Call to order: 7:00 pm
1. 109 Jackson Avenue. Upper Nyack Views, LLC.
Continuation of application for window replacement and deck repair.
APPLICATION APPEARS ON AGENDA FOR ADJOURNMENT PURPOSES ONLY.
2. 53 Route 59, NY Fuel Distributors LLC.
Continuation of application to demolish existing building and gas pump canopy and re-
locate on site.
APPLICATION APPEARS ON AGENDA FOR ADJOURNMENT PURPOSES ONLY.
3. 17 North Franklin Street. Boxer Donut.
Application for a sign on brick façade of building adjacent to entry door and
perpendicular sign above sidewalk, attached to a post in the middle of the sidewalk.
Building Inspector Review:
The size of the signage would comply with the zoning code, however, the following variances
are required from:
Article IV, VON §360-4.11E(1)(c)[1] for a parallel sign not on the fascia band above the store
window or on the window:
Article IV, VON §360-4.11E(1)(b)[1] for a perpendicular sign not protruding from the plane of the
building;
And from 2020 Building Code of New York State, Chapter 32, “Encroachment Into Public Right
of Way” for proposed sign post in middle of sidewalk.
Board Review Based Upon:
1. The application.
2. Building Inspector review
3. Testimony of applicant Eric Brown
4. ARB members’ knowledge of the site
5. Site visits by members
6. No testimony from the public

1. The Building Inspector and applicant agree to take the parallel sign on the brick façade off
the application. Only the perpendicular sign will be discussed.
Conclusion:
1. Having no comment by the public, the public hearing is closed on a motion by Member
Robertson, seconded by Member Healey, approved by a vote of 5-0.
2. Motion by Member Steinhorst to approve the application with the condition that the sign will
be at least ¾” thick and have a matte finish. Seconded by Member Buckley, approved by a
vote of 5-0.
4. 82 Main Street. Robert Silarski for Temptations.
Application for exterior alterations including signage and gooseneck lighting.
Building Inspector Review:
Proposal complies with zoning requirements.
Board Review Based Upon:
1. The application.
2. Building Inspector review
3. Testimony of applicant’s architect Robert Silarski
4. ARB members’ knowledge of the site
5. Site visits by members
6. Testimony from the public
Board Findings:
1. Applicant states that the signage band depicted in the elevation did not reproduce true to
the intended color which will be similar to the color of the existing brick facade.
2. Applicant would like the option to install three to five gooseneck light fixtures.
Conclusion:
1. Having no comment by the public, the public hearing is closed on a motion by Member
Robertson, seconded by Member Healey, approved by a vote of 5-0.
2. Motion by Member Robertson to conditionally approve the application. The board requests
to see a rendering that shows the proposed signage true to color and with details like the
drop shadow not showing on the submitted drawing to be reviewed by two members via
email.
The board also requests to limit the light fixtures to four (4) to avoid excessive light in the
area. Seconded by Member Healey, approved by a vote of 5-0.
