COVID-19 PANDEMIC STATUS~ IN PERSON. Meeting opened by the Chair at 7:00 pm.
Conflict Check: The Chair polled the members of the Board regarding the issue of possible conflicts of
interest regarding any of the applications. There were none.
The Clerk/Secretary to the Planning Board provided draft minutes of the October 7, 2024
meeting to the members of the Planning Board. There were no corrections and the
Clerk/Secretary to the Planning Board of the Village of Nyack was hereby authorized, directed
and empowered, by the Planning Board, to sign these Minutes, and to file a copy thereof in the
office of the Village Clerk.
1. 14 Depew Avenue. Robert Silarski. Site Plan application to restore and expand existing
single-family home damaged by fire and erect new one-car garage amending previously
approved design.
The applicant’s architect, Robert Silarski, presented to the Planning Board. A new GML from
Rockland County Planning has been received. Mr. Silarski is asking for the same Planning
Board considerations that they were given before. The house has been reduced in size as
well as the size of the garage. The only override of the County comments is the tandem
parking.
The Acting Chair opens for public comment. Hearing none, she moves to close. This is
seconded by Catherine Friesen. Vote passed 4-0.

Village Planner
The Planning Board received the GML review from Rockland County Planning dated June 11,
2024. Applicant’s response to Rockland County Planning’s GML comments dated June 15,
2024 provided. Applicant’s revised Narrative reflected the revised plans and provided to the
Planning Board. All variances required to permit the restoration as illustrated in the submitted
drawings were granted by the Zoning Board of Appeals at their May 20, 2024 meeting. The
proposed action remains a Type II action.
A revised site plan resolution reflecting the changes made in the amended plans has been
provided to the Planning Board. Since the Planning Board has received the County Planning
GML, the Board can consider and approve the site plan resolution.
Summary of changes made to the amended site plan – Following changes have been made: 1)
rebuild and vertically expand the single-family to two-family residence; and 2) convert the
proposed two-car garage to one-car garage. The 2-car garage will be reduced from 22’x 24’ to
16’ x 24’. This smaller garage will reduce the impact on neighboring properties. The house’s
footprint is again proposed to remain unchanged and the south facing façade will be
replicated. The existing single-story-addition at the west, previously approved to be extended
to two-stories, will now remain a single-story at the request of the neighbors to the west. The
single-story additions at the north side of the house will still be increased to two stories to
permit the addition of a small office (in lieu of the third bedroom previously approved) and an
ensuite bathroom at the upper floor level.
The overall height of the new construction will be increased by 2’-10” primarily to create an
8’-0” ceiling at the lower level, which has an existing ceiling height of 6’-11”, as well as to
incrementally increase the ceiling heights at the main and upper levels to 9’-0” and 8’-0”
respectively.
2. 52 Jefferson Street. Dorothea Erichsen. Site Plan application to raise the roof of existing
detached garage to add more storage space and relocate existing second floor deck stairs.
Carmen DeLaCruz from Jorge Lopez Architects is representing this application. She states
that this is a two-story, two-family house located in the TFR Zoning District. Applicant is
looking to raise the roof of the garage by 3.3 feet to allow more storage. The ground floor
level will also be used for storage. The owner and tenants will continue to park on the
existing driveway as they have been doing previously. The façade will remain the same.
The Chair polls the board. There were no comments or questions. Jennifer Knarich opens
for public comment. Hearing none, she makes a motion to close public comment.

Catherine Friesen makes a motion to approve the Site Plan initially dated 4/18/24 with a
revision date of 8/26/24 to restore and expand the existing garage. Matthew
Croussouloudis seconds this motion. Vote passed 4-0.
3. 199 Depew Avenue. Joe Brady-Amoon. Site Plan application to remove one-story rear
addition and replace it with a large one-story addition and covered porch.
Kier Levesque, Architect, represents this application. It was approved by the ARB on
September 18, 2024. They are removing a single- story addition and adding a two-story
addition expanding the kitchen and adding a powder room on the first floor. The proposed
action is a Type II action under NYS DEC 617.5 (c) (11) “construction or expansion of a single-
family, a two-family or a three-family residence on an approved lot” and, therefore, no
further SEQRA review is necessary. There are no impacts.
Jennifer Knarich polls the Board. There were no comments or questions. Jennifer Knarich
opens for public comments. Hearing no comment, she closes public comment. The motion
is seconded by Peter Voletsky.
Matthew Croussouloudis makes a motion to approve Site Plan for 199 Depew Avenue dated
7/2/24. This is seconded by Catherine Friesen. Vote passed 4-0.
Village Planner
The owner of the property is Mr. & Mrs. Joe Brady-Amoon. The applicant is represented by
Mr. Kier Levesque, architect. The 4,719.66-sf subject property is located at 199 Depew Avenue
on the south side of Depew Avenue, approximately 100’ from the intersection of Depew
Avenue and Crosby Street in the TFR zone. The property has an existing single-family residence
with a detached garage. The Applicant is seeking site plan approval to remove a rear addition
and construct a larger one-story rear addition with a covered porch; replace front porch
jalousie windows with double hung windows; and replace roof and front steps.
The Project received ARB approval on 9/18/24. There are no variances required for the
Project. Rockland County Planning provided a GML letter dated 10/21/24 indication no
impacts.
Applicant’s Narrative dated 7/8/24
The Project consists of the following, remove a 1 story rear addition and replace it with a larger
156 sf addition and covered porch in order to expand the kitchen and add a full bathroom. The
work at the front porch will be to remove old jalousie windows and replace with new double
hung windows matching the style of the existing. The roof and the front steps and walk will be
replaced.

SEQRA – The proposed action is a Type II action under NYS DEC 617.5 (c) (11) “construction or
expansion of a single-family, a two-family or a three-family residence on an approved lot” and,
therefore, no further SEQRA review is necessary.
LWRP – based on the Village Code, as a Type II action, this is consistent with LWRP policies.
Recommendation – There does not appear to be any issues relative to site plan approval by the
Planning Board.
4. 292 North Midland Avenue. Giuseppe Pagano. Continuation of application for the
subdivision of two lots.
Jay Greenwell and Giuseppe Pagano are representing this application. They have addressed
the Village Engineer report and will repair and replace macadam curb. There is less than
10,000 sq ft of disturbance. Will install drywells. There will be a new application for
individual site plans for Lot #1 and Lot #2. Have provided landscape plan. Lot will be split
down the middle and each of the two lots will require small lot width area variances. If they
constructed a two-family residence, there would be no variance required. The two lots are
more than adequate, just slightly narrow. The single-family residences and size of the lots
are more consistent with the neighboring properties. The Village Engineer comments have
been addressed.
Jennifer Knarich polls the Board for comments. Hearing none, she opens for public
comment.
Brian McNulty of 87 Front Street states that the homes will fit in perfectly in the
neighborhood. He is concerned about two large locust trees on the property being damaged
by excavation. He is concerned that trees will be compromised and potentially fall. Also
concerned about drainage systems and drywells.
Jay Greenwell states that any area of disturbance will be at least 30 feet from each Locust
Tree and will receive tree protection measures.
Bob Galvin states that the Village Engineer specified “tree protection” as part of the
subdivision plat.
Jennifer Knarich asks Bob Galvin to develop a Negative Declaration. She makes motion to
hold meeting open to the next Planning Board Meeting on Monday, December 2 nd at 7:00
pm in Nyack Village Hall. This is seconded by Matthew Croussouloudis.

Village Planner
The 11,812-sf subject property is located on the west side of North Midland Avenue,
approximately 250’ north from the intersection of North Midland Avenue and Sixth Avenue. This
is an application for a minor, 2 lot subdivision of 292 N Midland Avenue, located in the Two Family
Residential (TFR) zone. Applicant proposes to subdivide this over-sized parcel into equally sized
lots of 5,906-sf each. Applicant proposes to construct a single-family residence on each lot in
keeping with the character of the surrounding neighborhood. The proposed Lot 1 is vacant; the
proposed Lot 2 has an existing 1 ½ brick dwelling The Project will entail demolition of the existing
home and removal of three large Pine trees in the front of the proposed Lot 2 to allow for the
construction of the new single-family home.
SEQRA – the proposed minor subdivision is an Unlisted action under SEQRA. The ZBA is an
involved agency since the Project requires an area variance. The Planning Board staff will need
to circulate the GML and Notice of Intent (NOI) to be Lead Agency and will need to wait 30 days
before declaring its status as Lead Agency. The Planning Board assumed Lead Agency status at its
October meeting.
The OPRHP has already provided a letter of OPRHP (SHPO review) that no properties, including
archaeological and/or historic resources, listed in or eligible for the New York State and National
Registers of Historic Places will be impacted by this project.
DEC’s experience has shown that these kinds of actions do not have a significant adverse effect
on the environment, and the preparation of an EIS will not provide better explanation or
understanding of impacts nor provide the reviewing agency with significant additional authority.
Most of the typical impacts can easily be managed during subdivision or site plan review but
would require a formal Negative Declaration to close out SEQRA.
LWRP – Applicant has completed Coastal Assessment Form. Staff will comment as part of the
Neg Dec for this Project.
Recommendation – a draft Neg Dec can be provided by the Village Planner for the review and
consideration of the Planning Board at its December meeting. Similarly, a draft resolution can
also be provided for the December meeting.
The Acting Chair closed the meeting ended at 7:40 pm.
