Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday December 12, 2019 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Marie Lorenzini Trustee Donna Lightfoot-Cooper Trustee Elijah Reichlin-Melnick Trustee ALSO PRESENT James Politi Village Administrator Walter Sevastian Village Attorney Jennifer Hetling Village Clerk/Treasurer Meeting called to order at 7:30pm Pledge of Allegiance Moment of Silence - Gerald Inman Adoption of Minutes November 14, 2019 Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to accept the motion as presented. Motion passed by a vote of 4 – 1 abstain. Public Comment - None Action Items Resolution No. 2019 – 85 Resolution of the Nyack Village Board to accept the Audited Voucher Summary #20 Motion by Elijah Reichlin-Melnick, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 86 Resolution of the Nyack Village Board to approve the Annual Menorah Candle Lighting Ceremony Motion by Marie Lorenzini, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by unanimous vote. Resolution No 2019 – 87 Resolution of the Nyack Village Board to approve the 2020 Music on the Hudson dates of June 30, July 7, July 14, July 21, July 28, August 4 and August 11 Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 88 Resolution of the Nyack Village Board to approve a bond resolution for $500,000 related to Culvert Improvements Motion by Louise Parker, seconded by Elijah Reichlin-Melnick to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019 – 89 Resolution of the Nyack Village Board to approve the 2020 meeting dates Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2019-90 Resolution of the Nyack Village Board to approve the collective bargaining agreement with Local 363 of the IBEW, AFL-CIO for the term of June 1, 2017 through December 31, 2021 Motion by Louise Parker, seconded by Marie Lorenzini to open the resolution as presented for discussion. Motion passed by unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to table the resolution. Motion passed by unanimous vote. Resolution No, 2019-91 Resolution of the Nyack Village Board to appoint Marie Lorenzini as a Village of Nyack Marriage Officer Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by a vote of 4 – 1 abstain (Trustee Lorenzini). Public Comment Drew Burke – Stated that former Housing Authority Board members have a binder stating that board members that have missed 3 or more meeting cannot stay on the board. Stated that there is canine excrement on the sidewalk on South Broadway near the business of Strawberry Place. Margaret Amoder – Fourth Ave. has snow emergency parking regulations that were not enforced during the last storm. The road is not getting properly plowed because of the illegal parking. There is also a lot of illegal parking including blocked driveways and parking in a no parking zone. Nick DelPizzo – Asked the board to rename the Veteran’s Memorial Park to the Jerry Donnellan Veteran’s Memorial Park. The Nyack Rotary Club did major renovations for this park and the Rotary supports this proposal. Proposed that if the idea is approved he would like a plaque placed in the park on the Memorial Day weekend. Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – Has been spending a lot of time reviewing the Discovery for Justice Act of 2019 as it relates to Village prosecutions. Worked with the South Nyack attorney regarding parking regulations Request for executive session regarding pending litigation. Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to approve the executive session. Motion passed by unanimous vote. Resident Donald Roth has had some issues related to housing with the building department and they have been working with him. Village Administrator – Presented the Infrastructure Projects & Program Updates as well as the Recreation Department Report and Parks Commission Report. Met with Tony Keys of Nyack Housing regarding the requested speed bumps. The traffic engineer reviewed the request of a speed bump on Depew Ave. and will need more time to come up with a recommendation. The tree grant work will be starting on Monday December 16, 2019. Village Clerk – Treasurer – Presented the semi-annual financial report. The rental fees for 90 Depew Ave will be looked at and presented at the next meeting. Commission and Authority Reports to the Board of Trustees Water Commission - Parks Commission – Nyack Housing Authority – Old Business Communications Request from Scott Baird to give free parking in the Artopee lot to the Farmer’s Market vendors on Thursdays until 3pm in January and February 2020 A resolution will be added to the next agenda for this request Recycling Service press release The statement will be added onto our website and through social media. Resignation letter from Maggie McManus of the Architectural Review Board The board will be looking for new candidates for this board. Motion to accept the resignation of Maggie McManus by Donna Lightfoot-Cooper, seconded by Louise Parker. Motion passed by unanimous vote. Request from the Nyack Hunger Coalition to host “Resolution Run 4” on January 4th, 2020 from 9am to 11am Motion by Louise Parker, seconded by Louise Parker to approve the Resolution Run 4. Motion passed by unanimous vote. New Business To consider renaming Veteran’s Memorial Park to Jerry Donnellan Veteran’s Memorial Park. Village Attorney stated that the Village has a prohibition against naming a Village Park after a current or former employee. The board agreed that a plaque could be placed in the Veteran’s Memorial Park and a dedication could be done on Memorial Day weekend. Public Comment Drew Burke – Found a candidate for the Housing Authority and suggested she contact the Mayor. Comments from the Village Board of Trustees Elijah Reichlin-Melnick – The Nyack Center is taking toy donations. Marie Lorenzini – None Louise Parker – Has been working with Anngela Vasser-Cooper to provide help with the 2020 Census and the outreach to local seniors. Donald Hammond – On December 10, 2019 the school district made an agreement with Montefiore Nyack Hospital for the use of McCalman Field for a parking lot. A statement will be added to the minutes regarding the Board’s position on the issue. He has met with the Village Attorney about the zoning code and some items will be coming up in the future. Donna Lightfoot-Cooper – Attended the Nyack Housing Authority Board. She would like better communication with their staff. The last Nyack Housing Authority Board meeting was unprofessional because of the arguments between board members. Moment of Silence – Jamal Ladson Executive Session Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to move to executive session at 9:00pm. Motion passed by unanimous vote. Motion by Marie Lorenzini, seconded by Donna Lightfoot-Cooper to exit executive session at 9:45pm. Motion passed by unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Elijah Reichlin-Melnick to untable resolution 2019-90. Motion passed by unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to approve resolution 2019-90. Motion passed by unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Elijah Reichlin-Melnick to approve Donald Yacopino’s withdraw from the IBEW union. Motion passed by unanimous vote. Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to approve the Conditions of Employment Agreement with Donald Yacopino. Motion passed by unanimous vote.
