MINUTES OF THE MEETING OF THE NORTH PLATTE PLANNING COMMISSION HELD ON THE 27th DAY OF AUGUST 2024 IN THE CITY HALL COUNCIL CHAMBERS. MEMBERS PRESENT: David Fudge, Emily Wurl, Angie Forbes, Kathleen Matthews, Glenn Van Velson, Kert McKeone, Jeff Bain MEMBERS ABSENT: Nelson Jett, Lee Davies STAFF MEMBERS PRESENT: Judy Clark, Planning Administrator; Michelle Bain, Recording Secretary, Attorney Bill Troshynski Notice of the meeting was given in advance thereof, by posting in at least three places in the City as follows: North Platte Public Library, Lincoln County Courthouse, and City Hall offices. Notice of the meeting was given to the Chairman and all members of the Planning Commission. Availability of the agenda was communicated in the advance notice and in the notice to the Chairman and members of the Commission. All proceedings thereafter shown were taken while the convened meeting was open to the attendance of the public. Chair Fudge called the meeting to order at 5:30 p.m. and stated a current copy of the open meetings act of Nebraska is posted at the back of the Council Chambers. 2. Van Velson moved and Bain seconded the motion to approve the minutes of the meeting held July 23, 2024. Voting Aye: Fudge, Wurl, Van Velson, Matthews, McKeone, Forbes, Bain. Voting Nay: None. Absent: Jett, Davies. Motion carried. 3. File No. SU24-015 Discuss and consider action on an application by Richard and Tracy Housman for preliminary and final approval of Housman Replat and approval of a variance to the City of North Platte Code of Ordinances Section 155.093(D) The depth of a lot shall be no more than 3 times the width of the lot at the building line on property located at 2605 W 16th Street and 1610-1620 Buffalo Bill Avenue in an R-3 Dwelling District on property described as part of Block 37, Lincoln Highway Fourth Addition, North Platte, Lincoln County, Nebraska. Judy stated that the subdivision will reconfigure 4 lots into 5 lots. Public utilities are available to service the lots. Planning Staff has no objection to the proposed subdivision if the variance to depth of lot is approved. Chair Fudge stated that Kathleen Matthews will abstain from this action. Van Velson questioned if 49.5’ is enough area to build a home. Judy stated that it’s tight but it’s possible. Bain stated this includes a variance, but it makes sense to not have any land locked area. Bain moved and McKeone seconded the motion to make a recommendation to approve File No. SU24-015 preliminary and final approval of Housman Replat and a variance to City of North Platte Code of Ordinance Section 155.093(D) to allow the depth of lot to exceed 3 times the width. Voting Aye: Fudge, Wurl, McKeone, Forbes, Bain, Voting Nay: Van Velson. Abstaining: Matthews. Absent: Jett, Davies. Motion carried. 4. File No. SU24-016 Discuss and consider action on an application by Diamond E Properties, LLC and Eickhoff Construction, LLC for preliminary and final approval of Dancer 4th Replat and approval of a variance to the City of North Platte Code of Ordinances Section 155.093(D) The depth of a lot shall be no more than 3 times the width of the lot at the building line on property located at 815 Mockingbird Drive in an R-2 Dwelling District on property described of Lots 7 and 8, Block 2, Dancer Third Subdivision, North Platte, Lincoln County, Nebraska. Judy stated that the subdivision will consolidate two lots into one lot. Public utilities are available to service the lot. Planning Staff has no objection to the proposed subdivision if the variance to depth of lot is approved. North Platte Planning August 27, 2024 Page - 2 Clarine Eickhoff, 8909 S. Buffalo Rd., owner of Eickhoff Construction & Diamond Inc. Properties, was present and stated they had a higher level professional looking at that house and wanted additional parking, possibly a garage. The fire hydrant was inset into that lot quite a ways which limits the setbacks. Getting additional cars off those streets will be a benefit. Van Velson asked if the 62’ width is too small. Ms. Eickhoff stated there is no back yard on the house site. There wouldn’t be one on the lot next to it. Combining the two will tie the yard in with the garage. Matthews moved and Bain seconded the motion to make a recommendation to approve File No. SU24-016 preliminary and final approval of Dancer 4th Replat and a variance to City of North Platte Code of Ordinance Section 155.093(D) to allow the depth of lot to exceed 3 times the width. Voting Aye: Fudge, Wurl, Van Velson, Matthews, McKeone, Forbes, Bain. Voting Nay: None. Absent: Jett, Davies. Motion carried. 5. File No. SU24-017 Discuss and consider action on an application by Maple Park Dental Associates, PC and L&S Enterprises, LLC for preliminary and final approval of Residence Park Replat and approval of a variance to the City of North Platte Code of Ordinances Section 155.093(D) The depth of a lot shall be no more than 3 times the width of the lot at the building line on property located at 805 South Maple Street in an H-1 Hospital District on property described as Lots 15 and 16, Block 19, Residence Park Subdivision and Lot 1 Lashley Administrative Subdivision, North Platte, Lincoln County, Nebraska. Judy stated that the subdivision will consolidate three lots into one lot. Public utilities are available to service the lot. Planning Staff has no objection to the proposed subdivision if the variance to depth of lot is approved. They intend to move the house and put in a parking lot. Wurl moved and Forbes seconded the motion to make a recommendation to approve File No. SU24-017 preliminary and final approval of Residence Park Replat and a variance to City of North Platte Code of Ordinance Section 155.093(D) to allow the depth of lot to exceed 3 times the width. Voting Aye: Wurl, Van Velson, Matthews, McKeone, Forbes, Bain. Voting Nay: None. Abstaining: Fudge. Absent: Jett, Davies. Motion carried. 6. File No. SU24-018 Discuss and consider action on an application by Wilkinson Development Inc. for preliminary and final approval of Fatdogs Subdivision located at 3400 Halligan Drive in a B-2 Highway Commercial District and described as a tract of land in Government Lots 5 and 6, Section 11, Township 13 North, Range 30 West of the 6th P.M., North Platte, Lincoln County, Nebraska. Judy stated that the subdivision will reconfigure two parcels into 3 lots. Public utilities are not available to service the lots, infrastructure will be installed according to the Wilkinson Exit 179 Commercial Redevelopment Plan. Planning Staff has no objection to the proposed subdivision. McKeone moved and Bain seconded the motion to make a recommendation to approve File No. SU24-018 preliminary and final approval of Fatdogs Subdivision. Voting Aye: Fudge, Wurl, Van Velson, Matthews, McKeone, Forbes, Bain. Voting Nay: None. Absent: Jett, Davies. Motion carried. 7. Discussion of amendments to the City of North Platte Code of Ordinances Section 156.042 Conditional Uses in an A-1 Transitional Agricultural District and Section 156.290 Supplementary Regulations. Judy stated that Planning Staff has received a few inquiries on different uses in an A-1 Transitional Agricultural District and is proposing adding the following two uses as conditional uses.  Commercial Riding/Boarding Stables – allowed by conditional use and only on property that is 10 acres or more and outside the city limits of the city of North Platte o Currently stables are allowed in A-1 Districts outside the city limits as accessory uses; however, these are for personal use only. The reason for only allowing stables outside city limits is due to regulations that do not allow hooved animals in the city limits, additionally this would put horses on property that is not close to small lot residential developments. Also keeping them as North Platte Planning August 27, 2024 Page - 3 conditional uses will allow planning commission and city council the ability to put reasonable conditions on individual applications. There is a stable currently outside city limits.  Event Centers/Venues – allowed by conditional use only. o Currently the city ordinance does not allow venues in this district. Lincoln County allows venues as conditional uses just outside the two-mile jurisdiction of the City of North Platte, so the city should probably allow venues closer to city limits. The area within the two-mile jurisdiction is meant to transition to residential, commercial and industrial areas as the city develops. Keeping these uses as conditional uses will allow planning commission and city council the ability to put reasonable conditions on individual applications.  Solar Farms – allowed by conditional use only and must adhere to supplementary regulations o Currently the city ordinance does not allow construction of solar farms. Solar Farms take a large area to make them feasible so allowing them in an A-1 District through conditional use would make sense. Planning Staff is also recommending creating separate regulations for Solar Farms and adding them under Supplementary Regulations. Currently the zoning code does not allow a solar farm or a wind farm at all. She presented suggested zoning regulations but they can be changed. McKeone stated he wonders about hail with a solar farm. Judy stated one of the things the county did was put in a decommissioning portion in there so there would be a way to get it out of there if it did get destroyed by hail or something. Bain stated he feels all of these are a good idea to get something in writing. Attorney Troshynski agrees having something is better than having nothing to provide guidance if something comes forward. Chair Fudge stated he likes them as a conditional use to give this body some say-so and asked about a reasonable next step. Judy suggested the event center and riding stables can come back by next meeting and suggested they may need more time for the others but could perhaps move forward with it all. Attorney Troshynski stated he feels it could all be ready for public hearing at the next meeting. After some discussion it was decided it could come back in September for public hearing. 8.
