "NAY": None. Motion carried.
ITEM #14
APPROVE Mayor Kelliher declared a Public hearing on Ordinance No.
ORDINANCE 4231 4231 annexing Parcels 0054621.67 and 0054621.68 described as
ON 1ST READING Lot 1 & 2 Franzen Second Administrative Subdivision Lincoln
County, NE, into the limits of the City of North Platte,
consisting of approximately 8.54 acres.
Marcene Franzen, 1701 Valley Vista Drive, told the Council
they were not aware of the annexation and are against it as it will
be a financial burden; she said if they had known, they would
have done things differently when they sold their granddaughter
the lot.
Kaitlyn Holm, 1721 Valley Vista Drive, stated she never
expected to put her grandparents’ properties into City limits, and
thought only her lot would be annexed.
Volz moved and Rieker seconded the motion to close the
hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.
Mayor Kelliher instructed Ordinance No. 4231 to be read by title
on its first reading. McNew moved and Rieker seconded the
motion to approve Ordinance No. 4231 on its first reading.
Nisley moved and Dye seconded the motion to amend Ordinance
No. 4231 to only annex Parcel 0054621.68 described as Lot 2
Franzen Second Administrative Subdivision Lincoln County,
NE, into the limits of the City of North Platte. Roll call vote:
"AYE": Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker,
McNew. "NAY": None. Motion carried.
Roll call vote on Ordinance No. 4231 as amended: "AYE":
Nisley, Dye, Volz, Lucas, Garrick, Flanders, Rieker, McNew.
"NAY": None. Motion carried.
ITEM #15 Mayor Kelliher declared a Public hearing to adopt the City of
ADOPT 2025 North Platte 2025 Annexation Plan - East 6th Street and proposed
ANNEXATION annexations pursuant to Nebraska Revised State Statute §16-117.
PLAN FOR EAST 6TH
STREET Dotty Erickson, 1708 East 6th Street, told the Council she is
strongly against the annexation of the area, and it is not fair. She
stated the area is more country in nature, as they have livestock.
She said it is not the right time and asked how many City
ordinances they will have to follow if they are annexed.
Jeff Erickson, 2001 East 6th Street, said he did not request to be
annexed, and he does not understand how the land could be
developed as everything behind it is owned by the railroad and
there are water and drainage issues in the area. He stated that if
he is required to pay taxes, he will request things to be fixed by
the City.
Steve Simpson, property owner in Area D, told the Council he
likes where he is and does not want to be annexed. He said he
cannot afford the taxes as he already pays extra for utilities and
is trying to fix up his property.
Brent Kennedy, 1813 East 6th Street, stated he is strongly
opposed to the annexation.
Ed Sterner, 2101 East 6th Street, stated he has livestock and does
not want to be within City limits.
John Erickson, 1708 East 6th Street, told the Council he is against
the annexation, as they have horses. He stated that no one would
want to develop the land due to all of the issues with flooding.
McNew moved and Dye seconded the motion to close the
hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.
Volz moved and McNew seconded the motion to adopt the City
of North Platte 2025 Annexation Plan - East 6th Street. Roll call
vote: "AYE": Dye, Volz, Lucas, Garrick, Flanders, McNew.

ITEM #16 Mayor Kelliher declared a Public hearing on Ordinance No.
APPROVE 4232 annexing certain land referred to as Study Area 2025-A

John Erickson told the Council he has permits from the State for
his junkyard and asked if it would be grandfathered in.
Rieker moved and McNew seconded the motion to close the
hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.

property since he does not have any right now.

Jeff Erickson asked if he would be able to keep his livestock if
he was annexed.

carried.

APPROVE Mayor Kelliher declared a Public hearing on Ordinance No.
ORDINANCE 4237 4237 annexing certain land referred to as Study Area 2025-F
ON 1ST READING East 6th Street (2000 Block East 6th Street – South Side).
Dotty Erickson said she has a farm truck and asked if it will have
to be licensed if it is inside City limits.
Rieker moved and Volz seconded the motion to close the
hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, Rieker, McNew. "NAY": None. Motion
carried.

John Erickson told the Council he has a petition signed by the
property owners who are opposed to the annexation.
Rieker moved and Flanders seconded the motion to close the
hearing. Roll call vote: "AYE": Nisley, Dye, Volz, Lucas,
Garrick, Flanders, McNew. "NAY": Rieker. Motion carried.
Mayor Kelliher instructed Ordinance No. 4238 to be read by title
on its first reading. Flanders moved and McNew seconded the
motion to approve Ordinance No. 4238 on its first reading. Roll

ITEM #25 Discussion was held on departmental purchasing history and
DISCUSSION WAS procedures. No action was taken.
