The motion was approved by a vote of 4-0-1 (Trustee Lightfoot-Cooper absent) Mayor Rand gave an overview of the highlights of the budget which including additions for Camp Nyack, sidewalks, a used electric vehicle, code enforcement position and paving to name a few. This budget is within the tax cap. Motion by Pascale Jean-Gilles, seconded by Joseph Carlin to close the public hearing at 8:11pm. The motion was approved by a vote of 4-0-1 (Trustee Lightfoot-Cooper absent) 6.1 Resolution No. 2024-58 Resolution of the Nyack Village Board accepting audited voucher summary WHEREAS, the Audited Voucher Summary was presented to the Nyack Village Board of trustees at its regularly scheduled meeting of April 11, 2024. RESOLVED, that General Fund Claims set forth on pages 1 through 17 in the amounts of GENERAL $26,286.74 PARKING $4,831.75 Page 1 of 4  WATER $20,000.22 CAPITAL $9,485.00 CAPITAL PROJECTS – H1 $14,913.76 Motion by Pascale Jean-Gilles, seconded by Nathalie Riobe-Taylor to accept the resolution as presented. The motion was approved by a vote of 4-0-1 (Trustee Lightfoot-Cooper absent) Resolution No. 2024-59 SEQRA Determination of Non-Significance/Negative Declaration re. PFAS Treatment at the Nyack Water Treatment Plant WHEREAS, in accordance with Part 617 of the Regulations of the State Environmental Quality Review Act (“SEQRA”), there being no other SEQRA Involved Agency besides the Village Board of Trustees (“Village Board”), or, if there are other Involved Agencies, they have been given Notice of the Village Board’s Intention to Declare itself to be SEQRA Lead Agency, and, after more than thirty days having elapsed, the other Involved Agencies have either consented, or did not object, to the Village Board acting as Lead Agency, in accordance with SEQRA Coordinated Review, the Village Board hereby Declares itself to be the SEQRA Lead Agency in the environmental quality review of the proposed land use action, as per SEQRA Regulation 6 NYCRR §617.6(b)(5)(v); which proposed land use action is described under the heading of “Purpose and Need and Project Description” set forth in the “State Environmental Quality Review Negative Declaration Notice of Determination of Non- Significance,” dated April 8, 2024 (“Determination of Non-Significance”), which is appended hereto, made a part hereof, and incorporated by reference as if fully set forth herein. WHEREAS, the Village Board, acting in its capacity as the SEQRA Lead Agency, and after reviewing Part 2 of the SEQRA Full Environmental Assessment Form (“EAF”), entitled Identification of Potential Project Impacts, and after reviewing Part 3 of the SEQRA EAF, entitled Evaluation of the Magnitude and Importance of Project Impacts and Determination of Significance, both of which Parts of the EAF are dated April 2024, and were prepared and recommended, on behalf of the Village Board, by the Village’s consulting engineers, H2M Architects, Engineers, Land Surveying and Landscape Architecture (“H2M”); the Village Board hereby adopts the said EAF Parts 2 and 3, and incorporates them by reference as if fully set forth herein. THEREFORE, BE IT RESOLVED, that the Village Board, after conducting a “hard look” review of all environmental factors, including, but not limited to, both of the aforesaid Parts 2 and 3 of the EAF, and as more particularly described in the annexed Determination of Non- Significance, hereby finds and determines that there will be no potential significant adverse environmental impacts resulting from the Village Board’s implementation of the proposed land use action, and makes a Determination of Non-Significance under SEQRA, thereby determining and issuing a SEQRA Negative Declaration. The motion was approved by a vote of 4-0-1 (Trustee Lightfoot-Cooper absent) Department Reports to the Board of Trustees Village Administrator – The restaurant bump-outs will start going in after this weekends’ street fair. The Nyack Memorial Park project is continuing, the grass will be planted soon. The playground will be installed in May. The Village will need to apply for the DRI grant by September. Steve Cea and Marcy Denker are being recognized by the County Legislature for their work on sustainability. There will be a pop-up food truck from Bongo Fries on April 19th at Boxer Donut location. Old Business Motion by Nathalie Riobe Taylor, seconded by Pascale Jean-Gilles to set a public hearing on May 9 at 8pm for land use board legislation changes. The motion was approved by a vote of 4- 0-1 (Trustee Lightfoot-Cooper absent) The Board is committed to keep moving forward with the ETPA within the confines of the lawsuit. New Business The “Riverspace Sign” is owned by the building however it is old and dilapidated. The building department will talk to the owner and see if it can be removed or updated. The Chamber of Commerce booth should also be updated and used. Mayor and Trustee Reports Joseph Rand – This coming Friday night there is a vigil for the Palestinian victims at Hezekiah Easter Square at 6pm. Pascale Jean-Gilles – The Iftar went well and it was well attended. It will be an annual event. There was a DRI grant meeting and a good plan was developed. Joseph Carlin – The Rockland County Housing Forum is on Friday April 19th at 9am at the Rockland County Fire Training Center. Public Comment Drew Burke – Someone is going around and picking up peoples’ recycling and returning the bottles and cans for money. Mara – During the Palestinian Ceasefire protest someone tried to hit the protesters and if the Board passed the resolution maybe these things would not happen. The incident was reported to the police. Page 3 of 4 Rhea Matthews – She has been reaching out but the Board has not been responsive. Palestinians are still being killed. Nobody should be too busy to condemn genocide. Emily Feiner – She is disappointed in the Board for not considering the ceasefire resolution. Skylar Hamrick – There needs to be a safer community to disagree. Executive Session Motion by Joseph Carlin, seconded by Nathalie Riobe-Taylor to move to executive session at 8:50pm. The motion was approved by a vote of 4-0-1 (Trustee Lightfoot-Cooper absent) Motion by Nathalie Riobe-Taylor, seconded by Pascale Jean-Gilles to move out of executive session at 10:00pm.
