Minutes of the regular meeting of the Village of Nyack Board of Trustees held at 7:30 on Thursday, September 23, 2021. Motion passed by unanimous vote. Public Comment –None Action Items: Resolution No. 2021-- 58 A resolution of the Nyack Village Board to approve the refund a duplicate tax payment in the amount of $1,343.94 to the owner of 147 High Avenue, Tax Map designation 66.29-2-18. Motion by Louis Parker seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote Resolution No. 2021—59 A resolution of the Nyack Village Board to appoint James A. Slaughter, Village Administrator, as the Village’s RLO for the NYSDOT EBO System User Agreement. Motion by Joseph Rand, seconded by Louis Parker to accept the motion as presented. Motion passed by unanimous vote Resolution No. 2021--60 A resolution of the Nyack Village Board to approve the Abstract of Audited Claims as presented by the Village Clerk Treasurer. Motion by Marie Lorenzini, seconded by Joseph Rand to accept the motion as presented. Motion passed by unanimous vote Resolution No. 2021—61 A resolution of the Nyack Village Board to declare November 25, 2021 Cilamise Abellard Day in the Village of Nyack. Motion by Louise Parker, seconded by Marie Lorenzini to accept the motion as presented. Motion passed by unanimous vote. Resolution No. 2021—62 A resolution of the Nyack Village Board to declare Veterans Park be renamed Hezekiah Easter Veterans Memorial Square. Motion by Louis Parker, seconded by Joseph Rand to accept the motion as presented. Motion passed by unanimous vote. Public Comment; Mayor Hammond updated the public on the situation at the Marina parking. There is a three pronged approach. In the short term the police will increase patrols for the next 3 weeks. Over the next few weeks the Village will evaluate the legislative solutions while assessing the current signage and implement any revisions. Over the longer term the Village will examine the feasibility of other possible solutions such as permit parking, lighting, and possibly gates. Public Hearing to amend the Zoning Code of the Village of Nyack, Chapter 360-2.3 Motion to open the Public Hearing was made by Marie Lorenzini, seconded by Louise Parker. Motion was approved unanimously. Walter Sevastian advised the Board this revision will bring the Village Zoning Code in alignment with the current State Code. No members of the public spoke. Resolution No. 63 of 2021 to approve the Local Law amending the Zoning Code of the Village of Nyack Chapter 360-2.3, Motion made by Don Hammond, seconded by Marie Lorenzini. Motion approved by unanimously. Public Hearing to amend the Code of the Village of Nyack, Section 140-15. Motion to open Public Hearing was made by Don Hammond, seconded by Louise Parker. Motion was approved unanimously. Walter Sevastian reviewed update to the Building Department fees. He noted that the revisions were in line with surrounding communities and were reasonable. No members of the public spoke. Resolution No. 64 of 2021 to approve the Local Law amending Section 140-15 of the Village Code of Nyack. Motion made by Don Hammond, seconded by Marie Lorenzini. Motion was approved by unanimous vote. Department Reports to the Board of Trustees (based on availability) Orangetown Police Department-- None Village Attorney Walter Sevastian presented the Village Attorney Report. 1. Updated the Board on the possible changes to Parks & Recreation portion of the Village Code. He requested that a Public Hearing be scheduled for October 14, 2021. Motion to schedule the Public Hearing on October 14, 2021 was made by Don Hammond, seconded by Louise Parker. The motion passed by unanimous vote. 2. Advised the Board that the Acker family was moving forward with their donation of a boat slip. 3. Updated the on a complaint about the Architectural Review Board operations. He outlined several possible solutions including rolling the functions into the Planning Board, implement a recommendation from the Comprehensive Plan to establish design standards to guide development. He will provide some examples of local design standards to the Board and the Chair of the Architectural Review Board. 4. Requested an Executive Session to review ongoing litigation. Motion for Executive Session was made by Marie Lorenzini, seconded by Joseph Rand. Motion was approved by unanimous vote. Village Administrator James Slaughter presented his report. 1. Update on ongoing and new projects. a. CDBG Project is moving forward b. The Broadway TAP project is delayed by a week c. Hurricane Ida update i. Awaiting updates from the Engineer. He expects that there will have be some Bonding involved 2, Staff training sessions will begin on September 30, 2021. Village Clerk – Treasurer--none Old Business New Business--None Communications Letter regarding ongoing dangerous conditions at the intersection of Midland Avenue & Fifth Avenue because of school buses lining up during dismissal time at the BOCES Riverview School. The Board requested the Administrator Slaughter work with BOCES and the Orangetown Police on solutions to the issues. Letter from MOGY LLC d/b/a Simard & Co, requesting a waiver of the SLA 30 day notice period. The board approved waiver. Motion to approve made by Joseph Rand, seconded by Don Hammond. The motion passed by unanimous vote. Hart Place Block Party The Board approved the block party road closing for the hours of 12:00 pm to 10:00 pm. Motion was made by Don Hammond, seconded by Louise Parker. Motion passed 3 yay, 1 abstaining. Public Comment--None Comments from the Village Board of Trustees Marie Lorenzini thanked DPW heard Jonathan Abrams & his crew for all the hard work they put in during Hurricane Ida and its aftermath. Louise Parker spoke about the COVID restrictions in place for the Nyack Hospital event. She thanked Joe Rand for his efforts coordinating the 911 Memorial event. Joseph Rand advised the Board that a sign on behalf to the Village congratulating Nyack Hospital on 125 years will run on the Jumbo Tron sign at the stadium during the event. The sign was made possible by private donations. He also thanked Annmarie Tlsty of her help on the 911 Event. Don Hammond advised the Board that FEMA has opened up individual claims for damage received as a result of Hurricane Ida. Executive Session 9:47 pm Motion by Louis Parker to exit Executive Session, seconded by Joseph Rand. Motion passed by unanimous vote. Resolution No. 2021-65 Motion by Louise Parker to approve the settlement in the matter of Biondo v. Nyack, and to authorize the Mayor to execute a deed to accept title to premises identified on the Orangetown Tax Maps as parcel 66.46-1-27.2, seconded by Joseph Rand. Motion passed by unanimous vote.
