JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 A regular meeting of the Council of the City of Norwich was held June 2, 2014 at 7:30 PM in Council Chambers. Present: Aldermen Desaulniers, Noblick, Wilson, Eyberse, Bettencourt, Nash and Mayor Hinchey. City Manager Bergren and Corporation Counsel Michael Driscoll were also in attendance. Mayor Hinchey presided. Ald. Wilson read the opening prayer and Ald. Noblick led the members in the Pledge of Allegiance. Upon motion of Ald. Wilson, seconded by Ald. Nash, it was unanimously voted to adopt the minutes of May 5, 12 and 19, 2014. Upon a motion of Ald. Nash, seconded by Ald. Noblick, it was unanimously voted to accept the communication from the Public Safety Committee. Upon a motion of Ald. Wilson, seconded by Ald. Bettencourt, it was unanimously voted to accept the letter from City Manager Bergren. City Manager Alan Bergren gave his report as followed: DATE: June 2, 2014 TO: Mayor Deberey Hinchey & Council Members FROM: Alan H. Bergren, City Manager SUBJECT: City Manager’s Report 1. Public Works The project to demolish 77 Chestnut Street will be completed this week. Project costs were kept within the contingency budget. Norwich contractor Wiese Construction, Inc. performed the demolition and the project was managed by Public Works. Work to restore the dog pound following damage recently sustained by a fallen tree is scheduled to begin within 1-2 weeks and be completed by the end of June. The restoration costs are approximately $16,000 and are covered in part by City insurance. 2. Police On Friday May 30th Police Officer Sean Sullivan received the “First Responder Hero” award from the American Red Cross at their 2nd Annual Heroes of Southeastern Connecticut at the Mystic Marriott Hotel. The award was presented by Chief Louis Fusaro and Steve Ribeiro Sales Director of Anthem Blue Cross & Blue Shield for the American Red Cross. The Red Cross Hero award was given for Officer Sullivan’s quick action early one morning last August on North Main Street while doing traffic enforcement, when he heard a faint sound of a smoke detector in the distance. Smelling smoke, Officer Sullivan tracked it to a nearby two-story building. Seeing smoke and flames in the second floor he called for back-up and the fire department. He started knocking on doors to alert residents, when a resident of the second floor opened a window and started screaming that his house was on fire and was ready to jump. Officer Sullivan calmed the resident and then forced open a door and located the resident and guided him to safety. Neither the officer nor the resident was injured as a result of the fire. 1 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 3. Fire Due to increased efforts in diversity recruitment for the entry level positions, we are pleased to state that the Norwich Fire Department has 225 candidates enrolled for the next firefighter entrance examination. 4. Volunteers Needed! Volunteers are always needed to fill vacancies on City Boards/Committees/Commissions. For more information and to see a list of current vacancies, minutes from past meetings, specific qualifications (if any) and to fill out an application, please visit the City’s website, www.norwichct.org or call the Mayor’s office at (860) 823-3742. In addition to any Board specific qualifications, volunteers must be current on taxes and resident electors of the City. 5. Citizen Charter Input Citizens can go to the City’s website at www.norwichct.org to submit suggestions or ask questions on charter revision. Upon a motion of Mayor Hinchey, seconded by President Pro Tem Desaulniers, it was unanimously voted to suspend the rules to add the following resolution. WHEREAS, the Council of the City of Norwich, by resolution adopted April 7, 2014 authorized and directed the City Manager, with such assistance as he required, to issue a Request for Qualifications and Proposals seeking a qualified professional manager for the management and operation of the Norwich Ice Rink; and WHEREAS, said Request for Qualifications and Proposals has been issued and the city has received three (3) responses to the same from entities with experience in managing and operating ice rinks; and WHEREAS, the Council of the City of Norwich finds it to be in the best interest of the City of Norwich to pursue an expeditious review and evaluation of these proposals, to select a preferred operator and to attempt to negotiate and draft a lease and/or operations agreement with the preferred operator and present all of the foregoing to the Council of the City of Norwich as soon as practically possible by a resolution or resolutions NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that a committee to consist of the following individuals be and hereby is appointed to review and evaluate the proposals submitted in response to the city’s Request for Proposals and Qualifications, to recommend a preferred operator, and to negotiate and draft, with the assistance of the city manager and corporation counsel, a proposed lease and/or operation agreement, said determinations of this committee to be submitted to the Council of the City of Norwich for its approval by way of a single resolution or multiple resolutions, said submissions to be made no later than the meeting of the Council of the City of Norwich for the month of . The Committee shall consist of: Mayor Hinchey called for citizen comment. 2 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 Rodney Bowie, 62 Roosevelt Ave, stated he hope for a reduction in his taxes. He stated the city can’t keep raising budgets by 2% each year. Bill Champagne, Norwich Historical Society, spoke in favor of the lease in resolution #8 stating it could be an economic driver for Norwich and felt Norwichtown would be the ideal site. Joanne Philbrick, 10 Elm Ave, asked to keep in mind how much the taxpayers can afford when you go through the budget. She spoke on resolution #5 stating that this takes property off the tax roll, vacant land adds no income. Stated on resolution #7 she felt it wasn’t a fair or equitable rental. Her full support to resolution #8 and asked what impact it has on the neighborhood. She felt on resolution #9 this is a disservice to members of this committee. David Crabb, 47 Prospect St opposed to resolution #5 asked why this wasn’t done before the budget calculation. On resolution #8 he thought this was a Board of Education address. Mayor Hinchey declared citizen comment closed. Upon a motion of President Pro Tem Desaulniers, seconded by Ald. Nash, to adopt the following resolution introduced by Mayor Hinchey. Nash, Noblick, President Pro Tem Desaulniers and Mayor Hinchey voting in opposition. Upon a motion to amend of Ald. Noblick, second by Ald. Bettencourt to increase 80012 by $132,834 to add a Laborer and Fire Code Clerk. Ald. Nash asked to split the two positions. Upon a motion to amend of Ald. Noblick, second by Ald. Bettencourt to increase 80012 by $66,324 to add a Laborer. The above amended motion passed with a 4-3 vote with Ald. Nash, President Pro Tem Desaulniers and Mayor Hinchey voting in opposition. Upon a motion to amend of Ald. Noblick, second by Ald. Bettencourt to increase 80012 by $66,510 to add a Fire Code Clerk. The above amended motion passed with a 5-2 vote with President Pro Tem Desaulniers and Mayor Hinchey voting in opposition. RESOLVED, that the budget of the City of Norwich and the City Consolidated District for the Fiscal Year 2014-15 submitted by the City Manager on April 7, 2014, tentatively adopted by the Council of the City of Norwich on May 5, 2014 and as amended by the Council of the City of Norwich by Schedules A and B be, and the same hereby is, adopted. On the City Assessment list of 2013 a tax of thirty-eight and fifty-five hundredths (38.55) mills on the dollar is hereby granted to be levied upon the ratable estate within the City of Norwich of the inhabitants of said City and all others liable to pay taxes therein. Section 2. On the City Assessment list of 2013, a tax of forty-nine hundredths (0.49) mills on the dollar, is hereby granted to be levied for fire services upon the ratable estate within the Town Consolidated District of the inhabitants of said District and of all others in said district liable to pay taxes therein. Section 3. On the City Assessment list of 2013, a tax of seven and thirty-eight hundredths (7.38) mills on the dollar, is hereby granted to be levied for fire services upon the ratable estate within the City Consolidated District of the inhabitants of said District and of all others in said district liable to pay taxes therein. Section 4. Real Estate and Personal Property, shall become due on July 1, 2014, and payable on said date in whole or in equal installments from that date, namely on July 1, 2014 and January 1, 2015 except that any tax of less than one hundred dollars shall be due and payable on July 1, 2014. If the first installment is not paid on or before August 1, 2014 or if the second installment is not paid on or before February 1, 2015, interest will be charged on any such delinquent payment at the rate of one and one-half (1½%) per cent per month from the due date or $2.00 whichever is greater, as provided for in the general statutes. Any person may pay the total amount of such tax for which he is liable at the time when the first installment shall be payable. Section 5. Motor Vehicle taxes shall become due and payable in whole on July 1, 2014. If the payment is not paid on or before August 1, 2014 interest will be charged on the delinquent payment at the rate of one and one- half (1½%) per cent per month from due date or $2.00 whichever is greater, as provided for in the general statutes. Upon a motion of Ald. Noblick, seconded by Ald. Eyberse, it was unanimously voted to adopt the following resolution introduced by City Manager Bergren. WHEREAS, Section 12-165 of the Connecticut General Statutes, as amended by Section 35 of Public Act 13- 276 provides for the administrative procedure for transferring real estate taxes deemed uncollectible to the “suspense” tax book; and, WHEREAS, taxes transferred to the suspense tax book are no longer listed as an asset of the city in its annual financial report; and, WHEREAS, listed below are the names and addresses of the persons against whom certain real estate taxes on the Grand Lists up to and including 2012 were levied and which the Tax Collector believes such taxes are uncollectible because of lack of payment for several years; and, WHEREAS, in accordance with the Tax Collector’s recommendation the aggregate sum of $672,459 in real estate tax on the Grand Lists up to and including 2012, to be transferred to the suspense tax book; and, 11 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 WHEREAS, nothing herein contained shall be construed as an abatement of any tax transferred to the suspense tax account, but any such taxes, as it shall have been increased by interest, penalty fees and charges may be collected; and NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that the aggregate sum of $672,459 representing uncollectible real estate taxes on the Grand Lists up to and including 2012, be and the same hereby are transferred to the suspense account. Nash, seconded by President Pro Tem Desaulniers, it was unanimously voted to adopt the following resolution introduced by Mayor Hinchey. WHEREAS, the R.E. Van Norstrand Neighborhood Assistance Act, Chapter 228a of the Connecticut General Statutes (C.G.S. 12‐630aa‐12‐638) offers certain benefits to municipalities desiring to obtain the same and is administered by the State Department of Revenue Services (Commission of Revenue Services); and WHEREAS, the Neighborhood Assistance Act provides a tax credit for business firms which sponsor local programs; and WHEREAS, such programs must be proposed and conducted by private non‐profit agencies or municipalities and be approved by the local legislative body; 12 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH: A public hearing will be held on June 16, 2014 to review applications and receive comments relative to the Neighborhood Assistance Act. Upon a motion of Ald. Wilson, seconded by Ald. Eyberse, it was unanimously voted to adopt the following resolution introduced by City Manager Bergren. WHEREAS, the City of Norwich has leased a premises at 92 Salem Turnpike, Norwich, Connecticut to Live and Learn, Inc. for several years; and WHEREAS, Live and Learn, Inc. has requested to lease the premises for a further one year term to run from 07/01/2014 – 06/30/2015 at an annual rent of FOUR THOUSAND EIGHT HUNDRED ($4,800) DOLLARS, payable monthly, together with such other terms and conditions as have existed in the prior leases including its obligations to indemnify the City of Norwich as set out in the lease agreement and to maintain general liability insurance satisfactory to the City of Norwich NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that City Manager Alan H. Bergren be and hereby is authorized and directed to enter a lease agreement satisfactory to him and as described herein with Live and Learn, Inc. and to cause a copy of the same to be delivered to Live and Learn, Inc. Upon a motion of President Pro Tem Desaulniers, seconded by Ald. Nash, it was unanimously voted to adopt the following resolution introduced by Mayor Hinchey. WHEREAS, The Norwich Historical Society, Inc. proposes to rent from the City of Norwich the property known as the Daniel Lathrop School located at 69 East Town Street, Norwich, Connecticut for a term of two years to commence June 1, 2014 to be used under its direction as a “Heritage Information Center for Residents and Visitors” and for no other purpose without the written consent of the City of Norwich; and WHEREAS, The Norwich Historical Society, Inc. proposes to pay a rent of ONE ($1.00) DOLLAR per annum due on June 1st of each year during the term and to be responsible for maintaining the interior of the premises, and the City of Norwich to maintain the grounds of the building and to be responsible for snow removal from the parking area; and WHEREAS, the Council of the City of Norwich finds that such a lease arrangement will be in the best interest of the City of Norwich by establishing a central heritage information center in a historic area of the City of Norwich NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that City Manager Alan H. Bergren be and hereby is authorized and directed to enter a lease agreement with The Norwich Historical Society, Inc. satisfactory to him containing standard provisions with respect to 13 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 indemnity and insurance as well as termination in the event of default and to cause a copy of the same to be delivered to the Norwich Historical Society, Inc. Upon a motion of Ald. Nash, seconded by Ald. Noblick, to adopt the following resolution introduced by Ald. Nash, Noblick and Bettencourt. WHEREAS, the Council of the City of Norwich by resolution adopted May 5, 2014 assigned to the Public Safety Committee of the Council of the City of Norwich the obligation to review and evaluate the final report of the Police Station Committee and such other proposals and issues relative to the same deemed to be appropriate by the Public Safety Committee; and WHEREAS, the Public Safety Committee met on May 14, 2014 at which time the Police Station Committee made an oral presentation with respect to its final report, and at which time the Public Safety Committee received information with respect to development of two proposals for a police station to be constructed at the developer’s expense and leased to the City of Norwich; and WHEREAS, by letter dated May 20, 2014 the Public Safety Committee has recommended that the Police Station Committee be reconstituted to consider these two additional proposals using the criteria developed by the Police Station Committee for evaluating proposed locations, layout and the cost of development and construction of the new police station to meet the needs of the Norwich Police Department, the Police Station Committee to report to the Council of the City of Norwich NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that the Police Station Committee of the City of Norwich be requested to supplement its final report with specific evaluations of the two proposals presented to the Public Safety Committee at its meeting on May 14, 2014 using the criteria developed by the Police Station Committee for its evaluations and to report its findings with respect to these proposals to the Public Safety Committee on July 9, 2014 and the Public Safety Committee shall report to the Council of the City of Norwich with respect to the findings on July 21, 2014. The above amended motion passed with vote 7-0. Motion passed. Upon a motion of Ald. Noblick, second by Ald. Nash, it was unanimously voted to go into Executive Session pursuant to Connecticut General Statute Section 1-200(6), for the purpose of discussing the a lease of city property, said lease to include as part of the terms improvements to the existing structure, when publicity regarding such lease and the improvements will cause a likelihood of increasing the cost or diminishing the return property, and to review engineering and feasibility evaluations made for and made by the City of Norwich with respect to the proposes improvements. The following shall be asked to participate during all or portions of this executive session at the request of the City Council: City Manager Alan H. Bergren, Comptroller Joshua Pothier, Deputy Comptroller Anthony Madeira, William Block, Purchasing, Planning Director Peter Davis, Jeff Brining, Engineer Norwich Public Utilities, Corporation Counsel, Michael Driscoll, Doug Roberts, 14 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH JUNE 2, 2014 Manager Norwich Ice Rink, Joann Beguhl, Norwich Ice Rink Authority, Michael Goldblatt, Norwich Ice Rink Authority, Gary Makowicki Norwich Ice Rink Authority, and Cheryl Ritacco, Norwich Ice Rink Authority shall be asked to participate during all or portions of this Executive Session at the request of the City Council. The council was in Executive Session from 8:28 pm to 9:04 pm, at which time Mayor Hinchey, stated no votes were taken. Upon a motion of Ald. Wilson, seconded by Ald. Noblick, it was unanimously voted to return to regular session. Upon a motion of Mayor Hinchey, seconded by President Pro Tem Desaulniers, it was unanimously voted to adopt the following amended resolution. WHEREAS, the Council of the City of Norwich, by resolution adopted April 7, 2014 authorized and directed the City Manager, with such assistance as he required, to issue a Request for Qualifications and Proposals seeking a qualified professional manager for the management and operation of the Norwich Ice Rink; and WHEREAS, said Request for Qualifications and Proposals has been issued and the city has received three (3) responses to the same from entities with experience in managing and operating ice rinks; and WHEREAS, the Council of the City of Norwich finds it to be in the best interest of the City of Norwich to pursue an expeditious review and evaluation of these proposals, to select a preferred operator and to attempt to negotiate and draft a lease and/or operations agreement with the preferred operator and present all of the foregoing to the Council of the City of Norwich as soon as practically possible by a resolution or resolutions NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that a committee to consist of the following individuals be and hereby is appointed to review and evaluate the proposals submitted in response to the city’s Request for Proposals and Qualifications, to recommend a preferred operator, and to negotiate and draft, with the assistance of the city manager and corporation counsel, a proposed lease and/or operation agreement, said determinations of this committee to be submitted to the Council of the City of Norwich for its approval by way of a single resolution or multiple resolutions, said submissions to be made no later than the second meeting of the Council of the City of Norwich for the month of June, 2014. Noblick, seconded by Ald. Bettencourt, it was unanimously voted to adopt the following resolution. WHEREAS, the Council of the City of Norwich by resolution scheduled the second Monday of June 9, 2014, as the date of a regular meeting of the Council of the City of Norwich in the event the budget of the City of Norwich should not be adopted on or before the first Monday in June; and WHEREAS, the Council adopted a budget for the fiscal year 2014-2015 at its meeting on June 2, 2014 NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH, that the additional regular meeting of the Council set and scheduled for the second Monday of June 9, 2014, be and hereby is cancelled.
