It was determined there was a quorum.
D. Minutes:
Upon motion by Richard Morell and second by Doug Lee, the Commission voted
unanimously to APPROVE the minutes of the November 5, 2009 regular meeting.

1. IWWCC#09-03 – 168 Corning Road – Application of Mark Fields on behalf of
David A. Lewis, Sr. for the filling, grading and construction of a multifamily
housing complex.
Michael Schaefer recommended the Commission make a motion to table
the application to the 2/4/2010 regular meeting in order to schedule a Public
Hearing. Michael Schaefer stated that the Applicant is seeking a permit to
fill potholes, created by prior excavation of the site, and have since
intercepted groundwater. Upon motion by Richard Morell and second by
Barbara Rothstein, the Commission voted unanimously to TABLE the
application to the 2/4/2010 regular meeting, and, due to the amount of
wetland filling proposed, to set a public hearing for the same date.
2. SP#09-06 – 70 (a.k.a. 66-78) Town Street Floodplain Referral – Application
of Gas Development, LLC for Sec.14.6 Construction within a Floodplain and
waiver of Flood Impact Study (Sec.14.6.3 (b))
Michael Schaefer stated to the Commission that the application was before
them as a Floodplain referral from the CCP, and that the applicant is
requesting a waiver of a detailed Flood Impact Study. Appearing before the
Commission was Tim Bates of Robinson & Cole, Civil Engineer Kent

Staffier and Soil Scientist Dean Gustafson both of VHB. Mr. Bates made a
brief presentation and stated that the proposal includes the razing of the
existing structures and the construction of an updated 5-pump fueling
station. Mr. Staffier noted the location of the floodplain along the rear and
side property lines and stated that the 160 c.f. of proposed fill area would
be compensated by approximately 250 c.f. of compensatory flood storage,
as well as an improved stormwater treatment system. The Commission
had no further questions of the applicant or Staff. Upon motion by Richard
Morell and second by Doug Lee, the Commission voted unanimously to
GRANT the request for a recommendation to the CCP for a waiver of Flood
Impact Statement. In reaching their decision, the Commission made the
determination that the application as proposed was minor in nature and
would not negatively impact the flow or storage capacity of the floodplain.

unanimously to adjourn at 7:22 pm.
