Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30pm on Thursday July 8, 2021 at Nyack Village Hall, 9 N. Broadway, Nyack, New York Hon. Dr. Don Hammond Presiding: PRESENT Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Marie Lorenzini Trustee Joseph Rand Trustee ALSO PRESENT James Slaughter Village Administrator Walter Sevastian Village Attorney Lise J Chanin Village Clerk/Treasurer Meeting called to order at 7:30pm Pledge of Allegiance Mayor Don Hammond announced the recent passing of the Nyack Water Commissioner, Ross Daily. A resolution acknowledging his service to the Village of Nyack will be enacted in his honor in an upcoming meeting. A moment of silence was observed. Adoption of Minutes –June 24, 2021 - Motion by Donald Hammond, seconded by Marie Lorenzini To accept the motion as presented. Motion passed by a unanimous vote. Public Comment – Discussion of Action Items Only – 3 Minute Time Andrea DeVitta, 26 Burd Street requested clarification on the scope of the CBDG grant application as to the improvements being done as part of the grant. Would there be a reduction of macadam and more grass or provide more handicapped parking. Those items will be addressed in a Master Plan for Memorial Park. Action Items: Resolution No. 2021 –43 Resolution of the Nyack Village Board to appoint James Slaughter as Village Administrator Motion by Donna Lightfoot-Cooper, seconded by Louise Parker to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021 –44 Resolution of the Nyack Village Board appointing James Slaughter as signatory on all Village Accounts. Motion by Donald Hammond, seconded by Louise Parker to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021-45 Resolution of the Nyack Village Board authorizing the submission of the CBDG grant application. Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021-46 Resolution of the Nyack Village Board Amending the Procurement Policy. Motion by Louise Parker, seconded by Joseph Rand to accept the motion as presented. Motion passed by a unanimous vote. Resolution No. 2021-47 Resolution of the Nyack Village Board approving the Abstract of Audited Claims #10-2021as presented by the Village Clerk-Treasurer. Motion by Donald Hammond, seconded by Louise Parker to accept the motion as presented. Motion passed by a unanimous vote. Public Comment – Department Reports to the Board of Trustees Orangetown Police Department – None Village Attorney – Walter Sevastian 1. The opt-out/in for the Marijuana deadline is December 31, 2021.The following issues are still not clearly defined and the Board will need to give consider the impacts: How is on site consumption going to work, would it be similar to a cigar bar; How will the licensing work, similar to liquors; How much Local Control will there be, will the Village need to create a Cannabis Control Board? He advised the Board to consult with the Planner to examine these issues. There will be a special work session at the September 9, 2021 meeting. 2. Village Administrator – James Slaughter 1. He will address the lack of notice on the capital projects He will talk to H2M to get a clear schedule as to when work will be done so the Village can notice the public of street closings in advance rather than the day of. 2. There will be a water Shut off on July 12 to complete the Main hookup by the CSX tracks 3. Paving on Depew will be covered by Cost Sharing with Orange & Rockland & CHIPs funding 4. NYSDOT will be paving Route 59 from Route 303 to Route 9W. 5. The Building Department currently has 40 permit applications in progress, Field inspections are being done on 249-259 Main Street. 6. ARPA funding for Local Government has been awarded. There will be 2 Payments, one this year and one next year. 7. Working the Departments to review the existing contracts. Village Clerk – Treasurer – None Communications Nyack Library thanked the Village’s assistance with the American Library Association Libraries Transforming Communities Grant Rockland County Department of Transportation requested that a total of six parking spaces at two locations on South Franklin Street be eliminated to allow for new layover locations for the TOR busses that will not be able use the current location due the pending supermarket project being put in.- request was denied. Request from Lorna Levitin to hold a wedding ceremony for approximately 100 attendees in Memorial Park.-request was denied. . Public Comment – Andrea DeVitta asked if there were any plans for the River Club. Mayor Hammond thought there might be an RFP for a Restaurant. She also reported that there was a large crowd of people hanging out near the Restaurant on Burd St between hour of 12:00 AM and 3:00 AM. She played a recording to the noise. – The Village Board advised that residents contact the police when these events occur. They will consider what measures that they can take to address the issue. Comments from the Village Board of Trustees Louise Parker –The NAAPC is requesting that Depew Avenue be closed between Franklin & Depew Manor Entrance for their Back to School Event on August 28, 2021. A motion to approve the closure was moved by Mayor Hammond, seconded by Trustee Rand and was carried unanimously. Donna Lightfoot-Nothing Marie Lorenzini –The July 4th Fireworks were a great success, but the Fire Commissioners were concerned about the traffic control after the event. Joseph Rand –There needs to be a policy in place to handle events in Memorial Park. He will work on a proposal to address. Executive Session –Donna Lightfoot -Cooper moved to move into Executive Session at 9:37 pm seconded by Joseph Rand, motion carried unanimously. Adjournment – Donna Lightfoot-Cooper moved to adjourn the meeting in honor Ross Daley at 9:38 pm, seconded by Louise Parker, the motion carried unanimously.
