Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday February 27, 2020 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Marie Lorenzini Trustee ALSO PRESENT Walter Sevastian Village Attorney James Politi Village Administrator Jennifer Hetling Village Clerk/Treasurer ABSENT Elijah Reichlin-Melnick Trustee Meeting called to order at 7:30pm Pledge of Allegiance Adoption of Minutes February 13, 2020 Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by a vote of 4 – 1 (Trustee Reichlin-Melnick absent) Public Comment - Action Items Resolution No. 2020 – 13 Resolution of the Nyack Village Board to approve the Nyack Housing Authority 2020-2021 budget (tabled from the February 13, 2020 board meeting) Resolution No. 2020 – 17 Resolution of the Nyack Village Board to accept the Audited Voucher Summary #-2020 Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a vote of 4 – 1 (Trustee Reichlin-Melnick absent) Resolution No. 2020 – 18 Resolution of the Nyack Village Board to award the boat charter concession TO Belloster, LLC d/b/a Nyack Boat Charter Motion by Marie Lorenzini, seconded by Louise Parker to accept the motion as presented. Discussion: Attorney Sevastian explained the proposal. Trustee Lorenzini voiced her opinion on the past practicesof the Nyack Boat Charter regarding signage and business practices. The contract will be updated to include a clause stating no signage without Village approval and if the payment is not made by the first week of the month there will be a penalty. Motion passed by a vote of 4 – 1 (Trustee Reichlin-Melnick absent) Resolution No. 2020 - 19 Resolution of the Nyack Village Board to award the contract for Construction Administration and Inspection for the Broadway TAP Project to HVEA Engineers. Motion by Louise Parker , seconded by Donna Lightfoot-Cooper to table the motion as presented. Motion passed by a vote of 4 – 1 (Trustee Reichlin-Melnick absent) Motion by Donald Hammond, seconded by Louise Parker to appoint Jennifer Knarich to the position of planning board alternate. Motion passed by a vote of 4 – 1 (Trustee Reichlin-Melnick absent) Motion by Marie Lorenzini, seconded by Donna Lightfoot-Cooper to appoint Laurie Steinhorst to the position of architectural review board alternate. Motion passed by a vote of 4 – 1 (Trustee Reichlin- Melnick absent) Motion by Marie Lorenzini, seconded by Donna Lightfoot-Cooper to set a public hearing on March 12, 2020 at 8:15pm to review the fines as they relate to the boar launch fees. Public Comment Drew Burke – The last Housing Authority board meeting was short and he is concerned that some of the members of the board took time to talk amongst themselves after the meeting rather than have a discussion during the meeting. The dog leash requirement is not being adhered to in the park. There was someone selling items in the park which is not allowed and should be addressed. Joe Hazucha – The zoning board denied his request to hang a banner with the constitution on his building and he is upset with the outcome. He asked what else could be done to which Attorney Sevastian stated he would have to file a appeal with the zoning board. Gary Collennis – Asked why the memorial banners are ok but the constitution banner was not to which Attorney Sevastian stated one is public and another is private. Litney Burns – The process with the zoning board is painful. She asked why the YMCA and the Nyack Library can put signs on their property but they could not put the constitution banner on theirs. Attorney Sevastian stated that in the zoning code there are regulations as to what can and cannot be done and if your signage falls within the code then an appearance in front of the zoning board is not required. Mayor Hammond stated that Mr. Hazucha has to follow the processes of the zoning board. Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – There was a public hearing on the hospital garage structure at the Architectural Review Board meeting. It was a good discussion between the ARB, public and the applicant. Motion by Louise Parker, seconded by Donna Lightfoot-Cooper for an executive session regarding litigation. Motion passed by a vote of 4 – 1 (Trustee Reichlin-Melnick absent) Village Administrator – The CDBG Committee has met and will continue to meet to develop ideas. Presented the Infrastructure Projects and Programs Update (attached) There was a water main break that impacted a home by flooding it. Some of the issue may have been the road and he has met with an Orangetown official to discuss such. Village Clerk – Treasurer – Presented an event/invitation listing for the board to review. Requested to set upcoming budget workshops. Commission and Authority Reports to the Board of Trustees Water Commission - None Parks Commission – None Nyack Housing Authority – None Old Business Communications New Business Public Comment Comments from the Village Board of Trustees Marie Lorenzini – None Elijah Reichlin-Melnick - Absent Louise Parker – Joined the Historical Society of Nyack. At the last meeting they asked if the Village could move the Cynthia Hesdra sign from Piermont and Depew to Piermont and Hudson. Stated that the Housing Authority does not list the action items on the agenda and asked what is legally required. Attorney Sevastian stated that it is a policy decision of what to include on the agenda. Donald Hammond –Its very important to get all the Village residents to fill out the upcoming census forms. The plastic bag ban goes into effect on March 1, 2020. Orange & Rockland put out a consumer fraud alert. Jim and the Mayor will be meeting with the Nyack Center about their budget request. . Donna Lightfoot-Cooper – Looking forward to the meeting between the Housing Authority Board and the Village Board.
