Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday June 24, 2021 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Marie Lorenzini Trustee ALSO PRESENT James Politi Village Administrator James Slaughter Village Administrator Walter Sevastian Village Attorney Lise J Chanin Village Clerk/Treasurer ABSENT Joseph Rand Trustee Meeting called to order at 7:30pm Pledge of Allegiance As we continue to address our respective challenges associated with COVID-19, Village government continues to operate. And as there are matters the Village must continue to address as part of keeping the Village operational, our May 27, 2021 Village Board meeting remains as scheduled and was held remotely. We will be keeping the Agenda (see posting on website) to essential items. On March 7, 2020, in Executive Order No. 202.1, Governor Cuomo suspended certain provisions of the Open Meeting Law to permit a Village Board to meet and take actions authorized by law without permitting in public in-person access and authorizing such meeting to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed. The Village will be activating a remote meeting platform for the May 27th Village Board meeting, which will enable residents to phone in and listen to the meeting in compliance with the Executive Order. In the interests of the public's health and safety, the Village Board strongly encourages residents to utilize this platform. The Village Board appreciates your patience and understanding during this difficult and evolving situation. Please be sure to check in on the Village website for updates which will be posted on an ongoing basis. Adoption of Minutes – June 10, 2021 - Motion by Donald Hammond, seconded by Louise Parker to accept the motion as presented. Motion passed by a unanimous vote. Public Comment – None Action Items - Resolution No. 2021 – 41 Resolution of the Nyack Village Board to Accept the Audited Voucher Summary #9=2021 Motion by Donald Hammond, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021 – 40 Resolution of the Nyack Village Board to allow Rivertown Films to show films in Memorial Park on Saturday, July 17, 2021 (Rain Date July 18, 2021); Saturday July 24, 2021 (Rain Date July 18, 2021); and Saturday August 14, 2021. Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Village Motion passed by a unanimous vote. Public Comment – Andrea DeVitta reported that bushes at the corner of Main & Piermont were creating a sight hazard and need to be trimmed. Also requesting that something be done about the speeding on Burd Street, perhaps a speed bump. James Slaughter was asked to work on potential solutions. Richard Skipper reported to the Board about his efforts, along with Joyce Bulifant, on getting Helen Hayes home Pretty Penny designated as a Literary Landmark. They were hoping to have several events, including screening of Helen Hayes’ film works. The effort will be self-funded, and Mr. Skipper hoped the Board would support their efforts., Mayor Hammond advised that as the planned events get close they should meet with the Village to plan logistics, Department Reports to the Board of Trustees Orangetown Police Department – Trustee Lightfoot-Cooper requested that OPD be made aware of that there seems to be an increase if people running the stop signs on Hudson & Franklin. Village Attorney – Walter Sevastian 1. Governor Cuomo has rolled back restrictions at the local level, but allowing local governments to make their own requirements. 2. The State Liquor Authority plans to allow the extensions into the right of way to continue, 3. The Mayor brought a request from former State Senator Carlucci that the Village consider requiring contractors looking to bid on Village projects have an apprentice agreement, which could be a revision to the Village’s Procurement Policy. The Village Attorney to prepare a Resolution. 4. Resolution to have James Slaughter signer on all Village Accounts will be prepared for the July 2021 Meeting 5. Reviewing Building & Water Fees 6. Retail Sales and Onsite Consumption of Marijuana will come in by default if there is no opt-out resolution. He pointed out that a Local Law could be subject to referendum. The Work Session on 9/9/2021 was designated to a public session. Village Administrator – James A Slaughter 1. He has been working with McLaren Engineering after the upcoming Bid Opening on what the best options are, depending on the base bid. 2. Now that the Parking ticket amnesty is over, they are pursuing the remaining scoff laws, 3. Work continues on the Main Street Water Main & the Safe Routes Projects. 4. Finances for the LED project has been approved. 5. Working on scheduling Mandatory Certification courses. Village Clerk – Treasurer – None Communications Sustainability Committee memo—Mayor Hammond & James Slaughter to schedule a work session to review. Liquor Licensing Waiver for Breakfast & Burger Club-Resolution needed. Nyack Chamber of Commerce requests to hold an Exotic Car Show on August 5, 2021 (Rain Date August 19, 2021). They released the previously reserved dates for July 22, 2021 (Rain Date July 29, 2021) Louise Parker moved the Board approve the change, seconded Marie Lorenzini and was carried unanimously. Public Comment – Comments from the Village Board of Trustees Louise Parker – the NAACP is hosting a Back to School event and is soliciting sponsors and donations of school supplies. The NAACP also expressed some concern about the how the affordable housing component of the projects on Main St & Midland Ave. are going to be awarded. Leases are reviewed and must meet requirements. Donna Lightfoot – Painting of the sidewalks for Juneteenth was a great success. Marie Lorenzini --Nothing Donald Hammond – Executive Session –Louise Parker moved to move into Executive Session seconded by Marie Lorenzini, motion carried unanimously. Adjournment –
