1. 11 Central Avenue North. Joseph Bruno. Application to build dormered porch and replace
siding.

Board discussion:
Applicant seeking to make changes in 3 parts: Add covered porch/entryway, add two dormers in roof,
and remove and replace siding & trim. New siding will be taupe colored hardie board. Dormers and
porch/entryway face south towards middle of lot. Entryway/porch has open roof peak with window
pattern to add light.

entrance on Main St. Sign mounted with brackets drilled into wall.

3. 84 North Franklin Street. Rockland Garden Apartments. Application for signage.
Application presented by: Krystal Gutierrez
Board discussion:
Application is to erect monument type sign on lawn of Rockland Garden Apartments. Sign has brick
columns on side and gray panel sign face. Sign is in excess of 12 feet wide and 5 feet tall. Sign as
presented will face Sickles Ave. Sign to have uplighting from the lawn illuminating the sign during
nighttime hours. Sign as proposed would require ZBA variance as this type of sign is not allowed in MFR-
1 district. Presenter stated this sign is a HUD requirement. The point was raised that this property has
been a HUD property for many years without a sign.
Board objects to the size and style of the sign. It does not match character of the village nor fits into
acceptable sign criteria. Also location does not seem to make sense, not logical to have Franklin St
address on a sign that is on Sickles Ave .

Stated:The sign would be a hazard. Proposed location does not make sense. Sign is too big. Children
play in this area. Kids forced to play in the driveway. Doesn’t think the lights should be on all night.

Stated: Temporary sign there now is a problem
Sign in the yard is not safe for children and in front of peoples windows.

Stated: Temporary sign keeps falling over. Location of proposed sign is obnoxious. Not safe for kids
who play in the area. It is a safety issue.
Decisions are made without consulting tenants of the building. Fixing the problem after something
happens is too late.

Stated: Objects to the size of the proposed sign, as well as the lighting proposed and being on all night.
Daughter’s window overlooks the sign where the lights would be on. Confused why the sign would be
in this location on sickles, which is a small street, and create a blind spot for drivers turning onto and off
of sickles. Sign as proposed is unsafe, kids play here.

Stated: Supports comments made by previous public speakers. Is a volunteer firefighter, and the sign in
this location would be a hazard for the fire dept, in the way of where to put equipment. No reason for
this locations. Adress is not on sickles. Sign doesn’t work out, doesn’t fit.
Bob Monterro, property owner 10 sickles Ave (across street)
Stated: Sign is too big. Who is it directed to? Points to sickles ave, only people who already live here
would see it. Proposed sign is too big and doesn’t fit look. A more sensible sign on Franklin, where the
main entrance is, seems to make more sense, and make it more tasteful and fit the accepted Nyack look.
Sickles is a narrow street, and the sign as proposed would create a traffic hazard. Kids play in the area of
the sign. Proposes making a playground in the location instead.
Regina Hill
Stated: Lived in other HUD housing locations, never had a sign like this. Other places have a small sign at
the main entrance with the name, address and phone number. Residents of the building don’t need a
sign telling them where they live. Anything extra is unnecessary.
Conclusion:
All board members present object to size and location of sign as well as lighting scheme.
Applicant is requested to come before board with a different kind of sign, in a different location, reduced
size and different lighting scheme. Sign needs to be scaled down and more in line with accepted style of
sign as per Nyack village code.
ARB does not recommend project for ZBA approval
4. 135 Main Street. M&T Bank. Application for signage.

Board discussion:
Application is for replacement / addition of multiple signs as well as awnings for M&T Bank rebranding
including 3 signs on each of 3 sides of the building; one on Main St, one on Franklin Ave and one on
driveway entrance / Artopee Way. Main St and Artopee Way signs are same size and location as
existing. Franklin St sign is new. Awnings over both entrances (Main St & Artopee Way) are to be
replaced with new fabric, same size and color, only without any branding / name / text of any kind. In
addition, application is to replace multiple, parking advisory blade signs, traffic signs, and plaques over
drive thru on building. These latter signs are going to be same size or smaller than original. Also
applying for addition of decals on entryway doors. Application will need to go before ZBA to request
variance for exceeding maximum number of signs allowed. Lighting is to remain as is.
Addition of new sign on Franklin St seems unnecessary and is not that visible to traffic, due to angles of
streets / intersection and building.

Application accepted with condition that applicant remove one of proposed larger signs on sides of
building.( any 1 of the 3) Remaining signs and awning are acceptable as is.

5. 189 N Midland Ave. Jennifer Davenport. Application to replace windows and doors.

Applicant seeking to replace front door and windows. Replacing windows due to drafty /poorly
insulated condition. Attic window to be 6 pane. Basement windows to be replaced with hopper
windows. Front door to have 10 lite with storm and frosted windows, and window to the side to be new
ornamental window.

Applicant seeking approval of freestanding pool deck on one side of above ground pool. Deck to be
constructed entirely of pressure treated wood including supports, decking and railing. Deck has stairs
with gate at top. Size is approx 8’ X 10’. Deck will be on west side of pool.

7. 14 Depew Avenue. Robert Silarski. Application to restore and expand existing house damaged
by fire, erect new two-car garage and change of use from a single-family to a two-family dwelling

Board discussion:
Applicant seeking to restore fire damaged building, with expansion of second story over existing
extension in back of building while keeping existing footprint, plus addition of 2 car garage. Garage has
hip roof to keep low profile. Siding will be Cedar shingle throughout, similar to what existed on second
floor before fire. Bay window details to be restored. New rooflines to meet with existing, no height
addition.

8. 128 Main Street. Pal & Frank Real Estate LLC. Application for addition and alterations to existing
restaurant/retail building to include second floor roof deck and 3-story addition to include 12
apartments.

Board discussion:
Applicant presented plan to alter current building with removal of false front above 1st floor restaurant
on corner of Main St & Bridge St and add rooftop deck for patrons. In addition, the plan proposes
replacement of single story storefronts to the north along Bridge St with a 4 story 12 unit apartment
building.
The proposed apartments exceeds Nyack village code for maximum height, maximum density and does
not allow for any parking, which also violates village code.
The presenter provided little information regarding the actual materials, look or details of the building.
The board raised concerns that the proposed building lacks cohesiveness to the surrounding
buildings.The proposed use of painted stucco covering the entire façade as well as the use of casement
windows is dissimilar to existing structures in the immediate area. In addition, the board objected to
the occupant capacity of the apartment building without addressing any parking. The board also
expressed concern regarding the height of the building and its overall lack of character. The board had
no objection to the rooftop seating area above the restaurant.

Conclusion:
Board rejects application as presented and asks the applicant to revise the plan to reduce the occupancy
and size of the building, add architectural features and materials that will make it fit in with the
surrounding buildings and add a plan to accommodate parking.
