Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, September 9, 2021. Pledge of Allegiance Present Dr. Don Hammond Mayor Louise Parker Trustee Donna Lightfoot-Cooper Trustee Marie Lorenzini Trustee Joseph Rand Trustee Also Present: James Slaughter Village Administrator Lise J Chanin Village Clerk Treasurer Walter Sevastian Village Attorney Adoption of Minutes – August 12, 2021 Motion by Don Hammond seconded by Marie Lorenzini to accept the Minutes for August 12, 2021 as so presented. Motion passed by unanimous vote. Public Comment –None Action Items: Resolution No. 2021-- 55 A resolution of the Nyack Village Board to award the Hudson Avenue Sidewalk Improvement Project (Grant funding stream—CDBG—FY19/NYK0175) Motion by Marie Lorenzini, seconded by Joseph Rand to accept the motion as presented. Motion passed by unanimous vote Resolution No. 2021—56 A resolution of the Nyack Village Board to approve the Abstract of Audited Claims as presented by the Village Clerk Treasurer. Motion by Don Hammond, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote Resolution off the Nyack Village Board to approve Wayfaring Sign Installation to the EXPLORE NYACK VISITORS CENTER Motion by Louise Parker, seconded by Donna Lightfoot-Cooper to accept the motion as presented. Motion passed by unanimous vote Public Comment Drew Burke raised concerns about the Housing Authority Board & operations. Department Reports to the Board of Trustees (based on availability) Orangetown Police Department-- None Village Attorney Walter Sevastian presented the Village Attorney Report. 1. Mr. Sevastian requested that the Board Schedule a Public Hearing on October 28, 2021 at 7:00 PM to consider a Local Law to opt-out of the Retail & On-Site Consumption components of the Marijuana Regulation & Tax Act. Motion by Don Hammond to schedule the Public Hearing on 10/28/2021 at 7:00 pm, seconded by Louise Parker. Motion passed by unanimous vote 2. Mr. Sevastian requested that the Board schedule a Public Hearing to consider a Local Law to change the Zoning of the property known as 60 Catherine Street to make the parcel consistent with the surrounding neighborhood. He explained that the Local Law adoption was delayed by the outbreak of COVID-19. Motion by Don Hammond to schedule the Public Hearing on 10/28/2021 at 7:30 pm, seconded by Louis Parker. Motion passed by unanimous vote. Joseph Rand noted that the times for the just scheduled Public Hearings were in fact prior to the official start of the meeting. He made a motion to change the times to 8:00 & 8:30 respectively. The motion was seconded by Louise Parker. Motion passed by unanimous vote. 3. Mr. Sevastian requested that the Board schedule a Public Hearing on 9/23/2021 at 8:00 pm to consider a Local Law amending Chapter 360-3.2 the Zoning Code of the Village of Nyack with respect to Use-Specific Standards for Solar Collectors. He advised the Board that this law had also been delayed by the outbreak of COVID19. Motion by Don Hammond to Schedule the Public Hearing on 9/23/2021 at 8:00 pm. Motion was seconded by Louise Parker. Motion passed by unanimous vote 4. Mr. Sevastian requested that the Board schedule a Public Hearing on 9/23/2021 at 8:30 pm to consider a Local Law to amend Section 140-15 of the Code of the Village of Nyack entitled “Building Permit, building construction and other Building Department Fees” as pertains to fees charged. Motion by Joseph Rand to schedule a Public Hearing on 9/23/2021 at 8:30 pm. Motion was seconded by Louise Parker. Motion passed by unanimous vote 5. Mr. Sevastian updated the Board on the progress Justice Court’s plea agreement by mail operation. 6. He request the Board go into Executive Session to discuss ongoing Litigation. Motion to go into Executive Session, seconded by Louise Parker. Motion passed by unanimous vote Village Administrator James Slaughter presented his report. 1. Mr. Slaughter updated the Board on emergency repair work being done in response to the impact of Hurricane Ida. As the repairs are temporary in nature the Village will have to explore permanent solution. The Village Engineer is working on solutions & costs. The Administrator has met with FEMA representatives. 2. He advised the Board that a SAM grant of $100,000.00 was received to be allocated Pedestrian Bridge project at the Marina. 3. ZOOM meeting with HVEA, who will be supervising the TAP project 4. The mask mandate for Village Hall has been reinstituted. Village Clerk – Treasurer Lise Chanin presented her report. 1. Ms. Chanin updated the Board on the Site Inspection Report done by the Village Workers Compensation Insurance provider. Old Business Mayor Hammond read an official state on the ECODOCK program. Motion was made my Marie Lorenzini to accept the statement made by the Mayor. Motion was seconded by Joseph Rand. Motion passed by unanimous vote New Business--None Communications Petition from Residents regarding crowds congregating in the neighborhood of the Marina committing multiple code violations including but not limited to prohibited noise & alcohol consumption regulations. Andrea DeVitta presented the petition asking the Board to looking to address the issues arising from people congregating in the Marina/Village parking lot creating noise and litter late into the night. The Mayor & Village Administrator will meet with the resident’s neighborhood Request from St John Deliverance Tabernacle to had hand out flyers at 35 Piermont Avenue. The Board had no issue with the proposal. Request from William Batson for permission to hold a special event Veterans Park on September 18, 2021 from 2:00 PM to 4:00 PM to announce his campaign for the New York State Assembly. Motion was made by Don Hammond to approve the request. Seconded by Louise Parker, Motion passed by unanimous vote Save the Date from the Rockland County Human Rights Commission: The September 23, 2021 unveiling of the Thurgood Marshall Monument. Request by the Legerme & Leleune Families request a Proclamation be issued declaring November 25, 2021 as Cilamise Abellard Day in recognition of Ms. Abellard’s 106th Birthday. The Board decided to Make said motion at the September 23, 2021 Board Meeting. Letter from Steven J Collazuol requesting the Village Engineer investigate a flooding condition on his property. As the issue appears to be an issue with the catch basin, Mayor Hammond the Village Administrator to have the Village Engineer investigate the issue. A late request come in asking to add “Hezekiah Easter Square” to honor the longtime community leader. A Resolution will be done at the 9/23/2021 Village Board Meeting. Letter from Doug Foster regarding the 2022 Charter License. Public Comment Andrea DeVitta inquired about the status of the River Club. The Mayor advised that 2 RFP had not resulted in any viable proposals. Comments from the Village Board of Trustees Marie Lorenzini raised concerns about Halloween Parade and COVID-19. Louise Parker asked for clarification on fire pits, on behalf of a resident. Standalone fire pits are not allowed by State & Local Law, only grills for cooking.
