Michael Schaefer presented and stated that no erosion and sediment
controls were in place when the project was started 3-4 years ago, resulting
in sediment migrating off-site onto the abutting neighbor’s property.
Michael Schaefer stated that on January 7, 2009, he had visited the site and
all off-site cleanups had been performed as required. Michael Schaefer
explained that the permit before the Commission tonight involved
remediation, grading, stabilization, and the proposed housing units to build
out the previously approved site plan. Michael Schaefer stated that the site
bond is still in place, and that he has issued a department memo to the
Building Official and Zoning Enforcement Officer that no CO or CZC be

1. IW-VIOL – 07-01- 81 Corning Rd- Kudlach- update
Michael Schaefer reported that he had visited the site from the Kudlach

relatively minor and involved little if any wetland. Michael Schaefer noted
that Mr. Kudlach has until January 15 to apply for the after-the-fact permit,
and that he contacted Mr. Kudlach today to remind him. Michael Schaefer
stated that if Mr. Kudlach does not comply, he would refer the matter back
to Army Corp of Engineers.
