MINUTES OF THE MEETING OF THE SPECIAL NORTH PLATTE PLANNING COMMISSION HELD ON
THE 8TH DAY OF MARCH 2022 IN THE CITY HALL COUNCIL CHAMBERS.
MEMBERS PRESENT: Tristen Winder, Jeff Bain, Marilyn McGahan, Angie Forbes, David Fudge, Emily Wurl,
Nelson Jett
MEMBERS ABSENT: Lee Davies, Don Weber
STAFF MEMBERS PRESENT: Judy Clark, Planning Administrator; Michelle Bain, Recording Secretary
Notice of the meeting was given in advance thereof, by posting in at least three places in the City as follows: North
Platte Public Library, Lincoln County Courthouse, and City Hall offices.
Notice of the meeting was given to the Chairman and all members of the Planning Commission. Availability of the
agenda was communicated in the advance notice and in the notice to the Chairman and members of the Commission.
All proceedings thereafter shown were taken while the convened meeting was open to the attendance of the public.
Chair McGahan called the meeting to order at 5:30 p.m. and stated a current copy of the open meetings act of
Nebraska is posted at the back of the Council Chambers.
2. Fudge moved and Jett seconded the motion to approve the minutes of the meeting held January 25, 2022.
Voting Aye: Wurl, Weber, McGahan, Forbes, Fudge, Jett, Bain. Voting Nay: None. Absent: Davies, Winder.
Motion carried.
3. Public Hearing AM22-001 Discuss and consider action on an amendment to the City of North Platte Code of
Ordinance Chapter 130 General Offenses Firearms; Fireworks Section 130.25 Discharge of Firearms.
Chair McGahan opened the public hearing.
Judy stated that there are some special circumstances discharge of a firearm within city limits would be feasible.
For example, designation of a specific time and place for hunter education, hunter safety, or concealed carry
classes would be a good use of the new proposed regulations. Using the proposed language as written would
provide the City with the ability to designate those areas. Planning Staff has been in communication with Chief
Reeves and he has no objections to the proposed amendments. What is added is basically areas approved by the
governing body.
Kendall Allison with the Police Department was present to answer any questions.
Fudge moved and Bain seconded the motion to close the public hearing. Voting Aye: Wurl, Weber, McGahan,
Forbes, Fudge, Jett, Bain, Davies, Winder. Voting Nay: None. Absent: None. Motion carried.
Winder moved and Jett seconded the motion to approve an amendment to the City of North Platte Code of
Ordinances Chapter 130 General Offenses Firearms; Fireworks Section 130.25 Discharge of Firearms. Voting
Aye: Wurl, McGahan, Forbes, Fudge, Jett, Bain, Winder. Voting Nay: None. Absent: Davies, Weber.
Motion carried.
4. Public Hearing AM22-002 Discuss and consider action on an amendment to the City of North Platte Code of
Ordinances Chapter 156 Zoning adding Sections 156.260 and 156.261 relating to the establishment of the City
of North Platte Public Power and Irrigation Overlay District.
Chair McGahan opened the public hearing.
Judy stated that over the past several months the City has been working on annexations under our 2021 City of
North Platte Annexation Study East 4th Street and East Highway 30. One of the proposed annexations includes
property owned by Central Nebraska Public Power and Irrigation District (CNPPID). Through the annexation
process CNPPID has voiced a few concerns with some of the City’s current zoning and enforcement regulations

regarding their current operations. To help alleviate those concerns, the City Engineering and Planning
Department is proposing a Public Power and Irrigation Overlay District. The intent of the proposed public
power and irrigation overlay district is to provide public power and irrigation districts with basic guidelines that
would allow for normal and regular operations of the district to function in areas that may conflict with existing
regulations. When there is a conflict, these overlay districts supersede other city regulations set forth in the City
of North Platte Code of Ordinances. Planning Staff has no objections to the proposed establishment of the City
of North Platte Public Power and Irrigation Overlay District.
Mike Drain, CNPPID, 415 Lincoln St, Holdrege, Nebraska, was present and stated he supports creation of the
overlay district since they already lie within city zoning with or without the annexation.
Fudge moved and Bain seconded the motion to close the public hearing. Voting Aye: Wurl, McGahan, Forbes,
Fudge, Jett, Bain, Winder. Voting Nay: None. Absent: Davies, Weber. Motion carried.
After some discussion Judy explained that this overlay district can be changed or amended just like zoning.
Fudge moved and Winder seconded the motion to approve an amendment to the City of North Platte Code of
Ordinances Chapter 156 Zoning adding Sections 156.260 and 156.261 relating to the establishment of the City
of North Platte Public Power and Irrigation Overlay District. Voting Aye: Wurl, McGahan, Forbes, Fudge,
Jett, Bain, Winder. Voting Nay: None. Absent: Davies, Weber. Motion carried.
5. Discussion of Zoning Code Update.
Judy explained there will be a public hearing on the March 22, 2022 Planning Commission meeting agenda.
6. Old Business. There was no old business to be discussed.
7. New Business.
Judy invited the Planning Commission to attend the NPZA Zoom session March 18th.
Chair McGahan encouraged the Planning Commission to attend the sessions pointing out they will find other
cities have some of the same issues as North Platte.
8. Adjourn. Chair McGahan adjourned the meeting at 5:45 p.m.
