LAST REVISED 1/9/2009 11:30 AM CITY OF NORWICH INLAND WETLANDS, WATERCOURSES AND CONSERVATION COMMISSION January 8, 2009 Regular Meeting Minutes Lower-level Conference Room 23 Union Street Norwich Connecticut Agenda Items A, B & C – Call To Order, Roll Call, Determination Of Quorum: Chairman Baribeault called the meeting to order at 7:00 p.m. Present: Raymond Baribeault Richard Morell Douglas Lee Jeremiah Lowney Arthur Sharron, Alt. Brandon Hyde, Alt. Absent: Robert McCoy, Alt. Absent w/ notification: Barbara Rothstein Ralph Page Also Present: Michael Schaefer City Planner and Tianne Phoenix Curtis, Recording Secretary A quorum was present and all members present were voting. D. Minutes: Upon motion by Richard Morell and second by Arthur Sharron, the Commission voted unanimously to APPROVE the minutes of the January 8, 2009 regular meeting. E. Communications: Michael Schaefer submitted his letter to Mr. Kudlach and Wetland related mailings. F. Public Hearings: None G. Old Business: 1. IWWCC-08-08 – 8 Wisconsin Avenue – Re-Application of Norwich Woods Apartments, LP II for the construction of a multifamily complex and associated site amenities and off-site drainage. Michael Schaefer presented and stated that no erosion and sediment controls were in place when the project was started 3-4 years ago, resulting in sediment migrating off-site onto the abutting neighbor’s property. Michael Schaefer stated that on January 7, 2009, he had visited the site and all off-site cleanups had been performed as required. Michael Schaefer explained that the permit before the Commission tonight involved remediation, grading, stabilization, and the proposed housing units to build out the previously approved site plan. Michael Schaefer stated that the site bond is still in place, and that he has issued a department memo to the Building Official and Zoning Enforcement Officer that no CO or CZC be issued until all site work has been completed. Furthermore, Mr. Schaefer LAST REVISED 1/9/2009 9:44 AM noted his main concern is keeping the repaired site in stabilized condition. Upon motion by Richard Morell and second by Doug Lee, the Commission voted unanimously to APPROVE IWWCC#08-08. H. New Business: None I. New Business items submitted after agenda preparation and prior to the submission deadline. - None J. Other Business: Michael Schaefer stated that he had been in contact with FERC relative to the recently approved Algonquin Gas application #08-05, and that he will be observing periodically at his discretion. Richard Morell questioned the status of the Hilltop at Edgewood project relative to site runoff. Michael Schaefer responded that he has been actively involved with the site, however the issues involved appear out of the purview of the Planning and Development Office. Additionally, the matter has been referred to Corporation Counsel. K. Violations: 1. IW-VIOL – 07-01- 81 Corning Rd- Kudlach- update Michael Schaefer reported that he had visited the site from the Kudlach property and determined the extent of non-permitted activities appear relatively minor and involved little if any wetland. Michael Schaefer noted that Mr. Kudlach has until January 15 to apply for the after-the-fact permit, and that he contacted Mr. Kudlach today to remind him. Michael Schaefer stated that if Mr. Kudlach does not comply, he would refer the matter back to Army Corp of Engineers. L.
