JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 A regular meeting of the Council of the City of Norwich was held November 20, 2017 at 7:00 PM in Council Chambers. Present: Mayor Hinchey, Aldermen Nystrom, Philbrick, Braddock, Gould, Martin and Nash. City Manager Salomone and Corporation Counsel Michael Driscoll were also in attendance. Mayor Hinchey presided. Ald. Martin read the opening prayer and Ald. Nash led the members in the Pledge of Allegiance. Ald. Martin asked for a point of personal privilege. He personally thanked the citizens of Norwich, Council Secretary, Corporation Counsel, the City Manager and all the departments and staff. He personally thanked all his colleagues individually wishing them well and stated it was a pleasure working with everyone. Mayor Hinchey called for citizen comment. Shiela Hayes, 382 Laurel Hill Ave, congratulated all the returning council members and thanked Mayor Hinchey, Ald. Braddock and Ald. Martin for their service wishing them good luck. She stated that she looks forward to working with the new council. She hopes that the work that this Council started will be continued. Beryl Fishbone, 19 Bliss Place, thanked Robert and Patricia Dotolo for volunteering to keep the park clean, the Mohegan Park Committee for their hard work, and invited everyone to Earth Day April 22, 2018. She stated the park belongs to everyone and we all should have pride in that. She stated April 27 is Arbor Day and June 2-10 will be trails day. She thank this council for seeing through the challenges. Rodney Bowie, 62 Roosevelt Ave, thanked the council for the effort they put out. David Crabb, 47 Prospect St, talked about propaganda being effective at the beginning of the 20th century targeting women to get more customers, free commercials, magazine ads and the EPA. Glen Carberry, 27 Greenwich Ct, thanked the past Council for their service. He stated his comments are for the new Mayor and Council. He stated he was disappointed with some of the choices made to capital expenditures. He talked about the lack of funding for maintaining our recreational assets such as Dodd Stadium that make Norwich distinguished. He stated we have to keep people in Norwich and encourage growth. Mayor Hinchey declared citizen comment closed. Mayor Hinchey called for a Public Hearing on a AN ORDINANCE TO BE LISTED AS SECTION 2-23 OF THE NORWICH CODE OF ORDINANCES CONCERNING MUNICIPAL ELECTRIC UTILITY COOPERATIVES AND ESTABLISHING THE POSITION OF A MUNICIPAL REPRESENTATIVE TO BE APPOINTED BY THE COUNCIL OF THE CITY OF NORWICH Marvin Serruto, 100 Starr St, spoke in favor of this position and hoped there will be much communication and a lot of reporting. He asked to clarify the qualification. 1 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 Brian Kobylarz, 16 Hobart Ave, talked about the lack of communication and accountability. He stated we need to learn from the past. He stated there needs to be an Ordinance passed for reporting back to the Council with items that effect Norwich. David Crabb, 47 Prospect St, mimicked the last speaker and thinks that there is a lack of communication, we were putting the cart before the horse. He stated that the new members need an updated code of ethics. Joseph L DeLucia, 37 Sherwood Ln, asked what the requirements are going to be for reporting back to the council. He also asked that the Council table the appointment until the new Council takes office. There being no further speakers Mayor Hinchey declared the public hearing closed. Mayor Hinchey called for the second reading and action on AN ORDINANCE TO BE LISTED AS SECTION 2-23 OF THE NORWICH CODE OF ORDINANCES CONCERNING MUNICIPAL ELECTRIC UTILITY COOPERATIVES AND ESTABLISHING THE POSITION OF A MUNICIPAL REPRESENTATIVE TO BE APPOINTED BY THE COUNCIL OF THE CITY OF NORWICH Upon a motion of Ald. Braddock, seconded by Ald. Gould, it was voted to waive the reading of the full text and incorporate it into the minutes. Motion passes on a vote of 6-1 with Ald. Martin voting in opposition. Ald. Philbrick motioned, seconded by Ald. Braddock, to put the following ordinance introduced by President Pro Tem Nystrom on the floor. . Upon a motion of Ald. Martin, seconded by Ald. Nash, it was unanimously voted to amend in subsection #(b) to add section 6 to read: Any Norwich Ratepayer Representative, following initial appointment by the Council of the City of Norwich, shall be required to take and successfully complete the ethics training program then offered to and required of city department heads appointed by the city manager prior to attending any meeting of the cooperative utility board of the Connecticut Municipal Electric Energy Cooperative as the Norwich Ratepayer Representative, and shall be subject to applicable requirements as to additional or continuous ethics training required of such department heads while serving as the Norwich Ratepayer Representative. Motion to further amend by Ald. Nash, seconded by President Pro Tem Nystrom to amend the effective date to January 15, 2018. Motion to amend passes on a vote of 6-1 with Ald. Martin voting in opposition. Motion to further amend by President Pro Tem Nystrom, seconded by Ald. Nash to postpone action January 2, 2018 at 7:30 pm. Above amendment passes on a vote of 6-1 with Ald. Martin voting in opposition. Ordinance as amended is below. 2 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 AN ORDINANCE TO BE LISTED AS SECTION 2-23 OF THE NORWICH CODE OF ORDINANCES CONCERNING MUNICIPAL ELECTRIC UTILITY COOPERATIVES AND ESTABLISHING THE POSITION OF A MUNICIPAL REPRESENTATIVE TO BE APPOINTED BY THE COUNCIL OF THE CITY OF NORWICH WHEREAS, Connecticut Public Act No. 17-73 “An Act Concerning Municipal Electric Utility Cooperatives” was passed by the Connecticut General Assembly and made effective October 1, 2017; and WHEREAS, said Public Act provides that the managing body of a municipal electric utility cooperative shall be a cooperative utility board charged with carrying out the corporate purposes and powers of the municipal energy electric cooperative with representatives to be appointed by each member of a municipal electric utility and by one representative to be appointed by the legislative body of each municipality in which a member of municipal electric utility operates; and WHEREAS, the Board of Commissioners of the Norwich Department of Public Utilities appoints representatives to the Connecticut Municipal Electric Energy Cooperative (“CMEEC”) and the Council of the City of Norwich, pursuant to Public Act No. 17-73 is authorized to appoint a municipal representative to the CMEEC Board. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORWICH Section 2-23 - Norwich Ratepayer Representative to CMEEC (a) Purpose The position of a municipal representative for the City of Norwich to be made pursuant to Public Act No. 17-73, amending Connecticut General Statute (“C.G.S.”) §7-233c of Chapter 101a of the C.G.S., effective October 1, 2017, is hereby established by the Council of the City of Norwich to provide for additional representation for the City of Norwich on the governing body of the Connecticut Municipal Electric Energy Cooperative. This representative shall be appointed to the cooperative utility board of the Connecticut Municipal Electric Energy Cooperative by the Council of the City of Norwich by a resolution duly adopted and the position shall be titled the “Norwich Ratepayer Representative to CMEEC.” (b) Qualifications Any person to be appointed to the cooperative utility board of the Connecticut Municipal Electric Energy Cooperative by the Council of the City of Norwich (the Norwich Ratepayer Representative to CMEEC) shall be: 1) An elector of the City of Norwich; 2) A residential or commercial ratepayer of Norwich Public Utilities, who, at the time of appointment, owes only current residential or commercial utility charges to Norwich Public Utilities and is not delinquent in the payment of any such charges; 3 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 3) An individual who does not hold other official positions in and is not employed by (a) the governing body of Norwich Public Utilities; (b) the City of Norwich; (c) the governing body of any other municipal electric utility which is a member of the CMEEC; (d) any municipality in which any other member municipal electric utility operates, or (e) The Connecticut Municipal Electric Energy Cooperative or any other municipal electric energy cooperative; 4) The qualifications primarily to be considered for the Norwich Ratepayer Representative to CMEEC shall include: a) Professional or other expertise likely to be of assistance to the cooperative utility board in formulating opinions and directions relative to electric procurement and electrical generation strategy, contracting and management; and b) The ability to represent residential and commercial ratepayers of Norwich Public Utilities; and c) The possession of adequate availability, time, and resources to permit preparation and participation in proceedings on the cooperative utility board of CMEEC; and 5) Any Norwich Ratepayer Representative to CMEEC who shall cease to possess any of the qualifications enumerated in subsections 1), 2), and 3) herein shall forthwith forfeit the office, which shall be deemed vacant and the vacancy shall be filled by the Council of the City of Norwich for the unexpired term. 6) Any Norwich Ratepayer Representative, following initial appointment by the Council of the City of Norwich, shall be required to take and successfully complete the ethics training program then offered to and required of city department heads appointed by the city manager prior to attending any meeting of the cooperative utility board of the Connecticut Municipal Electric Energy Cooperative as the Norwich Ratepayer Representative, and shall be subject to applicable requirements as to additional or continuous ethics training required of such department heads while serving as the Norwich Ratepayer Representative. (c) Term of Office and Method of Appointment The Norwich Ratepayer Representative to CMEEC shall be appointed by the Council of the City of Norwich to a two year term commencing as of January 15, 2018 and biennially thereafter. The same person may be reappointed to additional terms. (d) Duties and Responsibilities The Norwich Ratepayer Representative to CMEEC shall exercise all powers and carry out all duties and responsibilities established and provided for in Chapter 101a of the Connecticut General Statutes as amended by P.A. No. 17-73 and as they may be amended from time to time. 4 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 (e) Compensation and Reimbursement The Norwich Ratepayer Representative to CMEEC may receive such salary or compensation and expense reimbursement as may be determined by the CMEEC by-laws for each meeting of the cooperative utility board or committee thereof actually attended, or as otherwise may be provided for in said by-laws or this ordinance, and said sum shall be payment in full for such services. Such representatives shall receive no salary, compensation or expense reimbursement from the City of Norwich. Any conflicting ordinances of the City of Norwich notwithstanding, CMEEC may reimburse such representatives for expenses for travel, both within and without the state, incurred in connection with services as a designated representative on such board. (f) Effective Date This ordinance shall take effect ten (10) days following its publication in a newspaper having general circulation in the City of Norwich following passage. Upon a motion of Ald. Gould, seconded by Ald. Braddock, it was unanimously voted to accept the letter of resignation of Linda Bertelson from the Ethics Commission thanking her for her service. Upon a motion of Ald. Gould, seconded by Ald. Braddock, it was unanimously voted to accept the letter of resignation of Margaret Aldrich from the Senior Affairs Commission thanking her for her service. Mayor Hinchey publicly read a letter from the United States Department of Justice commending Lt. John Perry for his exemplary contribution regarding his community policing in Norwich. Ald. Philbrick presented Mr. and Mrs. Robert Dotolo with a certificate of appreciation for keeping Mohegan Park trash free. Upon a motion of Ald. Gould, seconded by Ald. Martin, it was unanimously voted to accept the letter from the Ethics Commission. City Manager’s Report: To: Mayor Hinchey and members of the City Council From: John Salomone, City Manager Subject: City Manager’s Report Date: November 20, 2017 Congratulations to Peter Nystrom our newly elected mayor; Stacy Gould, Joanne Philbrick and Bill Nash for winning re-election and newcomers Stephanie Burnham, Joe DeLucia and Samuel Browning. The official swearing in ceremony will take place on Tuesday, December 5th at 7:30 pm with a reception immediately following. Board of Education members will also be sworn in that evening. The Mayor and I continue our weekly meetings. 5 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 I had a phone interview with Joey Bourgoin from WTIC regarding the state budget effects on local communities. I attended the Southeastern CT Council of Governments and Southeast Area Transit (SEAT) Board of Directors meetings on November 15th. I did a phone interview with Kevin Gordon of WICH regarding the upcoming sale of 80 Broadway for the proposed “Food Hall” which is an exciting project for the downtown. Dispatcher negotiations were held on Friday, November 17th. The City received a copy of a proposed financial commitment letter from Betsy Crum of the Women’s Institute, the developer of the Reid & Hughes building on Friday, November 17th. I had a conference call with members of the Women’s Institute, Corporation Counsel and staff. A discussion was held regarding the proposed financing of the stabilization phase. We will be continuing the discussion in another conference call this week. Cat’s Meow City Hall figures have arrived and are for sale in the Clerk’s Office for $15. All profits will benefit the Light Up City Hall event which will be held on First Friday December 1st. I would also like to thank Steve and Joan Eaton, and John and Mary Johnson for their tree donations for the City’s holiday festivities. Mayor Hinchey called for citizen comment on resolutions. Stephanie Burnham, 26 Cedar Ln, spoke on resolution #8 and thanked the Council for finding a full time Recreation Director. David Crabb, 47 Prospect St, spoke on resolution #8 stating the benefits for two positions are 24% of the total amount for each position. He asked to suspend until the next budget. Mayor Hinchey declared citizen comment on resolutions was closed. Upon a motion of President Pro Tem Nystrom, seconded by Ald. Gould, it was unanimously voted to put the following resolution introduced by Mayor Hinchey on the floor. Upon a motion of Ald. Braddock, seconded by Ald. Gould it was unanimously voted to send a referral to the Commission on the City Plan. Upon a motion of Ald. Philbrick, seconded by Ald. Gould it was unanimously voted to bring it back at the December 18, 2017 at 7:30 pm meeting. WHEREAS, the Council of the City of Norwich, by resolution adopted August 21, 2017, directed City Manager John Salomone to offer the properties at 80 and 68 Broadway (map 102, block 2, lots 38 and 39, respectively) to parties interested in acquiring and developing these properties through a Request for Proposal process, any interested parties being required to accept all of 6 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 the conditions and obligations imposed with respect to the properties pursuant to the deeds and other instruments recorded in the city land records; and WHEREAS, the Council directed the Request for Proposal to require any proposals to be submitted not later than October 20, 2017; and WHEREAS, the city received two timely proposals which were presented to the Council of the City of Norwich for its review; and WHEREAS, the Council of the City of Norwich extends its thanks to both parties for their interest and efforts in responding to the Request for Proposals; and WHEREAS, the Council of the City of Norwich finds it to be in the best interest of the City of Norwich to accept the proposal of the LeWitt Group of 3 Rockwell Terrace to acquire both properties for a total price of $131,300 subject to the city and the LeWitt Group reaching a satisfactory agreement concerning the development and transfer of the properties; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that, it tentatively accepts the proposal of the LeWitt Group with respect to 68 and 80 Broadway subject to reaching a satisfactory agreement with it with respect to the development and transfer of the properties; and BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that, City Manager John Salomone be and hereby is authorized and directed to negotiate an agreement with the LeWitt Group containing such terms and conditions as he believes to be appropriate with respect to the development, use, and the conveyance of said properties and to present the same to the Council of the City of Norwich in a timely fashion for its review and approval. Upon a motion of Ald. Philbrick, seconded by Ald. Braddock, it was unanimously voted to adopt the following resolution introduced by Ald. Gould. WHEREAS, the City of Norwich acquired the property known as 11 Lake Street (map 93, block 6, lot 44) through a tax foreclosure with title conveyed to the City of Norwich by a Certificate of Foreclosure on April 8, 2017 which Certificate was recorded April 27, 2017 in volume 3011 at page 90 of the Norwich Land Records; and WHEREAS, on February 6, 2017 the property was appraised as a having a fair market value of $35,000 in connection with the foreclosure, the land valued at $10,000 and improvements at $25,000; and WHEREAS, various parties have expressed an interest in acquiring the property; and WHEREAS, the Council of the City of Norwich finds it to be in the best interest of the City of Norwich to attempt to dispose of this property by a negotiated sale using the services of Allyn and Associates Realtors listing the property at a price to be recommended by Allyn and Associates Realtors; 7 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that, City Manager John Salomone be and hereby is authorized and directed on behalf of the City of Norwich to enter into a Real Estate Listing Agreement satisfactory to him and the corporation counsel with Allyn and Associates Realtors offering to sell the property at 11 Lake Street at a proposed sale price recommended by Allyn and Associates Realtors; and BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that, upon receipt of a Purchase and Sales Agreement containing a proposed price to be recommended by Allyn and Associates Realtors and containing such price, terms, and conditions as are satisfactory to him, City Manager John Salomone shall be and hereby is authorized and directed to notify the Council of the City of Norwich the proposed Purchase and Sales Agreement which may approve the same and authorize him to enter into the Purchase and Sales Agreement on behalf of the City of Norwich and, upon timely tender of the purchase price subject to standard adjustments, to execute and deliver a deed of conveyance for the property known as 11 Lake Street, Norwich, and to execute, receive, and deliver such other documents as are necessary to complete the transfer of title in keeping with the terms of the Purchase and Sales Agreement. Upon a motion of Ald. Gould, seconded by Ald. Martin, it was unanimously voted to adopt the following resolution introduced by Ald. Gould. WHEREAS, the City of Norwich became the owner of property known as 347 Central Avenue (map 87, block 1, lot 67) through a Committee of Sale Deed recorded September 29, 2016 in volume 2981 at page 298 of the Norwich Land Records; and WHEREAS, the fair market value of the property at the time the sale was ordered was found to be $45,000, $10,000 for the land and $35,000 for the building; and WHEREAS, after the city took title to the property it was required to apply for an execution of ejectment to cause the building to be vacated and there has been damage to the same; and WHEREAS, the Council of the City of Norwich finds it to be in the best interest of the City of Norwich to appoint a committee to review the condition of the property, to consider whether its size, location, and condition will allow it to be sold as is, and to make a recommendation to the Council regarding an appropriate disposition of the property; and WHEREAS, following such review should the committee intend to recommend the property be sold in “as is” condition the committee is to formulate an approach for selling the property, identify a proposed purchaser or purchasers of said property and recommend the same to the council in its report; NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that, a committee to be known as the “347 Central Avenue Committee of Sale” consisting of: Alderwoman Stacy Gould Sofee Noblick Gary Schnip Tucker Braddock Jim Heist 8 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 be and hereby is established and those listed herein are appointed as the 347 Central Avenue Committee of Sale to review the condition of the property and to make a recommendation to the Counc8il of the City of Norwich, as to disposing of the property, but if its recommendation is to sell the property in “as is” condition it is to identify a prospective purchaser or purchasers for the property and to make a recommendation or recommendations with respect to any proposed sale of the property to the Council of the City of Norwich for its consideration and approval; and BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF NORWICH that, City Manager John Salomone be requested to provide the assistance of City Building Official James Troeger to the committee as an ex officio member of the same. Upon a motion of Ald. Braddock, seconded by Ald. Gould, it was unanimously voted to adopt the following resolution introduced by President Pro Tem Nystrom, Ald. Gould and Braddock. Gould motioned, seconded by Ald. Braddock, to amend to substitute a new resolution #8. Motion to amend passes with on a vote of 6-1 with Ald. Martin voting in opposition. Relative to amending the 2017-18 General Fund Expenditure budget adopted on June 12, 2017 WHEREAS, Section 265(a)(3) of June Special Session, Public Act No. 17-2 enables the Council of the City of Norwich to “make transfers between accounts without having to follow the same process by which the original budget was adopted, provided such transfers are approved by the affirmative vote of a majority of such municipality's legislative body”; and WHEREAS, the City Manager recommends making certain changes to the 2017-18 expenditures budget to eliminate layoffs and offset these costs with projected savings in other areas of the budget. Braddock, it was unanimously voted, to set a public hearing on December 4, 2017, 7:30 pm for the second reading and action for the following ordinance introduced by City Manager Salomone. AN ORDINANCE REVISING THE MOTOR VEHICLE MILL RATE IN ORDINANCE #1748 CONCERNING THE TAX LEVIES ON THE LIST OF OCTOBER 1, 2016 WHEREAS, Section 699(c) of June Special Session, Public Act No. 17-2 enables the Council of the City of Norwich to revise the motor vehicle mill rate on the assessment year commencing 11 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 October 1, 2016 in accordance with the increase in the motor vehicle mill rate cap in Section 699(a) of June Special Session, Public Act No. 17-2; and WHEREAS, the increase in the motor vehicle mill rate cap necessitates a supplemental rate bill for the increase in the motor vehicle tax levy. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORWICH THAT ORDINANCE #1748 BE AND HEREBY IS AMENDED AS FOLLOWS: Section 1. On the City Assessment list of 2016 a tax of forty and fifty-two hundredths (40.52) mills on the dollar is hereby granted to be levied upon the ratable Real Estate and Personal Property within the City of Norwich of the inhabitants of said City and all others liable to pay taxes therein. Section 2. On the City Assessment list of 2016 a tax of thirty-nine (39.00) mills on the dollar is hereby granted to be levied upon the ratable Motor Vehicles within the City of Norwich of the inhabitants of said City and all others liable to pay taxes therein at the maximum mill rate established and allowed by the Connecticut General Statutes applicable on Motor Vehicles for the City Assessment list of 2016 or at the applicable mill rates established in Sections 1, 3, and 4 of this tax levy ordinance, whichever is the lesser. Section 3. On the City Assessment list of 2016, a tax of fifteen hundredths (0.15) mills on the dollar, is hereby granted to be levied for fire services upon the ratable Real Estate and Personal Property within the Town Consolidation District of the inhabitants of said District and of all others liable to pay taxes therein. Section 4. On the City Assessment list of 2016, a tax of eight and twenty-two hundredths (8.22) mills on the dollar, is hereby granted to be levied for fire services upon the ratable Real Estate and Personal Property within the City Consolidation District of the inhabitants of said District and of all others liable to pay taxes therein. Section 5. Real Estate and Personal Property taxes shall become due on July 1, 2017, and payable on said date in whole or in equal installments from that date, namely on July 1, 2017 and January 1, 2018 except that any tax of less than one hundred dollars shall be due and payable on July 1, 2017. If the first installment is not paid on or before August 1, 2017 or if the second installment is not paid on or before February 1, 2018, interest will be charged on any such delinquent payment at the rate of one and one-half (1½%) per cent per month from the due date or $2.00 whichever is greater, as provided for in the general statutes. Any person may pay the total amount of such tax for which he is liable at the time when the first installment shall be payable. Section 6. The first installment of Motor Vehicle taxes consisting of 32 mills shall become due and payable in whole on October 1, 2017. If the payment is not paid on or before November 1, 2017 interest will be charged on the delinquent payment at the rate of one and one-half (1½%) per cent per month from due date or $2.00 whichever is greater, as provided for in the general statutes. 12 JOURNAL OF THE COUNCIL OF THE CITY OF NORWICH NOVEMBER 20, 2017 Section 7. The second installment of Motor Vehicle taxes consisting of 7 mills shall become due and payable on January 1, 2018. If the payment is not paid on or before February 1, 2018 interest will be charged on the delinquent payment at the rate of one and one-half (1½%) per cent per month from due date or $2.00 whichever is greater, as provided for in the general statutes.
