Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday March 26, 2020 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Elijah Reichlin-Melnick Trustee Marie Lorenzini Trustee ALSO PRESENT Walter Sevastian Village Attorney James Politi Village Administrator Jennifer Hetling Village Clerk/Treasurer Meeting called to order at 7:30pm Pledge of Allegiance As we continue to address our respective challenges associated with COVID-19, Village government continues to operate. And as there are matters the Village must continue to address as part of keeping the Village operational, our March 26, 2020 Village Board meeting remains as scheduled. As Village Hall is closed, the meeting will have to be held remotely (see below). We will be keeping the Agenda (see posting on website) to essential items. On March 7, 2020, in Executive Order No. 202.1, Governor Cuomo suspended certain provisions of the Open Meeting Law to permit a Village Board to meet and take actions authorized by law without permitting in public in-person access and authorizing such meeting to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed. The Village will be activating a remote meeting platform for the March 26th Village Board meeting, which will enable residents to phone in and listen to the meeting in compliance with the Executive Order. In the interests of the public's health and safety, the Village Board strongly encourages residents to utilize this platform. The information for accessing the meeting as it happens are set forth below, and are also are posted on the Village website. Adoption of Minutes - None Action Items Resolution No. 2020-25 Resolution of the Nyack Village Board to set a public hearing on April 6, 2020 at 7:30pm regarding the 2020-2021 budget Motion by Marie Lorenzini, seconded by Louise Parker to accept the motion as presented. Motion passed by unanimous vote. Public Hearing – Community Development Block Grant Motion by Donna Lightfoot-Cooper, seconded by Marie Lorenzini to open the public hearing at 7:38pm. Motion passed by unanimous vote. Village Administrator, James Politi, explained that there is only 1 census track for CDBG funding this year. The CDBG committee looked at road and sidewalk work as possibilities. The Committee determined that they would recommend road paving on Hudson Ave. from S. Broadway to Franklin Ave. and selective sidewalks along the same road. Resident JC Brotherhood, asked for clarification on the proposal and if it would include wayfinding which Mayor Hammond said it would not. JC Brotherhood stated that any improvements Motion by Donn Lightfoot-Cooper, seconded by Louise Cooper to close the public hearing at 7:47pm. Motion passed by unanimous vote. Motion by Donald Hammond, seconded by Marie Lorenzini to accept the recommendation by the CDBG committee. Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – He suggested a public hearing be set for April 6, 2020 at 7:30pm to consider a passing a local law to override the 2% tax cap. Motion by Louise Parker, seconded by Marie Lorenzini to set a public hearing on April 6, 2020 at 7:30pm to consider overriding the 2% tax cap. Village Administrator – None Village Clerk – Treasurer – None Commission and Authority Reports to the Board of Trustees Water Commission - None Parks Commission – None Nyack Housing Authority – None Communications Comments from the Village Board of Trustees Marie Lorenzini – Applauded the Board and staff for keeping the community up to date and Village business moving along to which the other board members agreed. Elijah Reichlin-Melnick – Louise Parker – Donald Hammond – - Announced that the upcoming workshops and public hearing on the 2020-2021 budget will be done via Zoom video conference. - He has had 3 conference calls with the Village merchants so far and will continue to work with the community. The next one is scheduled for Monday March 30, 2020 at 4pm. - A staff member at Village Hall has tested positive for COVID-19. - On Saturday there will be a community pot-banging to show support for the hospital staff. Donna Lightfoot-Cooper – Public Comment JC Brotherhood - stated that the COVID-19 testing center at Good Samaritan Hospital is very efficient. Adjournment Motion by Marie Lorenzini, seconded by Elijah Reichlin-Melnick to adjourn the Village Board meeting at 8:01pm. Motion passed by unanimous vote.
