Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday April 8, 2021 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Joseph Rand Trustee ALSO PRESENT James Politi Village Administrator Walter Sevastian Village Attorney Jennifer Hetling Village Clerk/Treasurer ABSENT Marie Lorenzini Trustee Meeting called to order at 7:32pm Pledge of Allegiance As we continue to address our respective challenges associated with COVID-19, Village government continues to operate. And as there are matters the Village must continue to address as part of keeping the Village operational, our April 8, 2021 Village Board meeting remains as scheduled and was held remotely. We will be keeping the Agenda (see posting on website) to essential items. On March 7, 2020, in Executive Order No. 202.1, Governor Cuomo suspended certain provisions of the Open Meeting Law to permit a Village Board to meet and take actions authorized by law without permitting in public in-person access and authorizing such meeting to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed. The Village will be activating a remote meeting platform for the April 8th Village Board meeting, which will enable residents to phone in and listen to the meeting in compliance with the Executive Order. In the interests of the public's health and safety, the Village Board strongly encourages residents to utilize this platform. The Village Board appreciates your patience and understanding during this difficult and evolving situation. Please be sure to check in on the Village website for updates which will be posted on an ongoing basis. Adoption of Minutes – March 25, 2021 - Motion by Louise Parker, seconded by Joe Rand to accept the motion as presented. Motion passed by a vote of 3-1-1 (Trustee Lightfoot-Cooper abstain, Trustee Lorenzini absent) Public Comment – None Action Items - Resolution No. 2021 – 28 Resolution of the Nyack Village Board to submit an application for funding from the Rockland County 2020 Community Development Block Grant program Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a vote of 4-0-1 (Trustee Lorenzini absent) Public Comment – None Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – Request for an executive session for building department personnel – Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to approve the executive session. Motion passed by a vote of 4-0- 1 (Trustee Lorenzini absent) Village Administrator – Today was the first round of 2nd COVID shots and it went very well. There will be 2 more days of 2nd shots in the coming weeks. The attorney for Nyack Hospital contacted him and asked if the hospital could contact Mike Gallante (at their expense) to talk about the site plan application and traffic plan. Village Clerk – Treasurer – Request for a public hearing for a local law to go above the tax cap. Motion by Donald Hammond, seconded by Louise Parker. Motion passed by a vote of 4-0-1 (Trustee Lorenzini absent) Old Business Request from Davis Elites to hold football practice in Memorial Field on Monday, Wednesday and Fridays from March 26 – December 24 from 5pm – 730pm for approximately 60 people at a time. They are a non-for-profit entity. – The board denied this request based on size of group and length of time requested Letter from Joe Nilan regarding parking on Depew Ave – This request has been reviewed in the past but it could be a safety issue so the board will bring it up during their meeting with the fire department. Request from Nyack Boat Charter for a license addendum – The board needs more information so that the legal exposure as it relates to insurance can be reviewed. Communications Request from Nadav Hershko of Brix ‘N Ale for a waiver of the 30 day NYSLA notice – The board requested that they get a waiver from the church which is located next door before they will allow the waiver Correspondence from the Nyack Library – winner of the 2020 Joseph F. Shubert Library Excellence Award Invitation from DEC’s Hudson River Estuary Program to host the Climate-adaptive Design Studio – The board agreed to allow this event. Public Comment – None Comments from the Village Board of Trustees Joseph Rand – The spring fling has started but Easter Sunday did not have a big turnout. The ywill be back out on Sunday. Louise Parker –. None Donna Lightfoot-Cooper – None Donald Hammond – Thanked Louise Parker for helping with the pop-up vaccination center. Executive Session – Motion by Joe Rand, seconded by Louise Parker to enter into executive session at 8:28pm. Motion passed by a vote of 4-0-1 (Trustee Lorenzini absent) Motion by Donna Lightfoot-Cooper, seconded by Joe Rand to adjourn executive session at 8:41pm. Motion passed by a vote of 4-0-1 (Trustee Lorenzini absent) Adjournment – Motion by Joe Rand, seconded by Louise Parker to adjourn the meeting at 8:42pm.
