DRAFT CITY OF NORWICH ZONING BOARD OF APPEALS March 10, 2009 Meeting Minutes The regular meeting of the City of Norwich Zoning Board of Appeals was called to order at 7:00 p.m. Roll call was taken and it was determined that a quorum was present. PRESENT: Marc Benjamin, Chairman Joseph Jacaruso, Vice Chairman Dorothy Travers Henry Olender Paul Kramarewicz Santo Rizzuto, Alternate ABSENT: Raymond Dussault, Alternate ALSO PRESENT: Paulette Craig, Zoning Enforcement Officer Darlene Papineau, Recording Secretary ~~~~~ E. COMMUNICATIONS Chairman Marc Benjamin presented a letter received from Dieter & Gardner addressed to the Board. ~~~~~ F. ACCEPTANCE OF MINUTES On a motion by Kramarewicz/Rizzuto, it was voted unanimously to accept the January 13, 2009 meeting minutes as corrected. (Page 6 of 6 to amend Travers/Travers to Travers/Jacaruso.) ~~~~~ G. OLD BUSINESS None H. NEW BUSINESS #V-09-03 Appeal of Elaine Malchman for property at 555 Norwich Avenue, located in an ID zone district. In accordance with Sec. 12.1, northerly side yard setback, 25’ required to be reduced to 20’ in order to construct 2nd story landing/stairs. 1 of 3 Seated were, Marc Benjamin, Joseph Jacaruso, Dorothy Travers, Henry Olender, and Paul Kramarewicz. Ms. Craig entered into the record as Exhibit “A”, the application, as “B”, public notices of 02/25/09 & 03/04/09; as “C”, abutters’ notices; as “D”, Assessor’s street card; as “E”, GIS map; and as “F”, applicant’s sketch. Speaking in favor of the application was Daniel Malchman of 45 Royal Oaks Drive, Norwich. He told the Board that the City and State Fire Marshals require the proposed fire escape. The same person owns the property that abuts this property. Mr. Malchman stated there was a fire escape there years ago where an existing door is and it had deteriorated so this would be a replacement and the only logical place to rebuild it. There being no other speakers, the public hearing was closed. ~~~~~ I. DISCUSSION/DECISION ON APPLICATIONS #V-09-03 Appeal of Elaine Malchman for property at 555 Norwich Avenue, located in an ID zone district. In accordance with Sec. 12.1, northerly side yard setback, 25’ required to be reduced to 20’ in order to construct 2nd story landing/stairs. Seated were, Marc Benjamin, Joseph Jacaruso, Dorothy Travers, Henry Olender, and Paul Kramarewicz. The Board discussed the hardships and determined it is required by the Fire Marshals office, it’s the most logical area and there was an escape there for egress which is just being replaced. #V-09-03 Appeal of Elaine Malchman for property at 555 Norwich Avenue, located in an ID zone district. In accordance with Sec. 12.1, northerly side yard setback, 25’ required to be reduced to 20’ in order to construct 2nd story landing/stairs - APPROVED J. OTHER MATTERS Correspondence from Dieter & Gardner, Inc. to Zoning Board of Appeals dated March 4, 2009 regarding Appeal of Naranbhar Patel, #V-07-09 On a motion by Rizzuto/Benjamin, it was unanimously voted to enter into Executive Session. At 8:15 pm, on a motion by Benjamin/Jacaruso, it was unanimously voted to close Executive Session. Minutes were not taken during Executive Session. On a motion by Benjamin/Rizzuto it was unanimously voted to forward communications relative to Executive Session to Corporation Counsel for recommendations. Page 2 of 3 K.
